SUBJECT: Building Permits for Countryside

INTRODUCTION:
City Council discussed the issuance of building permits associated with the plat of
Countryside at the November 1,2005 City Council meeting and directed staff to prepare
a list of conditions for allowing building permits on lots where sidewalk has not been
installed.
BACKGROUND:
At the November 1, 2005 City Council meeting, City Council discussed the issuance of
building permits and in particular the issuance of building permits where concrete
sidewalk would not be installed in 2005. From this meeting, . staff has prepared a list of
items that need to be fulfilled in order for the developer to obtain building permits on lots
where sidewalks do not exist. These items are as follows:
1. Install the class 5 aggregate base for the concrete sidewalk on lots where permits
will be applied for and the aggregate base should be installed to the top of future
sidewalk grade.
2. A letter from the developer consenting the use of the Letter of Credit for
Countryside to install sidewalk by the City, if necessary.
3. Developer to notify builders and future homeowners of the sidewalk to be
installed and this sidewalk must be installed prior to the placement of future
driveways.
4. Sidewalks to be installed by June 1, 2006.
5. All other items per City Policy, City Ordinance and City Design Criteria must be
done prior to the issuance of a building permit, including the above referenced
items.
Staff believes that byperforming these items, the homeowner and builder will know of a
future sidewalk. The other concern from staff is that this future sidewalk would be
installed as soon as possible in the spring of 2006. The other item that was mentioned at
the November 1, 2005 Council meeting was a possible limit on the number of building
permits that do not have sidewalk. The number that the developer mentioned was a total
of 15. Staff would suggest that a limit on the maximum number of lots without sidewalk
is a good idea.
As an update to the progress on Countryside Development, many of the streets including
C.R. 79 now have curb & gutter and will be slated for bituminous paving in the upcoming
days. The recent good weather for November, 2005 has allowed the developer to
complete the sidewalk in Phase I and many of the streets in Phase II, although there are
some streets in Phase II that still need concrete curb & gutter and street paving and these
areas are very much weather dependent.
ALTERNATIVES:
1. Council needs to adopt a list of conditions for the issuance of building permits for
Countryside Development on lots where sidewalk is not constructed and to a
maximum of 15 lots that would be permitted in this fashion.
2. Provide a list of conditions for the issuance of building permits, as modified by
City Council.
3. Table for additional information.
RECOMMENDATION:
Staff recommends the issuance of building permits, without sidewalk, as per the
conditions included in this memo and would recommend a limit of building permits on
lots without sidewalk for a total of 15.
ACTION REQUESTED:
Approve a motion on requiring a list of conditions, in this memo, to be included for the
issuance of building permits in Countryside Development on lots where sidewalk has not
been constructed.
