No. 6329, 6332, 6333 1-5; c.. ~/ CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Acceptance of Feasibility Report for Trunk Sanitary Sewer Extension, from the Prior Lake Interceptor to the East Plat Line of Riverside Bluffs, Project No. 2006-4 DATE: November 15,2005 INTRODUCTION: Attached to this memorandum is Resolution No. 6329, a resolution accepting the feasibility report and establishing a public hearing date for December 6, 2005 for the Trunk Sanitary Sewer Extension, from the Prior Lake Interceptor to Riverside Bluffs. Also attached is Resolution No. 6332, a resolution authorizing eminent domain proceedings and Resolution No. 6333, a resolution amending the City's Special Assessment Policy for sanitary sewer. BACKGROUND: On October 4, 2005, City Council adopted Resolution No. 6310, a resolution ordering the preparation of a report for the Trunk Sanitary Sewer Extension, from the Prior Lake Interceptor to the East Plat Line of Riverside Bluffs. The City also authorized an extension agreement with WSB. & Associates, Inc. to prepare the feasibility report. Attached is the feasibility report outlining the project costs, project funding, easement acquisition and assessments for lateral sewer benefit associated with this trunk sanitary sewer extension. This project will provide a sewer service to the area east of the Prior Lake Interceptor and to much of the area north and south of C.R. 16. The trunk sewer extension does also serve the proposed Ridge Creek development and the preliminary plat approved Riverside Bluffs development, with lateral sewer benefit and overall general benefit to a larger area, which makes it a trunk sanitary sewer. Associated with this project and the feasibility report, is a need to acquire additional easements from Ridge Creek proposed development, which is a parcel owned by Terrance Hanson. Staff is requesting authorization for eminent domain proceedings in order to obtain the right-of-way to meet the proposed project schedule. If the project is not approved at the December 6, 2005 public hearing, staff would not proceed with filing a petition for condemnation of the easements. It has been proposed by Ryland Homes, the developer of Riverside Bluffs, that they would contribute $150,000.00 towards the City's trunk expenditures, if a 429 project is done in order to provide them sewer service for their development. In order to meet the time line of June 1,2006, an authorization for eminent domain proceedings needs to be done at the November 15, 2005 Council meeting. Also included with this feasibility report is an amendment to the City's Assessment Policy on sanitary sewer, which allows the City to assess for lateral sewer benefit associated with a trunk sanitary sewer or establish a lateral sewer connection charge for this benefit. The Assessment Policy for sanitary sewers has not been updated when the Trunk Sanitary Sewer Charge was developed. This Assessment Policy amendment brings the policy up to date. Staff has also reviewed the City's Trunk Sanitary Sewer Charge on whether the fee is adequate to fund future trunk sewers. In reviewing the revenues generated by the Trunk Sanitary Sewer Acreage Charge and the City's Sewer Availability Charge (SAC), staff has determined that the current rates are adequate. Lateral sewer benefit to developing properties can be assessed or a lateral sewer connection charge determined for each trunk sewer project. For this project, a special assessment is recommended. Staff will be reviewing the Sanitary Sewer Enterprise Fund budget with Council on November 29, 2005, Staff did receive on November 9, 2005 the attached petition from the Liesener's, Terry Hanson, Ryland Homes and Tollefson Development, Inc. for this project. After discussions with the City Attorney, staff is recommending a public hearing needs to be held. ALTERNATIVES: 1. Adopt Resolution No. 6329, a resolution accepting the feasibility report and establishing a public hearing for December 6, 2005 for the Trunk Sanitary Sewer Extension, from the Prior Lake Interceptor to the East Plat Line of Riverside Bluffs. 2. Adopt Resolution No. 6332, a resolution authorizing eminent domain proceedings for the Trunk Sanitary Sewer Extension Project. 3, Adopt Resolution No. 6333 , a resolution amending the City's Assessment Policy. 4. Do not approve these resolutions at this time. 5. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No.1, No.2 and No.3 in order to proceed with this project, to provide sanitary sewer service to Riverside Bluffs and other areas beyond and in order to have a public hearing on December 6,2005. ACTION REQUESTED: 1. The Council will consider the Trunk Sanitary Sewer Extension, from the Prior Lake Interceptor to the east plat line of Riverside Bluffs Project and all appurtenant work in accordance with the report and the assessment of abutting and benefited property for all or a portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvement of $590,592,81. 2, A public hearing shall be held on such proposed improvements on the 6th day of December 2005, at 7:00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street, Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and improvement as required by law. 3. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS: 1. Acquisition by the City of the Property described on Exhibit A is necessary, convenient and reasonable for the purpose of constructing the Project. 2. The City Council deems it necessary in order to meet the anticipated construction schedule for the Project to acquire title to and possession of the Property prior to the filing of a final report of commissioners, in accordance with Minnesota Statutes, Section 117.042. 3. The City Attorney is authorized and directed on behalf of the City to acquire permanent and temporary easements for street, highway, sidewalk, utility and drainage purposes for the Project by the exercise of the power of eminent domain pursuant to Minn. Stat. Chapter 117, and is specifically authorized to notify the owners of intent to take possession pursuant to Minn. Stat. Sec. 117.042. 4, The City Engineer is authorized to approve the appraised value for the Property if the City Engineer determines that the appraisal adequately reflects the fair market value of the Property. 5. The City Attorney further is authorized to take all actions necessary and desirable to carry out the purposes of this resolution. C:\DoclIments and Settings\bloney\Local Settings\Tcmporary Internet Filcs\OLK65\ParceI l.doc RESOLUTION NO. 6333 A Resolution Amending The Sanitary Sewer Assessment Policy WHEREAS, on January 19, 1992 the City Council of Shakopee adopted the Special Assessment Policy by Resolution No, 3735; and WHEREAS, the Special Assessment Policy was amended by Resolution No. 4852 on February 1 ih, 1998; WHEREAS, the City Council desires to further amend the Special Assessment Policy. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: The Special Assessment Policy is hereby amended as follows: Section X - Assessment Computations: Paragraph D, Sanitary Sewer Assessments is revised as follows: D. SANITARY SEWER IMPROVEMENTS This policy establishes the criteria for the determining the means of funding sanitary sewer extensions through the application of assessments. The construction of sanitary sewers within new developments may be funded privately with the application of trunk fees and lateral connection fees applied in the Developer's Agreement. The Developer may also petition the City for the construction of sanitary sewers within a new subdivision as a Chapter 429 public improvement project. In the case of petitioned improvements, 100% percent of the cost of construction of laterals within the subdivision shall be assessed against the underlying property for the proposed subdivision. . In the event a sanitary sewer lateral provides trunk benefit the City, the cost of the construction of an 8-inch equivalent lateral shall be assessed to the property receiving benefit. The calculation of assessments shall be based on the following definitions: . Trunk Sanitary Sewer - A trunk sanitary sewer represents an extension of the City's sanitary sewer system across public and private property with the intent to provide service across subdivision lines. A trunk sewer is intended to cross public owned or undevelopable property without individual service or lateral connections, . Lateral Sanitary Sewer - A lateral sanitary sewer shall be understood to be the extension of a sanitary sewer (8-inch) into a subdivision from the property line connecting to the trunk sewer. A lateral sanitary sewer shall provide the opportunity for the extension of other lateral lines and private service connections. In the case of a lateral extension, it is the underlying property owner's responsibility to the extend the sanitary sewer to the property line abutting the next upstream subdivision. When it becomes necessary to provide a trunk sewer extension providing lateral benefit to a property that requires installation of a pipe that is greater than the standard size and deeper than 12-feet at the property line for a respective development, assessments shall be calculated for the installation of a standard pipe size and depth with the following costs to be paid through the City's trunk fund. . Oversizin2: - The incremental cost to provide the required pipe size greater than the standard size as determined by the City shall be considered an oversizing cost and will be paid for by the City from the Trunk Sanitary Sewer Fund. The cost to extend an 8-inch will be deducted from the total project cost and assessed to the property receiving lateral benefit from the trunk sewer extension. . Overdepth - The incremental cost to construct a lateral sanitary sewer to be extended to another subdivision greater than a depth ef necessary to serve the development or12 feet.. whichever is greater, and the most upstream point of the lateral shall be considered an overdepth cost and will be paid for by the City from the Trunk Sanitary Sewer Fund. The cost of the installation of the pipe at a minimum depth of 12 feet will be assessed against the properly receiving benefit from the lateral extension, In the event that a trunk sewer is to be extended across a new subdivision with the intent to provide service to undeveloped property, lateral benefit shall be determined by the City for determining the application of payment for that lateral benefit. Payment could consist of an assessment or as a lateral connection charge. In situations where a trunk sewer is extended across developable property that the cost of the lateral benefit to that particular property be collected at the time of development through a lateral connection charge or special assessment as approved by the City Council. In situations where sanitary sewers will be assessed, lateral sanitary sewers will be assessed on a basis to be determined by the City Engineer. Major trunk sewers or interceptors will be funded through charges to the entire drainage basin benefited by the sewer. This will be collected as trunk charge or connection charge in accordance with the City Trunk Sanitary Sewer Policy. Funds collected from this fee shall be retained in the Trunk Sanitary Sewer Fund to be used for trunk related costs. The replacement of existing sewers will not be assessed but rather paid for 100% by the City using either the Sanitary Sewer Enterprise Fund or other funding sources identified by the City Council. Should the nature of the development require upgrading of existing pipes due to capacity limitations, the incremental cost between the existing pipe size and the upgraded pipe shall be assessed to the development initiating the improvement. Individual service lines installed directly to specific properties will be fully assessed directly to the benefited properties. Properties that have existing sanitary sewer services, but do not have mainline sewers adjacent, across or up to their property lines will pay 50% ofthe assessment rate for the new mainline sanitary sewer as well as 100% of the costs associated with replacing the service lines. Any existing service line found to be defective as part of a street reconstruction shall be replaced as part ofthe project and assessed directly to the property. This policy change shall become effective November 15,2005. INTRODUCTION On October 4, 2005, the City of Shakopee ordered the preparation of a feasibility report to be I prepared by WSB & Associates, Inc. for a trunk sanitary sewer extension from the Prior Lake Interceptor to the Riverside Bluffs development by Resolution No. 6310. I 2. SCOPE I This report addresses the anticipated project costs and feasibility of extending a trunk sanitary sewer from the Prior Lake Interceptor (MCES line), in the recently approved Ridge View Farm's plat, approximately 3,525 feet easterly to the recently approved Riverside Bluffs plat. I 3. BACKGROUND I On September 6, 2005, the preliminary plat of Riverside Bluffs was approved with several conditions. One of the conditions is for the development to have permanent sanitary sewer I extended to their site for development. At the September 6, 2005, City Council meeting, it was suggested by City Staffto wait until the October 4,2005, meeting to consider a public improvement project for the extension of trunk sewer to this development. I Brian Sullivan of Ryland Homes and Mark Leisener, the property owner of Riverside Bluffs, petitioned the City Council to extend trunk sanitary sewer via a Chapter 429 public improvement I project. The developers would like sanitary sewer to their site by June of 2006. To extend the trunk sewer to the Riverside Bluffs development, the proposed alignment will I extend through the Ridge Creek Preliminary Plat, which is currently at the concept stage in the development process. Since the Riverside Bluffs development is further along in the I development process than Ridge Creek development, the developer is requesting the City to proceed with the construction of this trunk sanitary sewer through the 429 public improvement process. I 3.1 Existing Conditions I 3.1.1 Roadway I Currently, there are no existing roadways within the project limits. The existing land is rural agricultural. I 3.1.2 Sanitary Sewer The proposed trunk sanitary sewer will connect into the existing Prior Lake I Sanitary Sewer Interceptor. This 42-inch RCP trunk sanitary sewer line is owned by the Metropolitan Council Environmental Services. It was constructed in 1971 and carries sewage from the City of Prior Lake and portions of Shakopee to the I Feasibility Report I Trunk Sanitary Sewer Extensions City of Shako pee, MN WSB Project No. 1281-92 Page 1 I I Blue Lake Treatment Facility which is located along the Minnesota River north of the proj ect area. I 3.1.3 Wetlands The proposed sanitary sewer alignment may cross or extend along an existing I wetland on the we~t side of the project area (see Figures 2 & 3 in the Appendix). This wetland has been delineated and portions of it will be removed to accommodate the future alignment of Pike Lake Road. The wetland area is I owned by the City of Shakopee . and is classified as a Type III wetland that is seasonally flooded and that has been ditched. The ditch that runs through this wetland is part of the Prior Lake outlet channel and water levels are dependent on I when the outlet control structure is opened on Prior Lake. Organic and muck soils are found and extend to depths of about 5-feet and greater. I 3.1.4 Existing Property Owners At the westerly proposed connection point to the MCES system, the landis in the I proposed Ridge View Farms Plat that is owned by Tollefson Development. The proposed connection point to the Prior Lake Sanitary Sewer Interceptor is contained in an existing MCES easement within the Ridge View Farms I Preliminary Plat. The wetland to the east of the previously described area is owned by the City of Shako pee. The east portion and a majority of the area that will be crossed by this trunk sewer is in land currently owned by Terry Hanson. I This land is proposed to be developed by the Ridge Creek, Inc. Development Company and is shown in Figure 3 of the Appendix as the proposed Ridge Creek Plat. Plans for this proposed plat have been recently submitted to the City, but I have not been approved and the area is currently unplatted. The proposed trunk line will extend east into the proposed Riverside Bluffs Subdivision, which is I being developed by Ryland Homes. 4. PROPOSED IMPROVEMENTS I 4.1 Sanitary Sewer I The proposed project involves the design and construction of a trunk sanitary sewer to be extended from the existing MCES interceptor, located west of Pike Lake Road, along a proposed I alignment that has been defined by City staff. The pipe alignment is proposed to extend through a primarily undeveloped area oftheCity. The I proposed trunk will connect to the MCES interceptor west of future Pike Lake Road and extend north and easterly through or along the edge of an existing wetland and eventually through private property along a planned road alignment anticipated to be constructed with the Ridge I Creek development project. The connection to the MCES interceptor will be completed by setting a new manhole over the existing line. The proposed alignment has been set based on the conceptual Ridge Creek Plat for this area. Further extension of this trunk line will be accomplished with the construction of the proposed Riverside Bluffs development. I The proposed pipe alignments are located adjacent to and potentially within wetlands. Proposed Alignment 1 illustrates (see Figure 3 in the Appendix) the wetland crossing and is the most direct routing east. This route presents the more difficult construction option of the two alignments. I Preliminary indications from the geotechnical exploration indicate that the wetland is holding water depths of3 to 4 feet and underlying soils are extremely soft. The crossing of the wetland would add time and cost due to dewatering and difficult construction across this area. It will be I critical to provide a stable foundation for the pipe within this area and piling will likely be required through the wetland. As a result, a second alignment has been generated that follows the south edge of the wetland. Proposed Alignment 2 crosses to the east on the south side of the I wetland and is anticipated to be a less difficult alignment to construct and access for maintenance. Soil borings indicated that dewatering will be necessary along the entire project length and anticipated to be a significant project cost. I The 15-inch PVC pipe is proposed to be run ata minimum grade of 0.15% and will be designed in accordance with the MCES and City of Shakopee design standards. Stubs are proposed to be I installed within the Ridge Creek future development to provide for future lateral sanitary sewer connections. I 4.2 Easement Acquisition The proposed pipe will be crossing a parcel of property under private ownership (the proposed I Ridge Creek development). It is proposed to acquire a 20-foot permanent utility easement for operating and maintaining the pipe line. 30-foot wide temporary easements on either side of the permanent utility easement will also need to be acquired for the construction. Evergreen Land I Services has been retained by the City to complete an appraisal at the easement in question and negotiate the land acquisition with the Ridge Creek Developer. It is anticipated that the pipe will I eventually be located in permanent public right-of-way once the fmal plat is recorded. If necessary, the land acquisition can be pursued through eminent domain. The eminent domain proceedings typically require 90 days before the City would be able to enter the property. The I schedule established for this project provides an allowance for this contingency. 4.3 Permit Applications I If this project moves into the design phase, the following permits will be prepared and submitted by WSB on behalf of the City. It is anticipated that the City will provide fees for the submittals. I . Minnesota Pollution Control Agency - Sanitary Sewer Extension Permit . COST ESTIMATES A detailed cost estimate can be found in the Appendix. The following costs were prepared using I 2005 construction costs and are subject to change, depending on the final design of the project, bids received, and actual work performed. The construction and easement acquisition costs plus 10% contingency and 25% indirect (engineering and administration) costs for the project are I estimated to be $590,592.81. 5.1 Sanitary Sewer I New sanitary sewer will be assessed to the benefiting properties per the assessment policy and there is oversizing costs associated with the proposed sanitary sewer within this project. The I estimated construction cost for this project is $507,467.81. Oversizing costs are determined by any costs associated with installing a sewer line greater than an 8-inch line, which is the smallest size installed in residential areas of the City. The oversizing costs for this project are I $111,650.00 and are calculated for the cost difference between a 15-inchand 8-inch line. A detailed cost estimate is shown in the Appendix. I 5.2 Easement Acquisition An easement is required for the proposed sanitary sewer for its alignment through the future I Ridge Creek Plat. The cost ofthe land acquisition and 25% indirect costs are necessary for this project since the Ridge Creek Plat is in the early stage of the development review process and the land will not be dedicated at this time. The total easement acquisition cost for this project is I estimated at $83,125.00. The hmd acquisition costs are based on an appraised value ofthe land for permanent and temporary easement uses. See the Appendix for the detailed cost estimate for the easement acquisition. I 6. PROJECT FUNDING I The City has essentially two potential funding sources for the construction of trunk sewer lines. I They include trunk area charges and connection fees, and assessments on laterals extended to development. Part of this study was to evaluate the City's TrUnk Policy and Lateral Assessment Policy. I The Riverside Bluffs development has pledged $150,000 toward public construction of trunk sanitary sewer to defray any additional costs that the City may incur by proceeding with an I improvement project. This contribution would be in addition to paying the City's trunk sanitary sewer charge. I 6.1 Trunk Area Charge.and Connection Fees I This program is established by the City and is collected with each development project. These rates have been established and are in current use, and are updated annually based on annual construction cost index values. As this program is in practice and accepted, it is not I Feasibility Report I Trunk Sanitary Sewer Extensions City of Shako pee, MN WSB Project No. 1281-92 Page 4 I I recommended that this policy be revised. However, the City may want to evaluate the future cost of the known trunk improvements and evaluate that as an annual amount to be collected. Under this scenario, the value would be realized at the time the project is needed without annual I updates to the policy. 6.2 Lateral Assessment Policy I The City's standard calls for the extension of 8- inch laterals for residential development and 10- inch laterals for commercial and industrial land uses. These are the base sizes to be calculated I for lateral assessments. The current assessment policy indicates that when trunks are constructed that the cost of an 8- I inch extension is assessed to benefiting properties. The cost of upsizing them is paid for by trunk funds. I It is also proposed to amend the City's policy to address over depth installation. Typically, twelve feet deep is the minimum depth required to service a full basement house. Based on this, there is no benefit to constructing anything deeper than that. This should only apply to instances I of a trunk installation to be extended to adjacent subdivisions. This would not apply to specific developments where topography requires a greater depth on a lateral installation. I The calculation of assessments under this scenario would allow for a depth of twelve feet at the next upstream subdivision line. Any depth beyond that would then be considered overdepth and would not be assessed. It also may necessitate a change in how the City pays for sewer I installations in different depth zones to determine this value. The assessments calculated under this section are based on the two preceding sections. I 6.3 Easement Acquisition Funding I As discussed earlier in this report, an easement is required for the proposed sanitary sewer for its alignment through the future Ridge Creek Plat. The construction ofthe project will require the acquisition of both permanent and temporary easements across the proposed Ridge Creek Development site. It is I anticipated that the permanent easements will become-void with the dedication of right- of-way at the time of final plat approval. I 2. The extension of Alignment 2 as proposed will allow the Ridge Creek Subdivision to develop according to the current grading plan. The proposed system shown on the concept plan from the developer's engineer will require additional fill and cost in the I northeast ends ofthe site, adding additional cost to the project. The flatter grades (0.15%) allowed by the extension ofthe IS-inch trunk sewer that is proposed herein will I allow development according to the currently proposed plan. 3. The extension of Alignment 2 as proposed herein will provide adequate depth to allow I continued extension of this line to the east and south in accordance with the City's. Comprehensive Plan. 4. The proposed grades on the pipe extension on Alignment 2 will provide a minimum of I six feet of cover over the top of the pipe in the Prior Lake Outlet Channel at the crossing point. I 5. The construction of Alignment 2 follows the south edge ofthe existing wetland complex on the west end ofthe project site. This will allow lower costs due to ease of I construction. It also provides. greater cover over th~ pipe as the pipe will not cross the low point. of the wetland. - 6. The project funding will utilize City funds for the initial pipe extension from the Prior Lake Interceptor to the west edge ofthe Ridge Creek property. I 7. It is anticipated that imminent domain proceedings will be necessary to acquire the permanent easements for the construction of the project. I 8. This project is being completed as a Chapter 429 Improvement. This process will require a public hearing for the project and the Council will need to order the improvement following the hearing in order to proceed. I 9. This report was developed using the new proposed sanitary sewer assessment policy, which is currently on the City Council's Agenda for consideration. The new policy I incorporates revisions related to assessments for trunk and lateral improvements. Based on the conclusIons listed. the following is recommended: I 1. The City's current trunk area charge policy is in place and accepted as part of the development process. It is not recommended to be modified at this time. I 2. The current assessment policy should be revised according to the revised policy agenda item currently be considered by City Council. I 3. This report finds that construction of the trunk sanitary sewer extension proposed as Alignment 2 is feasible, cost effective, and necessary, and should be constructed as I proposed. 4. It is recommended that the City Council accept the Feasibility Report as presented and I call for the public hearing.
