CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director.H SUBJECT: Public Hearing for Pike Lake Road Improvements, from CSAH 16 to 1100 Feet South and a Street 425 Feet West of Pike Lake Road, Project No. 2007-3 DATE: February 6, 2007 INTRODUCTION: A public hearing has been scheduled by the City Council by adopting Resolution No. . 6562 on January 16, 2007. BACKGROUND: Improvement of Pike Lake Road 1100 feet south of CSAH 16 and a public street 425 feet west of Pike Lake Road is necessary for a new elementary school to open in August, 2007. A feasibility report has been prepared by WSB & Associates, Inc. for these improvements. Tollefson Development, Inc. has requested the assessments be placed on their remaining 114 acres and will enter into an agreement with the City for the assessments. Independent School District #720 did purchase 20 acres from Tollefson Development, Inc. and part of the purchase agreement is for Tollefson Development to pay for local improvements. In previous correspondence, Tollefson Development, Inc. has indicated that they will enter into an agreement with the City for these assessments. Council should direct the City Attorney to prepare the assessment agreement with Tollefson Development, Inc. The City will have oversizing costs for the collector street (Pike Lake Road) and street lighting. Shakopee Public Utilities will also have watermain oversizing with this project. PROJECT COSTS: The total estimated project cost for this project is $822,300.00. The estimated cost apportionment is as follows: Assessments $693,710.00 SPUC $ 48,365.00 City (CIF Funds) $ 80,225.00 TOTAL $822,300.00 ALTERNATIVES: 1. Adopt Resolution No 6571, a resolution ordering the improvement and the preparation of plans and specifications for Pike Lake Road Improvements, from CSAH 16 to 1100 Feet South and a Public Road 425 Feet West of Pike Lake Road, Project No. 2007-3. 2. Deny Resolution No. 6571. This action will halt the project until such time as the City Council reconsiders the resolution. 3. Table Resolution No. 6571, to allow time for staff to prepare additional information and/or revise the feasibility report as directed by City Council. 4. Approve a motion directing the City Attorney to prepare an agreement between the City and Tollefson Development, Inc. for the assessments associated with the Pike Lake Road Improvement Project No. 2007-3. RECOMMENDATION: If Council desires to proceed with this project, at this time, then Resolution No.. 6571 needs to be adopted, a resolution ordering the improvement and the preparation of plans and specifications. If City Council does not wish to pursue this project for the 2007 construction season,> then the appropriate action would be to move the approval of Resolution No. 6571 and vote against the motion. If City Council wants more information on the project and/or to amend the feasibility report, then Alternative No.3 is recommended. Previous Council action on October 3, 2006 authorized WSB & Associates, Inc. to prepare the feasibility report and final design, if approved by Council. ACTION REQUESTED: 1. Offer Resolution No. 6571, A Resolution Ordering an Improvement and Preparation of Plans and Specifications for Pike Lake Road Improvements, from CSAH 16 to 1100 Feet South and a Public Road 425 Feet West of Pike Lake Road, Project No. 2007-3 and move its adoption. 2. Plans And Specifications For Pike Lake Road Improvements, From CSAH 16 To 1100 Feet South And A Public Road 425 Feet West Of Pike Lake Road Project No. 2007-3 WHEREAS, Resolution No. 6562 adopted on January 16,2007, fixed, a date for Council hearing on the proposed improvements of Pike Lake Road, from CSAH 16 to 1100 feet south and a Public Road 425 feet west of Pike Lake Road by installation of sanitary sewer, watermain, storm sewer, concrete curb & gutter, grading, aggregate base, bituminous paving, bituminous trail, concrete sidewalk, street lighting and all appurtenant.work; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 6th day of February, 2007, at which all persons desiring to be. heard were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That the improvement is necessary, cost effective and feasible and is ordered as hereinafter described: Pike Lake Road hnprovements, from CSAH 16 to 1100 feet south and a Public Road 425 feet west of Pike Lake Road, and all appurtenant work. 2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvements. 3. The work of this project is hereby designated as part of the 2007-3 Public hnprovement Program. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption ofthis resolution.
