for the Project Identified as The Bluffs; Approval of Scope of
Services Agreements with consultants SRF and WSB

INTRODUCTION:
Petitions have been filed asking the City to annex lands south of TH 169 and west of CR
15/Marystown Road. These lands, totaling about 340 acres, are the site ofthe proposed
D.R. HortonJRyan Contracting, Inc. "The Bluffs" project.
DISCUSSION:
Under Minnesota Rules, because of the size of the proposed project, it requires the
preparation of an Environmental Assessment Worksheet (EA W). As an alternative, City
staff has discussed the preparation of an Alternative Urban AreaWide Review (AUAR).
In addition, the City's Environmental Advisory Commission (EAC) has previously
proposed the preparation of an AUAR. Because ofthe developers' concerns about the
time involved, they do not favor the preparation of an AUAR. As an alternative, they
discussed with staff a sort of "enhanced" EA W that would analyze transportation
elements and impacts in the area more broadly (such as a future TH 41 river crossing,
extension of 17th Avenue/possible future CR 16).
To address the enhanced transportation analysis, staffhas solicited a proposed Scope of
Services from SRF. It was felt that this firm is uniquely qualified because of the work it
has been and is doing on the TH 411River Crossing Tier I EIS. In addition, staff solicited
a Scope of Services from WSB to oversee and manage the overall EA W process. Copies
of both ofthese documents are attached for the Council's information. Costs incurred
would be reimbursed by the project proposer(s) under a written agreement.

Environmental Review:
1. Offer and pass a motion authorize the appropriate city officials to proceed with
preparation of an EA W for the Proposed "The Bluffs" project located south ofTH
169 and west ofCR 15.
2. Offer and pass a motion authorize the appropriate city officials to proceed with
preparation of an AUAR for the Proposed "The Bluffs" project located south of TH
169 and west ofCR 15.
3. Table the matter for additional information.

SUBJECT: SCOPE OF SERVICES FOR THE PROPOSED BLUFFS AT MARYSTOWN RESIDENTIAL
DEVELOPMENT TRAFFIC STUDY - SOUTHWEST OF TH 169 AND MARYSTOWN ROAD
Dear Mr. Leek:
We are very pleased to submit this proposal to conduct a traffic analysis for the proposed Bluffs
at Marystown Residential development, south of Highway 169, west of Marystown Road in the
City of Shakopee. The main objective of this study is to evaluate the traffic impacts at the key
adjacent intersections and recommend any improvements necessary to support the proposed
development for this site.
SCOPE OF SERVICES
The scope of our services, as we understand it, is to perform the following tasks:
1. Collect a.m. and p.m. peak hour turning movement counts at the following intersections:
. Marystown Road (County Road 15) and Vierling Drive
. Marystown Road (County Road 15) and TH169 ~orth Ramps
. Marystown Road (County Road 15) and TH 169 South Ramps
. Marystown Road (County Road 15) and 17th Avenue
. Marystown Road (County Road 15) and 128th Street West
. Marystown Road (County Road 15) and 130th Street West (County Road 78)
. Zumbro Avenue (County Road 73) and 130th Street West (County Road 78)
. Old Brick Yard Road (County Road 69) and 130th Street West (County Road 78)
. Old Brick Yard Road (County Road 69) and TH 169
2. Analyze a.m. and p.m. peak hour traffic operations at the key intersections listed above for
existing conditions.

3. Estimate the new total trips that will be generated in the a.m. and p.m. peak hour and on a
daily basis by the proposed development and other known adjacent developments, based
on current ITE trip generation rates
4. Distribute and assign the a.m. and p.m. peak hour trips generated by the proposed Bluffs
at Marystown Residential development and other known adjacent developments to the
existing roadway system and street intersections.
5. Analyze a.m. and p.m. peak hour operations at the key intersections listed in Task #1 and
up to five additional intersections that will be built as part of the proposed development
and local roadways that may be constructed by 2015 in anticipation for the future TH 41
river crossing project, for 2015 future build (one year after construction) and no build
conditions.
6. Determine what improvements, if any, are needed to acconunodate the proposed
development with acceptable levels of service.
7. Review the site access as well as any other related internal or site specific traffic issues.
8. Review the 17th Avenue extension from Marystown Road to Old Brick Yard Road.
9. Prepare a draft memorandum describing the results of the traffic analysis and any
recommendations.
10. Make revisions as appropriate based on City review and prepare a final1].1emorandum.
11. Prepare for and attend two public meeting.
Optional tasks:
1. Analyze a.m. and p.m. peak hour intersection operations at the key intersections listed in
Task #1 and up to five additional intersections that may be built in relations to the TH 41
river crossing project, for future year 2030 build andno build conditions.
2. Noise analysis for Year 2015, a.m. and p.m. peak hours. Assume (1) no noise monitoring,
(2) modeling for existing, year 2015 no build and year 2015 build conditions, (3) no
mitigation analysis and (4) a technical memorandum.
3. Noise analysis for Year 2030, a.m. and p.m. peak hours. Assume (1) no noise monitoring,
(2) modeling for existing, year 2015 no build and year 2015 build conditions, (3) no
mitigation analysis and (4) a technical memorandum.
4. Air analysis for existing, year 2015 and 2030 conditions. Assumes that optional task #1 is
performed.

BASIS OF PAYMENT
The total cost of our services on this project will not exceed $13,000. The additional cost for the
optional tasks will not exceed$2,500 for Task #1, $3,500 for Task #2, $2,500 for Task #3 and
$6,000 for Task #4. The cost is based on the scopeof services provided. It is understood that if
the scope or the extent of work is adjusted at any time, the project cost will be adjusted
accordingly, upon your approval.
We propose to be reimbursed for our services on an hourly basis for actual time expended. The
project cost includes out-of-pocket expenses (printing, reproduction, etc.), billed at cost, and
mileage, which will be billed at a rate not to exceed the IRS allowance for business miles.
Invoices would be submitted on a monthly basis for work performed during the previous
month, with payment due within 30 days.
NOTICE TO PROCEED
A signed copy of this proposal or a separate letter of authorization returned to this office will
serve as notice to proceed. We will begin the work immediately thereupon and will complete
the project within a mutually agreed upon time schedule.

Re: Extension Agreement - Bluffs EA W Review and Coordination
Dear Mr. Leek:
According to our Agreement for Professional Services within the City of Shakopee, this
extension agreement is written to provide services for the above-referenced project.
We are proposing to complete this work on a cost-reimbursable basis as necessary in accordance
with the proposal dated November 28,2005, with a maximum not-to-exceed cost of $14,142.
The City of Shakopee agrees to reimburse WSB & Associates for these services in accordance
with Section IV ofthe Agreement for Professional Services.

Dear Mr. Leek:
As requested, please find outlined below a Scope of Services to review and coordinate the
Environmental Assessment Worksheet (EA W) process for the proposed Bluffs development. An
EA W is required for this project pursuant to MN Rules 4410.4300 subp. 19 pertaining to the
construction of 630 residential units within the 320 acre parcel.
Task {-Project Management/Meetings Cost Estimate: $712
This task involves coordinating the activities ofWSB Staff, City Staff, and the developer and
reviewing the information that is developed with appropriate City Staff. This task includes one
kick-off meeting with the City and developer to review the project.
Task 2 - Review Draft EA W Cost Estimate: $4,885-$7,624
Once the draft EA W is obtained by the City from Westwood, WSB will review the document for
conformance with EQB requirements as well as City requirements. Each item in the EA W will
be reviewed in conjunction with the guidance provided by the EQB for the preparation of an
EA W. This will include reviewing the analysis in the EA W including the storm water modeling
information, fish and wildlife habitat analysis, traffic analysis, water and wastewater analysis,
and other pertinent items. This task includes a meeting with the developer to review the traffic
analysis for the site.
If revisions are needed within the document, written comments will be provided to the developer
so the EA W can be revised. This task includes one meeting with City Staff and the developer to
review the draft EA W. This scope includes one round of review and revisions with a final
review being completed before the document is submitted to the City Council.
Task 3 - Submit EA Wand Respond to Comments Cost Estimate: $3,806-$5,806
Once the final EA W is obtained, it will be submitted to City Staff and City Council for review.
Once authorization from the City has been received, WSB will distribute the EA W to the
required agencies and EQB Monitor for the 30-day review. A public notice will also be
submitted to the local paper.

WSB will follow-up with the EA W review process, respond to comments generated by the
public review process, and develop the Findings and Conclusion documentation. Following
completion of the review process, we will present the findings ofthe EA W to the Council and
provide a recommendation relative to the need for an Environmental Impact Statement (EIS).
This task includes one meeting with the City Staff and developer and two meetings with the City
Council.
It is our understanding that the developer will be preparing the EA W. Depending on the
completeness ofthe submittal, the cost to complete this work could range from $9,403 to
