Natural Resource Design Standards Manual Report CITY OF SHAKOPEE 1;J. .n. r . ~ Memorandum To: Mayor and City Council Mark McNeill, City Administrator From: Ryan Hughes, Natural Resource Specialist On Behalf of the Environmental Advisory Committee Subject: Natural Resource Design Standards Manual Proposal Meeting Date: February 21,2006 INTRODUCTION CR Planning has provided a proposal to work with the City of Shakopee to complete the Natural Resources Design Standards Manual. The Environmental Advisory Committee recommends approval of the proposal and for work to begin on the Natural Resource Design Standards Manual. BACKGROUND On November 14,2005, staff and representatives from the Environmental Advisory Committee presented an update on the work completed in creating a Natural Resource Corridor system. Following this presentation, City Council authorized work to finalize the Natural Resource Corridor Map and to begin developing the Natural Resource Design Standards Manual. DISCUSSION CR Planning was the firm that assisted the City in analyzing the natural resources and developing the Natural Resource Corridor map. This work was funded by the DNR as part of a grant that the City received. Due to the anticipated workload in 2006 for the Natural Resource Specialist, we asked CR Planning for a proposal to continue working with the City and helping to develop the more detailed design standards. CR Planning has provided a proposal with a cost not to exceed $15,000. The average hourly rate CR Planning would be charging is $55. Funding to complete the project is available in the Natural Resources budget. The Natural Resources budget includes $10,000 in professional services to complete a Wetland Management Plan. In essence, the Natural Resource Design Standards Manual will include the same information and provide the same preservation policies as a Wetland Management Plan. Thus, staff recommends the $10,000 be utilized for work to be completed on the Natural Resource Design Standards Manual. The additional $5,000 to complete the work would be funded by the money budgeted to complete the Natural Resource Inventory update. Based on information obtained fromthe engineering department, the cities of Scott County have decided not to take aerial photos of the county until 2007. If a Natural Resource Inventory were to be completed in 2006, the most recent aerial photos taken in 2003 would be utilized. This would only update the inventory to 2003 conditions. All development occurring between 2003 and 2006 would not be included in the update. Thus, staff recommends utilizing the $5,000 budgeted to complete the Natural Resource Inventory Update to complete the Natural Resource Design Standards Manu~l in 2006, ~nd defer the Natural Resourcelnventory update until after new aerials are available. I have enjoyed working with you, Ryan and the Environmental Advisory Committee throughout the past year. Moving into implementation of the map would be exciting. My skills as an attorney and my experience developing multiple land use ordinances, many with a focus on natural resource protection, are directly applicable to this project My familiarity with the Priorities Map would help the project move quickly over the proposed four-month timeline which includes one month for public hearing and adoption. Attached to this proposal is a detailed work plan and a resume describing projects I have managed. In addition to my general enthusiasm for working on natural resource ordinances, my specific skills most relevant to this project are: Deve!opin<..f!, natura! resource protection ordinances - I am familiar with a broad range of techniques for protecting natural resources through development ordinances. I am also very familiar with the minimum state and federal standards for shoreland, wetland, erosion and sediment control, and floodplain controls. I have applied this knowledge in ordinances for multiple local governments in Minnesota. Managingprojeds on tight timelines - I managed a 10- week project to develop program guidelines for the Dakota County Farmland and Natural Area Program. Working with a committee of the Metropolitan Council, I managed a three-month project to develop rural policiesfor Blueprint 2030. The keys to success for both of these projects were consistent contact with the client and a clear schedule with milestones. . In addition, my current workload is decreasing with projects ending in December. I have only one project continuing into early 2006 and would be able to devote enough time to this project to complete it by the beginning of the building season in 2006. The following page contains a work plan and schedule reflecting our discussion about scope and schedule. I have highlighted tasks where staff will contribute time or take the lead. The proposed scope does not include outreach to the general public or stakeholders. It is assumed staff will manage outreach such as open houses and review by stakeholder groups. To accomplish the proposed work plan I estimate a total of 274 hours. In addition to me, my project assistant will provide word processing, layout and illustration assistance. The total estimated cost of the proposed scope is $15,000; with an average hourly rate of $55. Thank you for considering this proposal. Ms. Coleman's work :R~~~~i combines her interests in planning and law by using public participation and conflict resolution techniques to develop policies, ordinances, and programs. JEAN COLEMAN Ms. Coleman enjoys working in a variety of landscapes and has managed multiple projects at the neighborhood, township, county and regional scale. EDUCATION of Natural Resources, Jean is facilitating natural resource-based land use Juris Doctorate planning in three communities faced with growth pressures. She developed a refmed greenways plan for the City of Shakopee, J\1N, based on a recently University ofIowa, 1986 completed :MLCCS natural resources inventory. The greenways plan identifies M.A. Urban & Regional Planning areas for protection and recommends strategies for implementation. Jean is also working with the City of Oak Grove to raise awareness of natural University ofIowa, 1986 resources and how development design choices can protect or impact these RA. Political Science resources. Jean obtained funding for a natural resources inventory and recently completed a "BioBlitz" as part of raising awareness for the Mid- University of Northem Iowa, 1983 Minnesota stretch of the Mississippi River, north of St. Cloud. EMPLOYMENT EXPERIENCE . Comparative Research of State-level Land Conservation Initiatives, March 2003 - present 2005. Jean researched efforts in twelve states to develop state-level land President/ Owner conservation initiatives. The research was used by the Campaign for CR Planning, Inc. Conservation, a consortium of environmental and sportsmen's organizations Minneapolis, :MN developing a 50-year vision for land conservation in Minnesota. 1993 - 2003 . Jean developed public participation and land use implementation sections for Minneapolis, :MN EnvironmentallY-Based &gionalSmartGrowth Planning and Design. This handbook presents a GIS-based process for analyzing green infrastructure and 1990 -1993 determining local protection and development priorities. The Metropolitan Midwest Office Director Council funded the application of the process in Washington County,:MN. American Farmland Trust Chicago, IL . Farmland and Natural Area Program Guidelines, 2003. Jean managed the creation of an implementation guidebook for the Dakota,County 1987 -1990 Farmland and Natural Area Program. The $20 million, ten-year program will Project Manager protect priority farmland and natural areas in Dakota County through the Trust for Public Land purchase of land and easements. The guidebook project involved working New York, NY with Dakota County staff and Board of Commissioners to develop policies for project selection, property valuation, negotiations with landowners, and 1986 -1987 property management. Jean Middletown, NJ managed policy and implementation strategy development for the Twin Cities Metropolitan Council's Rural Issues Work Group as part of the update of the 2030 Regional Blueprint. Recommendations included: enhancement of traditional rural population centers through coordinated planning with surrounding rural areas, transportation improvements and utility investment; defining urban expansion areas; cost estimates and program components of a regional Purchase of Development Rights (PDR) program; and promotion of a Transfer of Development Rights (TDR) program. Jean worked with the Minnesota Dept. of Natural Resources and the Minnesota CQ;IlUll;Unttjl Erosion Control Association to create model stormwater, erosion control, Ri}~:OO;%$ shorelandand subdivision ordinances to protectwater quality. The JEAN COLEMAN ordinances contain options for rural and urban communities and communities with high to low levels of administrative staffmg. Working with a national PROFFESSIONAL team managed by Prof. Thomas Daniels, University of Pennsylvania, Jean evaluated conservation easements in eight states for their effectiveness in ASSOCIATIONS meeting the goals of the National Fish and Wildlife Foundation (NFWF). Admitted to Minnesota State Bar NFWF has made grants to local land trusts for twenty years for the acquisition since 1994 of conservation easements to protect habitat. The easement impact survey assessed the effectiveness of these easements in meeting NFWF habitat 1000 Friends of Minnesota protection goals. Board of Directors . Jean authored the guidebook Project NEMO Protecting Your Communi!}'s Natural Resources: A Land Protection Toolbox for Local Steering Committee Government as part of the LCMR-funded Green Corridor Project. The (Non-point Education for Toolbox guides local governments in the implementation of a natural resource Municipal Officials) protection plan using incentive-based techniques such as PDR and TDR. The model ordinances are used by local governments and include urban expansion districts, natural resource protection districts, transfer of development rights (TDR); and natural resource protection overlays. . 'Natural Resource Protection Ordinances, 1996-2005. Jean has incorporated natural resource protection in zoning, subdivision, and traditional neighborhood design (IND) ordinances for Clay County, MN; Crow Wing County, MN; Linn County, IA; Rice County, MN; Itasca County, MN; Cook County,:MN; Town of Farmington, WI; City ofMt. Horeb, WI; and the City of North Branch, MN. These ordinances include cluster/ conservation subdivision districts, agricultural and forest protection clistrtcts,natural resource protection overlays, scenic protection districts, transfer of development rights (!DR), mixed-use districts, and defined urban service areas.
