SUBJECT: Public Hearing for the Trunk Sanitary Sewer Extension, from the
Prior Lake Interceptor to the East Plat Line of Riverside Bluffs,
Project No. 2006-4
DATE: December 6, 2005
INTRODUCTION:
As per Resolution No. 6329, a resolution receiving a report and calling for a public
hearing on the Trunk Sanitary Sewer Extension, from the Prior Lake Interceptor to the
East Plat Line of Riverside Bluffs, Project No. 2006-4, a public hearing is scheduled for
December 6, 2005. This agenda item is to conduct the public hearing for the proposed
improvements associated with the trunk sanitary sewer extension.
BACKGROUND:
On October 4, 2005, City Council ordered the preparation of a feasibility report for the
trunk sanitary sewer extension. The report was completed and accepted by City Council
on November 15, 2005. This proposed project includes extending Trunk Sanitary Sewer,
from the Prior Lake Interceptor to the East Plat Line of Riverside Bluffs.
PROJECT COSTS:
The total estimated project cost for this project is $590,592.81, including easement
acquisitons.
The estimated cost apportionment is as follows:
Assessments $289,828.88
*City (Trunk Sanitary Funds) $300.763.93
Total $590,592.81
* The developer of Riverside Bluffs has indicated a contribution of$150,000 towards
this project, if sewer is available by June 1,2006. Attached is a letter from Ryland
Homes in regard to the contribution which has been reviewed by our attorney.
Since the City has initiated this project and the petition signed by the property ownersis
not applicable for this type of project, a super majority of the Council is necessary to
order the proj ect.
Staff has begun the condemnation process by sending an offer letter to the property
owner in which easements are needed. If this project is ordered, a condemnation petition
would be filed to obtain the easements.
ALTERNATIVES:
1. Adopt Resolution No. 6336, a resolution ordering the improvement and the
preparation of plans and specifications for the Trunk Sanitary Sewer Extension,
from the Prior Lake Interceptor the East Plat Line of Riverside Bluffs, Project No.
2006-4.
2. Deny Resolution No. 6336. This action will halt the project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 6336, to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by City Council.
4. Motion to accept the offer by Ryland Homes, Inc. to pay $150,000.00 towards the
Trunk: Sanitary Sewer Extension Project.
5. Do not accept offer letter from Ryland Homes, Inc.
RECOMMENDATION:
If Council desires to proceed with this project, at this time, then Resolution No. 6336
needs to be adopted, a resolution ordering the improvement and the preparation of plans
and specifications. If City Council does not wish to pursue this proj ect for the 2006
construction season, then the appropriate action would be to move the approval of
Resolution No.6336 and vote against the motion. Previous approval of WSB &
Associates extension agreement included final design services, if project is ordered.
Also, acceptance of Ryland Home's offer letter is recommended by staff.
ACTION REQUESTED:
1. Offer Resolution No. 6336, A Resolution Ordering an Improvement and
Preparation of Plans and Specifications for the Trunk: Sanitary Sewer Extension,
from the Prior Lake Interceptor to the East Plat Line of Riverside Bluffs, Project
No. 2006-4, and move its adoption.
2. Approve a motion to accept the offer letter from Ryland Homes, Inc. to pay
$150,000 towards the Trunk Sanitary Sewer Extension Project.

RE: Riverside Bluffs/Extension of Trunk Sanitary SewerslPartial Funding Commitment
Honorable Mayor and Council Members:
As you know, the Shakopee City Council has recently ordered in a public improvement project
which will benefit, along with other properties, the property being platted by The Ryland Group,
Inc. ("Ryland") and related parties as "Riverside Bluffs." Such project involves the extension of
trunk sanitary sewer line to such property from the Prior Lake Interceptor located west of the
Riverside Bluffs site (the "Project").
Prior to the action of the City Council in ordering in the Project, Ryland had proposed, in a letter
dated September 29,2005, to provide $150,000 toward public construction of the trunk sanitary
sewer to help defray a possible funding deficit. Please consider this letter to be the binding
commitment of Ryland to pay said amount (i.e. $150,000) to the City of Shakopee(the "City")
upon completion of the Project. As we have discussed with City staff, this obligation is subject,
however, to the contingency that the City either awards the contract for the Project by March 21,
2006 or completes the Project on or before June 30, 2006, except to the extent delays beyond
such date in completion of the Project are caused by causes not within the reasonable control of
the City.
Ryland understands that the City of Shakopee is relying upon the commitment embodied in this
letter in electing to proceed with the Project. Please do not hesitate to call should you have any
questions.

Ordering An Improvement And Preparation Of
Plans And Specifications For The
Trunk Sanitary Sewer Extension,
From The Prior Lake Interceptor To The
East Plat Line Of Riverside Bluffs
Project No. 2006-4
WHEREAS, Resolution No. 6329 adopted on November 15, 2005, fixed a date for
Council hearing on the proposed improvement of Trunk Sanitary Sewer Extension, from the Prior
Lake futerceptor to the East Plat Line of Riverside Bluffs and all appurtenant work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 6th day of December, 2005, at which
all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, lVIINNESOTA:
1. That the improvement is necessary, cost effective and. feasible and is ordered as
hereinafter described:
Trunk Sanitary Sewer Extension, from the Prior Lake futerceptor to the East Plat Line of
Riverside Bluffs, and all appurtenant work.
2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2006-4 Public Improvement
Program.
4. The City Council shall let the contract for all or part of the improvements as authorized
by Minnesota Statutes 429.041, no later than three years from the date of adoption ofthis
resolution.
Adopted in session of the City Council of the City of Shakopee,
