SUBJECT: Update on Feasibility Report for Trunk Sanitary
Sewer Extension along CSAH 83, from Church Addition to
Valley View Road, Project No. 2006-6

INTRODUCTION:
Staff will provide an update on the CSAH 83 sanitary sewer extension project for an
alternative on the east side of CSAH 83. Attached is Resolution No. 6377, a resolution
which reschedules the public hearing until March 6, 2006.
BACKGROUND:
At the January 17, 2006 meeting, Council authorized a feasibility report to be prepared by
WSB & Associates, Inc. by adopting Resolution No. 6361. On February 7, 2006, City
Council accepted the feasibility report by adopting Resolution No. 6363. A public
hearing was scheduled for March 7,2006 for this project.
Attached to this memo is Resolution No. 6377, a resolution which changes the public
hearing to March 6,2006 due to precinct caucuses on March 7, 2006.
Since the Council meeting on February 7, 2006, staff has had discussions with Stan
Ellison, Land and Natural Resources Manager of the Shakopee Mdewakanton Sioux
Community (SMSC), for a possible temporary easement on the east side of CSAH 83.
Attached is a letter and drawing requesting consideration of temporary easements by
SMSC to the City.
The SMSC has met on this request on Wednesday February 15, 2006 and they have
indicated verbally that they would grant a temporary easement of 5.3 acres at a cost of
$100,000.00. This easement cost is less than the projected easement acquisition cost on
the west side ofCSAH 83.
For the west side alternative, the easement acquisition cost is estimated at $217,875.00.
The contribution from Pulte Homes is an additional $90,000.00 to eliminate a lift station
needed for River Valley Estates 2nd Addition.
Based on the reduced cost of easements needed to construct the Trunk Sewer, the east
side alternative would be the most cost effective and could be obtained without
condemnation.
Another item for the project is whether an EA W is needed or not. At this time, the
MPCA has not determined whether an EA W is needed or not. An answer is expected by
the March 6, 2006 meeting.
The purpose ofthis agenda item is to update the Council of items affecting this project.
A public hearing would still be held for the project on March 6, 2006 and a final decision
can be made at that time. Council can provide staff direction on proceeding with the
project. If the project is to proceed, staff recommends adopting Resolution No. 6377 for
rescheduling of the public hearing date.
AL TERNAITVES:
1. Provide staff direction on proceeding with this project.
2. Do not provide direction at this time, but wait until the public hearing.
3. Adopt Resolution No. 6377, to reschedule the public hearing date to March 6,
2006.
RECOMMENDATION:
Staff recommends adoption of Resolution No. 6377, to reschedule the public hearing date
and for Council to provide direction to staff prior to the hearing on this project.
ACTION REQUESTED:
1. Provide staff direction on proceeding with this project.
2. Offer Resolution No. 6377, A Resolution Receiving a Report and Calling a
Hearing for the CSAH 83 Trunk Sanitary Sewer Extension, from the Church
Addition to Valley View Road, Project No. 2006-6 and move its adoption.

And Calling A Hearing For The
CSAH 83 Trunk Sanitary Sewer Extension,

WHEREAS, pursuant to Resolution No. 6361 of the City Council adopted January 17,
2006, a report has been prepared by the City Engineer, with reference to the CSAH 83 Trunk
Sanitary Sewer Extension, from the Church Addition to Valley View Road, Project No. 2006-6,
and this report was received by the Council on February 7, 2006,
WHEREAS, Resolution No. 6363 received this report and called for a public hearing on
March 7, 2006,
WHEREAS, the Council meeting date has been changed to March 6, 2006 due to precinct
caucuses on March 7, 2006.
NOW, THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. The Council will consider the CSAH 83 Trunk Sanitary Sewer Extension, from the
Church Addition to Valley View Road and all appurtenant work in accordance with the report
pursuant to Minnesota Statutes Chapters 429 and 444 at an estimated total cost ofthe improvement
of $90 1 ,331.25.
2. A public hearing shall be held on such proposed improvements on the 6th day of March,
2006, at 7:00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street,
Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and
improvement as required by law.
3. The work of this project is. hereby designated as part of the 2006-6 Public Improvement
Project.
Adopted in session of the City Council of the City of Shako pee,
Minnesota, held this day of , 2006.

RE: Temporary Easements for CSAH 83 Sewer
Dear Stan:
As we have discussed over the phone, the City of Shakopee is interested in extending the
sewer line on CSAH 83 to Valley View Road to eliminate a lift station associated with
River Valley Estates. Attached is a drawing showing the amount of temporary easement
needed to complete the construction.
This potential proj ect does have a tight timeline for the sewer li:rie to be completed.
Please ask the Tribal Council if a temporary easement could be granted and at what
compensation they would require. I would need an answer back by Thursday to update
City Council for Tuesday's meeting. I apologize for the short notice and should have
contacted you earlier for a possible easement.
The City would be considering a lateral sewer connection charge to properties that would
connect to this line in the future. In past discussions with Shakopee Mdewakanton Sioux
Community's (SMSC) staff, the Community will serve their property with their sewer
system and treatment plant. In other words, no cost would be charged to the SMSC
unless they connected to this line.
Please review my request, accept my apology for the short notice and let me know what
the decision is on Thursday. If you have any questions on, this letter or the attached
drawing, please call me.
