J ., Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Consider A warding a Contract for the Dean Lake Outlet Control Structure, Project No. 2005-7 DATE: November 15, 2005 INTRODUCTION: Attached is Resolution No. 6328, which accepts the bids and awards a contract for the Dean Lake Outlet Control Structure, Project No. 2005-7. BACKGROUND: On October 4, 2005, City Council adopted Resolution No. 6309, which approved the plans and specifications and authorized staff to advertise for bids for the Dean Lake Outlet Control Structure, Project No. 2005-7. The project includes construction of a permanent control structure for the outlet of Dean Lake On November 8, 2005, a bid opening was held on the Dean Lake Outlet Control Structure Project, in which there were six bids opened for this improvement project. The bids are summarized in the attached resolution. From the bid opening, the apparent low bidder is Sheryl's Construction, Inc. with a Base Bid - $88,630.00 plus Alternate A - $50,000.00 totaling $138,630.00 or Jay Bros., Inc. with a Base Bid - $68,640.00 plus Alternate B - $40,766.00 totaling $109,406.00. The Engineer's estimate for this project is $190,000.00 for Alternate A and $135,000.00 for Alternate B. The 2005 CIP contained a construction cost estimate of approximately $160,000,00 and a project cost estimate of approximately $205,000.00. In review of the bids and the alternates, the Prior Lake - Spring Lake Watershed District (PLSLWD) would prefer the concrete structure (Alternate A), This project would be considered part of the Prior Lake Channel upgrade and eligible to be paid by the PLSLWD, Cities of Prior Lake and Shakopee and the Shakopee Mdewakanton Sioux Community (SMSC) once an agreement is signed. Currently, the draft JP A would have this structure paid as follows: Cityof Shakopee 37.3% PLSLWD 36.9% City of Prior Lake 14.0% SMSC 11.9% If a total project cost of $182,000.00 is utilized, which will be construction cost for Alternate A, 5% contingency and 25% indirect costs, then Shakopee's share would be $67,886.00. The amount budgeted in the CIF was $170,000.00. Attached also is a recommendation from Todd Hubmer, of WSB & Associates, Inc., on the bids and low bidder. Staff's recommendation would be for Alternate A to be awarded, as the structure. will be a focal point for pedestrians and residents in the area. If Council awards the contract, staff is also requesting a contingency amount equal to 5% of the contract to cover minor change orders and quantity adjustments that may occur on the project. Also, an extension agreement with WSB & Associates, Inc. is necessary to provide for the surveying and construction engineering assistance, as needed for this proj ect. ALTERNATIVES: 1. Accept the low bid of Sheryl's Construction, Inc. and adopt Resolution No. 6328. 2. Accept the low bid of Jay Bros., Inc. and adopt a revised Resolution No. 6328. 3. Reject the low bidder and award to another bidder. 4. Reject all bids and rebid. 5, Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 6. Authorize the appropriate City officials to execute an extension agreement with WSB & Associates, Inc. to provide for the surveying and construction engineering assistance, as needed for this project. 7. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.'s 1,5 and 6 in order for this project to commence. If Council wants to proceed with the project using Alternate B, then Alternative No.2 should be selected. ACTION REQUESTED: 1. Offer Resolution No. 6328, A Resolution Accepting Bids on the Dean Lake Outlet Control Structure, Project No. 2005-7 and move its adoption. 2. Approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. 3. The appropriate City officials are hereby authorized and directed to enter into a contract with Sheryl's Construction, mc. in the name of the City of Shakopee for the Dean Lake Outlet Control Structure Project according to the plans and specifications therefore approved by the City Council and on file in the office of the City Clerk. The City received a total of six bids for completion of this of this work. The Dean Lake Outlet Control Structure project was bid as two alternates: Alternate A - concrete outlet control structure; and Alternate B -steel sheetpile outlet control structure. Attached, please find photographs of typical concrete and steel sheetpile outlet control structures. The apparent low bidders for the project are: Alternate A - Concrete outlet control structure - Sheryl's Construction, Finlayson,~, with a bid of$138,630.00. Alternate B - Steel sheetpile outlet structure - Jay Brother's Construction, Forest Lake~, with abid of$109,406.00. Based on previous conversations with the Prior Lake Spring Lake Watershed District and the City of Shakopee's Environmental Advisory Committee, there was a preference that the City give consideration to construction ofthe concrete outlet control structure, which will provide for a more appealing aesthetic improvement. Appearance ofthe structure was a concern due to the outlet structure being located adjacent to a future trail. Should the City Council desire to construct Alternate A (the concrete outlet control structure), we would recommend award of the bid to Sheryl's Construction in the amount of $138,630.00. However, should the City Council desire to construct Alternate B (the steel sheetpile weir), we would recommend awarding the contract to Jay Brothers Construction in the amount of$109,406.00. City of Shakopee 129 Holmes Street South Shakopee,~ 55379 Re: Extension Agreement to Provide Survey and Construction Services Related to the Dean Lake Outlet Control Structure Project City of Shakopee Project No. 2005-7 WSB Project No. 1281-88 Dear Mr. Loney: According to our agreement for professional services with the City of Shakopee in Section I-C-2 (Major Projects), this extension agreement is written to provide professional services for the above referenced project. WSB proposes to provide construction staking and contract administration as necessary to complete the installation of the Dean Lake Outlet Control Structure. The tasks are anticipated to include the following: I. Construction Staking WSB survey crews will provide location and elevation staking for the berm and the outlet control structure as necessary to complete the project. Anticipated cost to complete this task: $1,500- $1,800. II. Construction Management WSB proposes to provide shop drawing review, and as needed construction observation and provide pay voucher and payment recommendations and track change orders on the project. Anticipated cost to complete this task: $2,400 - $3,400. ID. Record Plans WSB will provide a record survey and plans for the Dean Lake Outlet Control Structure. November 10, 2005 Page 2 WSB proposes to complete the construction phase of the Dean Lake Outlet Control Structure for an estimated cost of $4,700 - $6,400. The City of Shako pee agrees to reimburse WSB & Associates, Inc. for the services in accordance with Section V of the Agreement of Professional Services.
