INTRODUCTION
The City Council is asked to consider adopting the attached
ordinance setting fees for licenses, permits, services, and
documents for 2006.
BACKGROUND
Prior to the end of each year, the City Council adopts a fee
schedule by ordinance for the ensuing year. The fee ordinance
includes the fees for all licenses and permits issued within the
City of Shakopee. Department heads have been asked to re-examine
their fees and make appropriate recommendations for adjustments to
the City Council. A summary of those recommendations follows.
Please note that there are no adjustments proposed in the Building
and Planning divisions at this time; recommendations will be
forthcoming after completion of the Springsted study that is
underway.
In the proposed ordinance, the stricken language is deleted
and the underlined language is inserted.
City Clerk - recommends increasing the license fee for
tobacco licenses from $175 to $200/ page 2; and increasing the dog
license fees from $20 to $24 for a two year license and pro-rating
the fee on the basis of 1/24 for each calendar month, page lI.
The Telecommunications Commission is recommending adjustments and
additions for video dubbing fees, page 3.
Building Department - The SAC charge is being increased from
$l,4350/unit to $1/550/unit, page 7. These funds are forwarded to
the Metropolitan Council. Recommendations on other adjustments
will be made after the Springsted study is complete.
Fire Prevention - additional fees and adjustments being
recommended are noted on pages 8 and 9.

Finance Department - recommends increasing the monthly sewer
service charge by fifty cents (0.50) for both metered and
unmetered residential water accounts, page 10 i and, increasing. the
storm water drainage utility fee from $25.05 per REF to $25.55 REF
(residential equivalent factor), page 18.
Police Department - Copes of reports are being reduced to
twenty five cents per copy, per a new law that limits the amount a
person can be charged in most cases, page 11. A fee is added for
photo disks in the amount of $10.00, page 11.
Public Works - there are no changes recommended for 2006.
Planning Department - No adjustments in fees are proposed at
this time. Recommendations will be made after the Springsted
study is complete. Fees that are passed through to Scott County
for the recording of documents were increased mid year, as
outlined on page 12.
Engineering Department - is recommending the additions and
adjustments as noted on pages 16 - 18. Recommendations for other
adjustments will be made after the Springsted study is complete.
Park and Recreation - The Park and Recreation Advisory Board
recommends increasing the park dedication fees for residential
properties from $4,632 to $5,340 per unit, for multi-family from
$3,860 to $4,450 per unit, and for commercial/industrial
properties from $6,277 to $6,930 per acre, page 13, see attached
memos from the Recreation and Facilities Director to the Park and
Recreation Advisory Board, dated November 28, 2005. No changes to
the fees for programs and facilities are recommended at this time.
In the future the Park and Recreation Advisory Board will be
asking the City Council to consider extending the fee study to
include the park and recreation fees.

ORDINANCE NO. 743, FOURTH SERIES
AN ORDINANCE SETTING FEES FOR
CITY LICENSES, PERMITS, SERVICES AND DOCUMENTS
WHEREAS, by Ordinance No. 715, the City Council established a fee schedule
effective January 1,2005; and
WHEREAS, amendments to the fee schedule were subsequently made with the
adoption of Ordinance No. 721 and Ordinance No. 733; and
WHEREAS, the City Council has determined that adjustments to those fees are
reasonable and appropriate.
NOW, THEREFORE, BE ITRESOL VED, by the City Council of the City of
Shakopee, Minnesota, that the Fee Schedule dated January 1,2006, a copy of which is on
file in the office of the City Clerk, is hereby approved and adopted in its entirety.
BE IT FURTHER RESOLVED, that the Fee Schedule shall become effective on
January I, 2006, unless indicated otherwise therein, and Ordinance Numbers 715, 721
and 733 and all other ordinances and resolutions inconsistent herewith shall be repealed
effective January 1,2006.

Engineering
A. Private Developments
The development fees for private developments apply in situations where private developers choose to construct the
public improvements, rather than having them constructed by the City. The fees that the City charges in those
situations are intended to reimburse the City for all of the direct and indirect costs incurred by the Public Works
Departments to process the development application, to process and administer the project, to review and approve
the plans for the project, and to inspect the construction of the project. The percentage used for various items are
based on the historical costs incurred by the City.
Streets and Utilities
The Development Fees for private developments include a lump sum of 8.5% of the estimated construction costs for
the following: public sanitary sewer, public storm sewer, public street construction, sidewalks, boulevard trees and
other appurtenances. The 8.5% lump sum is based on the following breakdown:

city limits minus the portion of the development used for public right-of-way, lakes,wetland areas, stormwater
ponding easements, and parks.
C. Trunk Storm Water Storage and Treatment Charges
A fee will be charged to all new developments that utilize regional ponding systems, per the City's Trunk Storm Water
Charge Policy. This fee shall be as follows:

Sewer Charge Policy. The term "net acre" means the acreage equal to 85% of the gross acreage of the
development.
E. City Projects and Miscellaneous Engineering Work
The actual hourly rates of the employees will be used plus a multiplier of 2.5 for benefits, overhead, etc.
A 1% project administration fee will be charged to all projects.
Other Costs incurred will be added in using the actual costs (ie. Consultant fees, testing laboratories, etc.)
F. Grading Permits

Subject: 2006 Park Dedication Fees
INTRODUCTION
City ordinance requires City Council to set the park dedication fees each year. The
Advisory Board is asked to review and consider the 2006 fee.
However, based on a recommendation from the Planning Commission in 2004, we have
asked for an outside analysis of recent land sale transactions by a certified appraisal
firm. That analysis was not complete as of writing this report, but is due on Monday and
will be presented at the meeting, along with the proposed fee.
BACKGROUND
Minnesota State Statute 462.358 allows cities to require park land dedication during the
development process, or to "... accept an equivalent amount in cash from the applicant
for part or all of the portion required...". The city's Park Dedication ordinance specifies
that the cash contribution amount must be established annually by City Council.
The park dedication fee is calculated using a formula that was developed with the 1998
Comprehensive Park Plan (attached). In order to demonstrate the required relationship
between park dedication fees and costs for providing the city's park system, the analysis
calculated full park system development costs based on average land values for
acquisition and construction costs, and assigned those costs 85% to residential, and
15% to commercial. (This analysis would be updated with the update of the

undeveloped property that is either in the urban service area, or where urban services

DISCUSSION
In the past, the average land value was determined by a staff review of recent land
transactions that we were able to identify. During the joint budget work session with the
Planning Commission and City Council in 2004, the Planning Commission
recommended that the city have a professional appraisal firm prepare a.list of recent
land sale transactions to add additional validity to the process. Council concurred with
their recommendation.
This year, I asked Patchin Messner and Dodd, an appraisal firm that the city and SPUC
work with, to prepare a list of recent land sale transaction. They had not completed the
analysis as of writing this report, but will have it complete by Monday's meeting. I will
present the land sales and proposed dedication fees at the meeting for your
consideration.
REQUESTED ACTION
The Advisory Board is asked to review the procedure for calculating the 2006 Park
Dedication Fees, recent land sale transactions, and proposed fee amounts, and make a
recommendation to City Council.

I received the attached land value analysis referenced in the main staff report before
your packets went out, so I was able to prepare an analysis of the proposed 2006 park
dedication fees.
Average land Value Sales
The land sales summary prepared by Patchin Messner & Dodd dated November 23,
2005 contains seven single family density and two medium density sales that have
occurred in 2005. Prices range from $111,351/acre to $157,817/acre. Using these sales,
the average land price is $133,557.77 (The Marystown Road sales listed at
$173,318/acre and $198,602/acre contain commercial property, so they have been
excluded from the analysis.)
Proposed Fee
Assuming an average land sale of $133,560/acre, the following are the proposed 2006
Park Dedication fees, rounded to the nearest $10:
Single Family $133,560 /25 units per acre = $5,340 per unit
Multiple Family and Duplex $133,560/30 units per acre = ~4,450 per unit
Commercial Increase Based on the Average Increase of the
Single Family and Multi Family Increases = $6,930
