INTRODUCTION:
Attached to this memorandum is Resolution No. 6363, a resolution accepting the
feasibility report and establishing a public hearing date for March 7, 2006 for the CSAH
83 Trunk Sanitary Sewer Extension, from the Church Addition to Valley View Road.
Also attached is Resolution No. 6365, a resolution authorizing eminent domain
proceedings.
BACKGROUND:
On January 17, 2006, City Council adopted Resolution No. 6361, a resolution ordering
the preparation of a report for the CSAH 83 Trunk Sanitary Sewer Extension, from the
Church Addition to Valley View Road. The City also authorized an extension agreement
with WSB & Associates, Inc. to prepare the feasibility report.
Attached is the feasibility report outlining the project costs, project funding, easement
acquisition and lateral sewer connection charge associated with this trunk sanitary sewer
extension. This project will provide a sewer service to the area west of CSAH 83 and
south of Church Addition known as the Southwest Shakopee District. The trunk sewer
extension does provide lateral sewer benefit to parcels adj acent to the trunk sewer
location. Also, extending this sewer will eliminate a lift station in the River Valley
Estates 2nd Addition.
Associated with this project and the feasibility report, is a need to acquire additional
easements from property owners along CSAH 83. Staff is requesting authorization for
eminent domain proceedings in order to obtain the right-of-way to meet the proposed
project schedule. If the project is not approved at the March 7,2006 public hearing, staff
would not proceed with filing a petition for condemnation of the easements. It has been
proposed by Pulte Homes, Inc., the developer of River Valley Estates that they would
contribute $150,000.00 towards the City's trunk expenditures and an additional
$90,000.00 for the lift station not having to be constructed if the sewer is in operation by
September, 2006. In order to meet the time line of September, 2006, an authorization for
eminent domain proceedings needs to be done at the February 7,2006 Council meeting.
Lateral sewer to developing properties can be assessed or a lateral sewer connection
charge determined for each trunk sewer project. For this project, a lateral sewer
connection charge is recommended. The reason for this recommendation is that the
properties adjacent to CSAH 83 sewer are not proposed to develop at this time and an
assessment on the property might cause theneed to develop.
ALTERNATIVES:
1. Adopt Resolution No. 6363, a resolution accepting the feasibility report and
establishing a public hearing for March 7,2006 for the CSAH 83 Trunk Sanitary
Sewer Extension, from the Church Addition to Valley View Road.
2. Adopt Resolution No. 6365, a resolution authorizing eminent domain proceedings
for the Trunk Sanitary Sewer. Extension Project.
3. Do not approve these resolutions at this time.
4. Table for additional information.
RECOMMENDATION:
Staff would recommend Alternative No.1 and No.2 in order to proceed with this project,
to provide a gravity sanitary sewer service to River Valley Estates and other areas beyond
and in order to have a public hearing on March 7,2006.
ACTION REQUESTED:
1. Offer Resolution No. 6363, A Resolution Receiving a Report and Calling. for a

WHEREAS, pursuant to Resolution No. 6361 of the City Council adopted January 17,
2006, a report has been prepared by the City Engineer, with reference to the CSAH 83 Trunk
Sanitary Sewer Extension, from the Church Addition to Valley View Road, Project No. 2006-6,
and this report was received by the Council on February 7, 2006.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. The Council will consider the CSAH 83 Trunk Sanitary Sewer Extension, from the
Church Addition to Valley View Road and all appurtenant work in accordance with the report
pursuant to Minnesota Statutes Chapters 429 and 444 at an estimated total cost of the improvement
of$901,331.25~
2. A public hearing shall be held on such proposed improvements on the 7th day of March,
2006, at 7:00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street,
Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and
improvement as required by law.
3. The work of this project is hereby designated as part of the 2006-6 Public Improvement
Proj ect.

RESOLUTION NO. 6365
A Resolution Of The City of Shakopee, Minnesota,
Determining The Necessity For And Authorizing
The Acquisition Of Certain Property
By Proceedings In Eminent Domain
WHEREAS, the City of Shakopee is a municipal corporation organized and operating
under Minnesota law, and is authorized by Minnesota Statutes Sections 412.211 and 465.01 to
acquire private property for an authorized public purpose, using the procedure prescribed by
Minnesota Statutes, Chapter 117; and
WHEREAS, the City Council has determined that the City needs to construct a trunk
sanitary sewer extension along CSAH 83, from the Church Addition ton Valley View Road
("Project") in order to provide public sanitary sewer service to adjacent and nearby property; and
WHEREAS, the City has identified the need to acquire permanent and temporary
easements over certain real property described on the attached Exhibit A and Exhibit B (the
"Property") for purposes of construction of the Project; and
WHEREAS, the City has been unable to successfully negotiate the acquisition of the
necessary easements for the Proj ect.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS:
1. Acquisition by the City of the Property described on Exhibit A and Exhibit B is
necessary, convenient and reasonable for the purpose of constructing the Project.
2. The City Council deems it necessary in order to meet the anticipated construction
schedule for the Project to acquire title to and possession of the Property prior to the
filing of a final report of commissioners, in accordance with Minnesota Statutes,
Section 117.042.
3. The City Attorney is authorized and directed on behalf of the City to acquire
permanent and temporary easements for street, highway, sidewalk, utility and
drainage purposes for the Project by the exercise of the power of eminent domain
pursuant to Minn. Stat. Chapter 117, and is specifically authorized to notify the
owners ofintent to take possession pursuant to Minn. Stat. Sec. 117.042.
4. The City Engineer is authorized to approve the appraised value for the Property if
the City Engineer determines that the appraisal adequately reflects the fair market
value of the Property.
5. The City Attorney further is authorized to take all actions necessary and desirable to
carry out the purposes ofthis resolution.

I 1. INTRODUCTION
On January 17,2006, the City of Shakopee ordered the preparation of a feasibility report to be
I prepared by WSB & Associates, Inc. for a trunk sanitary sewer extension from the Church
Addition to Valley View Road, City Project No. 2006-6.
I 2. SCOPE
Thisreport addresses the anticipated project costs and feasibility of extending a trunk sanitary
I sewer from the Church Addition approximately 4,000 feet south along CSAH 83 to Valley View
Road. See Figure 1 in the Appendix for a project location map.
I 3. BACKGROUND
The existing sanitary sewer line from the Church Addition is proposed to be extended along
I CSAH 83 to provide trunk sanitary sewer to undeveloped properties in the southwest area of the
City of Shakopee that currently do not have sanitary sewer. The proposed areas to be served are
identified in the City of Shakopee's Comprehensive Sanitary Sewer Plan asSub-Districts: SS-C,
I SS-E; SW-A, SW-B, SW-C, and SW-D.
To extend the trunk sewer to Valley View Road, the proposed alignment will extend through the
I properties of 1868 County Road 83, 1870 County Road 83, 3300 Valley View Road, 2036
County Road 83 and the proposed River Valley Estates 2nd Addition, which is currently at the
preliminary plat stage of the development process.
I Both temporary and permanent easement acquisitions will be required as defined by the
proposed project scope. Easements will need to be acquired for the properties of 1868 County
I Road 83,1870 County Road 83, 3300 Valley View Road, 2036 County Road 83 and River
Valley Estates and may require eminent domain proceedings.
3.1 Existing Conditions
I 3.1.1 Roadway
I The proposed project area runs along approximately 4,000 feet of CSAH 83 to
Valley View Road. Through the entire project area, CSAH 83 is a two-lane,
paved rural section highway. This project is not anticipated to impact the existing
I roadway surface.
3.1.2 Sanitary Sewer
I The existing sanitary sewer within the project area consists of 18-inch PVC pipe
and was installed in 2004. This sanitary sewer trunk was extended to the south
I plat line of the Church Addition with the construction of that subdivision. , The
existing trunk is shown on Figure 2. This pipe has been sized to accommodate
development in the southwest area of the City of Shakopee in accordance with the
I City's Comprehensive Sewer Plan. An 18-inch PVC pipe was also installed
under Valley View Road as part of the recent road improvements. The sewer
extension project is proposed to connect to this pipe.

I 3.1.3 Existing Property Owners
The existing sanitary sewer line lies within the property of the Church Addition.

3.1.4 Existing Utilities
I Center Point Energy has an 8-inch.steel high pressure gas main that runs along the
west side of CSAH 83 from CSAH 16 to approximately 1,000 feet south. This 8-
I inch main then crosses CSAH 83 diagonally from the west to the ,east and
continues east along the south plat line of the Church Addition. Where the 8-inch
gas main crosses CSAH 83 a 2-inch plastic gas line extends to the south along the
I west side of the CSAH 83 to approximately 35 feet south of the driveway to the
1868 CSAH 83 property. The 8-inch gas main is located north ofthe existing
sanitary sewer manhole within the Church Addition and will not be crossed with
I this project. The 2-inch gas line may require relocation or support when the
proposed sanitary sewer is installed.
I There are overhead power lines located on the east side of CSAH 83 that will
likely require support during construction. This overhead power line runs
north/south and has service lines crossing to west to serve the existing properties.
I Fiber optic, telephone and cable television lines are also located on the east side
of CSAH 83 at the north end of the project. At the north end of the project, these,
utilities are located on the west edge of the proposed trench excavation limits and
I will likely require relocation or support during construction.
4. PROPOSED IMPROVEMENTS
I 4.1 Sanitary Sewer
I The proposed project involves the construction of an IS-inch trunk sanitary sewer to be extended
southerly along CSAH 83. The extension will begin at the existing trunk sanitary sewer near the
southwestern corner of the Church Addition. The proposed pipe size and elevations are designed
I to meet the capacity and depth requirements to serve the future development to the south by
gravity sewer. See Figure 3 for the proposed pipe alignment.

I The pipe alignment is proposed to extend through a primarily undeveloped area of the City. The
area is currently zoned agricultural but is anticipated to be developed into residential and/or
commercial areas in the future. The proposed sanitary line will connect to the existing 18-inch
I trunk sanitary line at the south end of the Church Addition, and will extend approximately 400
feet to the south, then run to the southwest and cross beneath CSAH 83. The connection to the
existing Church Addition sanitary sewer will be completed by core drilling the existing manhole.
I The crossing beneath CSAH 83 is proposed to be installed by jacking since Scott County will not
allow this road to be closed to traffic. The trunk sanitary sewer will extend to the south along the
west side of CSAH 83 to Valley View Road. The portion of trunk sanitary sewer through the
I River Valley Estates 2nd Addition development will be installed as part of that development's
utility construction.
I The land on the east side of CSAH 83 is owned by the Mdewakanton Sioux. The Mdewakanton
Sioux have indicated their property could be served by a private sewer system and may not
require public sanitary sewer service. Therefore, the sewer is proposed to pe constructed on the
I east side of CSAH 83 for the initial 400 feet of the pipe extension and cross to the west side of
CSAH 83 to serve the west side properties. The sewer is proposed to be placed on the east side
for the first 400 feet to avoid impacting the property at 1776 CSAH 83 which has structures close
I to the roadway.
I The pipe construction proposed with the City's project terminates at the north plat line of the
River Valley Estates 2nd Addition development. Further extension of this sanitary line will be
constructed with of the River Valley Estates 2nd Addition utility construction.
I At the north end of the proposed project the sewer depths are approximately 40 feet. The pipe
shallows as it extends to the south to 25 feet deep at the north property line of2036 County Road
I 83 and 15 feet deep at the north plat line of the River Valley Estates. Due to the depths of the
sewer, it is proposed to use 18-inch diameter HOBAS pipe for this trunk sanitary sewer
extension project. Hobas pipe is a specific manufactured brand of pipe that is a fiber glass
I reinforced pipe and is designed for deep installations. It also provides the benefit of being
virtually water tight and will minimize potential for groundwater infiltration. This type of pipe
was recently used as part of Shakopee's River District Sanitary Sewer project.
I Due to the significant depths required for the installation of this sewer and limited area for
construction, this project will use special construction techniques. These techniques include
I trench box construction and/or back casting to minimize the width of excavation to protect
roadways, culverts, existing utilities and miscellaneous structures. The excavation width is also
minimized to reduce the amount of temporary and permanent. easements to be acquired; and to
I keep construction within existing right-of-way where no easements are proposed. This will
increase construction costs due to the extra difficulty in construction using these techniques. The
design of the alignment for the sanitary sewer kept the limits of the trench excavation a minimum
I of IS-feet from the edge of driving lanes on CSAH 83. This may require temporary traffic
barriers along the edge of CSAH 83 to protect the public from the deep excavations. A cross
section of the design trench width used for the design of the trunk sanitary sewer alignment is
I shown in Figure 4 in the Appendix.

I The installation of the trunk sewer across the property at 2036 County Road 83 (Koehnen
property) is proposed to be accomplished by one of two possible installation methods. The first
installation method (Alternate 1) would be by open cut trench construction. This method would
I involve clearing and grubbing the trees from the wooded area on this property and require a 40-
foot-wide permanent easement and a 25-foot temporary construction easement. There would
also be costs involved with the removal of all trees located within the proposed easements and
I outside of CSAH 83 right-of-way. The second method of installation (Alternate 2) would be to
directionally drill the trunk sanitary sewer using a HDPE pipe. This method would minimize the
impact of construction on the property and would reduce the amount of easement area required.
I CSAH 83 is proposed to be widened to a four-lane divided highway in the near future. The trunk
sanitary sewer extension alignment must be located far enough away from the future roadway so
I' the sewer can be maintained and repaired without disrupting traffic. This preliminary sewer
alignment was designed considering the future roadway widening dimensions, but may be
modified by Scott County in the plan review process.
1 4.2 Easement Acquisition
I The proposed pipe will be crossing the properties of 1868 County Road 83, 1870 County Road
83,3300 Valley View Road, 2036 County Road 83, and the proposed River Valley Estates 2nd
I Addition site. It is proposed to acquire an 80 to 40-foot-wide permanent utility easement for
operating and maintaining the trunk sanitary sewer. An additional 40 to 25-foot-wide temporary
easement on the west side of the permanent utility easement will also need to be acquired for the
I sanitary sewer construction. See Figure 3 in the Appendix for the locations of these easements.
It is anticipated that the eminent domain process will need to be utilized for the easement
acquisition for the property at 2036 County Road 83 (Koehnen property). The use of directional
I drilling or other trenchless technology for the construction across this property will eliminate the
temporary easement. The eminent domain proceedings typically require at least 90 days before
the City would be able to enter the property. The schedule established for this project provides
I an allowance for this contingency. River Valley Estates 2nd Addition will provide the necessary
easements for the trunk sanitary sewer with the final plat for this development. Due to the
project schedule the construction limits, and therefore the easement width needs, have been
I estimated using available soil data. Completion of on site borings are necessary to verify these
assumptions.
I 4.3 Permit Applications
If it is the City Council's intent to move this project forwar4 into construction, the following
I permits will need to be prepared and submitted on behalf of the City. It is anticipated that the
City will provide fees for the submittals.

I 5. PROJECT COSTS
A detailed cost estimate can be found in the Appendix. The following costs were prepared using
I 2005 construction costs and are subject to change, depending on the final design of the project,
bids received, and actual work performed. The total project costs, including construction and
easement acquisition cQsts are estimated to be $894,718.75 for Alternate 1 and $901,331.25 for
I Alternate 2. These costs include a 10% construction contingency and 25% indirect including
engineering, legal, and administration costs for the project.
I It should be noted this feasibility study addresses the extension of sewer from the Church
Addition to Valley View Road, but the cost estimates for this trunk sanitary sewer only extend
from the Church Addition to the north plat line of Ri ver Valley Estates. The portion of trunk
I sanitary sewer from the north plat line of River Valley Estates to Valley View Road will be
constructed with the utility construction of the River Valley Estates 2nd Addition.
I 5.1 Sanitary Sewer
The total project construction costs are estimated to be $676,843.75 for Alternate 1 and
I $697,331.25 for Alternate 2. These costs include a 10% construction contingency and 25%
indirect including engineering, legal.and administration costs for the project. Alternates 1 and 2
I are comparisons for installing the trunk sanitary sewer across the property at 2036 County Road
83 (Koehnen property) as discussed in Section 4.1 of this study. There are alsooversizing and
overdepth costs associated with this project. Oversizing (and overdepth) costs are determined by
I any costs associated with installing a sewer greater than an 8-inch line and typically at a depth of
greater than 12 feet. The oversizing costs for this project are $488,867.50 for Alternate 1 and
$509,355.00 for Alternate 2. See the Appendix for the detailed cost estimates for construction.
I 5.2 Easement Acquisition
I Permanent and temporary easements are required for the proposed sanitary sewer for its
alignment through 1868 County Road 83, 1870 County Road 83,3300 Valley View Road, and
2036 County Road 83. The cost of the land acquisition and 25% indirect costs are necessary for
I this project since there is insufficient right-of-way to install this sewer. The total easement
acquisition cost for this project is estimated at $217,875.00 for Alternate 1 and $204,000.00 for
Alternate 2. The land acquisition costs are based on an appraised value of the land for permanent
I and temporary easement uses. See the Appendix for the detailed cost estimate for the easement
acquisition.
I 6. PROJECT FUNDING
The funding source for this project will be the City's Sanitary Sewer Trunk Fund. Sources for
I reimbursement of this fund include the River Valley Estates development and potentially
adjacent properties that receive a lateral benefit.

I River Valley Estates
Pulte Homes, the developer of River Valley Estates, will make a $150,000 contribution toward
this project over and above all other assessments to their subdivision. Additionally, Pulte Homes
I has agreed to contribute another $90,000 if the trunk sewer is in place for their use in September
of 2006. If the trunk sewer is in place as planned Pulte Homes would not need to construct and
operate a temporary lift station to serve their development.
I Potential Lateral Sewer Connection Charges
In addition to the proposed River Valley Estates development, this project could also benefit
I undeveloped properties on the east and west side of CSAH 83 between the existing sewer and the
new development. However, these connection charges would only be collected if and when the
properties were developed. In order to determine the lateral connection charge, we first have to
I remove any over-sizing and over-depth trunk costs. What will remain is a project cost based on
a more typical8-inch main extension along the same alignment. These costs tot~ $194,051.26
including a temporary easement cost west of CSAH 83. The costs were then aIlocated to the east
I and west sides of the improvement. The construction costs were equally allocated, the easement
costs were assigned to the west side. As there are multiple property owners along the west side,
a fair and equitable method of further allocating the costs had to be used. There are no
I development plans or concepts for these properties but as the number of units that could be
served in the future is directly related to the area of the parcels, the costs were allocated on an
I acre basis. The resulting Lateral Sewer Connection Charge for this project is $1,465.91 per acre.
The additional lateral computations are included in the Appendix.

I- In an effort to keep the project on schedule, it was necessary to start the land acquisition
for the project at the time of approval of the feasibility study. The following schedule
addresses the possible need to acquire the property through the use of eminent domain.

eminent domain proceedings for 2036 County Road 83 will allow for work to commence

I 8. CONCLUSIONS AND RECOMMENDATIONS
Based on the preceding discussions we would offer the following conclusions:
I 1. The construction of the project will require the acquisition of both permanent and .
temporary easements across the Schneider, the Koehnen, and the proposed River Valley
I Estates properties.
2. The project funding will utilize City Sanitary Sewer Trunk Funds for the pipe extension
I from the existing Church Addition sanitary sewer line to the north edge of the River
Valley Estates property. Fund reimbursement sources include River Valley Estates
contributions and Lateral Sewer Connection Charges.
I 3. The River Valley Estates Development is willing to pay an additional $90,000 towards
the construction of this trunk sanitary sewer if the system is operational in September, .
I 2006 for the development's connection to the sewer.
4. Itis anticipated that eminent domain proceedings will be necessary to acquire the
I permanent easements across at least one parcel in the project corridor for the construction
of the project.
I 5. This project is being completed as a Chapter 429 Improvement. This process will require
a public hearing for the project and the Council will need to order the improvement
following the hearing in order to proceed.
I 6. The project as proposed is necessary, feasible and cost effective from an engineering
I standpoint.
Based on the conclusions listed, the following is recommended:
I 1. It is recommended that Alternate 2 (directional drill) be used to cross 2036 County Road
83 (Koehnen property). This will allow the City to avoid and minimize easement and
I construction costs required to cross the property compared to the costs of the sewer being
installed by open cut trench method.
I 2. It is recommended that the City Council accept the feasibility report as presented and call
for the public hearing.
I 3. The City Council initiate the easement acquisition process (eminent domain if necessary)
in accordance with the schedule as proposed herein. This will allow the City to realize
the process necessary for easement acquisition at the time of the public hearing.
