Michael Leek, Community Development Director SUBJECT: Text Amendment Regarding Monument Signage MEETING DATE: February 21,2006 INTRODUCTION: Recently, the City Council upheld the action of the Board of Adjustments and Appeals (BOM) in denying the application of Furniture Outlet for a variance to allow second monument sign on Twelfth Avenue. However, the Council directed staffto prepare a text amendment for consideration that would allow signs in such cases, so long as the area of the signage permitted would not exceed the total area currently permitted on the site. ALTERNATIVES: 1. Offer and pass Ordinance No. 747, approving the text amendment as presented. 2. Offer and pass Ordinance No. 747, approving the text amendment with revisions. 3. Do not approve the proposed text amendment. 4. Table the matter for additional information. PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed the proposed text amendment at its meeting of February 9, 2006. It voted 4-0to recommend denial of the proposed text amendment. The sense of the commissioner's discussion was that a) they felt the ordinance provided adequate opportunities for signage that would have met needs such as those expressed by Furniture Outlet (e.g. use of directional signage), and b) they felt that the proposed amendment was developed to respond to one situation, and that it Was not in the City's best interest to do so. Michael Leek Community Development Director H:\CC\2006\02-21\PC06-016 Text Am monument signs CC.doc ORDINANCE NO. 747, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CHAPTER 11.70, SUBDIVISION 9, COMMERCIAL SIGN REGULATIONS TIlE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - That City Code Chapter 11.70, Subd. 9, Commercial Sign Regulations,is hereby amended by adding the language, which is underlined, and deleting the language that is stfl:lek: through. ~ B. Freestanding and Business Complex Signs. Freestanding and business complex signs shall be pennitted subject to the following: 1. all freestanding signs shall be monument style. Properties adjacent to arterial roadways shall be allowed freestanding pole signs; 2. one (1 ) square foot of signage shall be allowed per linear foot of street frontage; 3. maximum of 125 square feet (per side for double sided signs); 4. one (1) sign shall be allowed per lot, except that business complexes shall be allowed one or more sign per street frontage, so long as the total area ofthe monument signs does not exceed the total sign area permitted under 2 above. One (1) sign shall be allowed per lot, except that business complexes shall be allowed one (1) sign per street frontage. Placement of these signs may be allowed along any of the street frontages at the discretion of the property owner(s). so long as the total number of signs does not exceed the number of street frontages for the property. Re-number accordingly. Section 2- - Effective Date. This ordinance becomes effective from and after its passage and publication.
