I, CITY OF SHAKOPEE CONSENT Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Authorize Preparation of an Update to the City's Comprehensive Storm Water Management Plan and an MPCA, NPDES Phase II Non-Degradation Plan DATE: November I, 2005 INTRODUCTION: Attached to this memorandum is a proposal from WSB & Associates, Inc. on updating the City's Comprehensive Stormwater Management Plan to meet the Minnesota Rules 8410. Also, this proposal includes preparing a Non-Degradation Plan, as required by the MPCA National Pollution Discharge Elimination Phase II Permit, as the City of Shakopee was one of the 30 cities selected to prepare a plan due to its development and growth. BACKGROUND: The City of Shakopee has prepared a Comprehensive Stormwater Management Plan, which was required by the Metropolitan Service Water Act and to be in compliance with watershed management organizations and watershed districts within the City of Shakopee. The City of Shakopee has two watershed districts and one watershed management organization in its jurisdictional boundaries. These organizations are as follows: . Prior Lake-Spring Lake Watershed District . Scott County Watershed Management Organization . Lower Minnesota River Watershed District The watershed districts have completed their second-generation watershed management plan and most recently Scott County Watershed Management Organization has completed their first generation plan, which has been approved by the Board of Soil and Water Resources. Once these plans have been approved, the City of Shakopee must revise its current Comprehensive Stormwater Management Plan to be consistent with the plans that have been approved by the Board. of Soil and. Water Resources. Per the rules, the City of. Shakopee must have an updated Comprehensive Stormwater Management Plan by the spring of 2006. WSB & Associates, Inc. has done the initial Stormwater Management Plan for the City and has been doing the stormwater management planning for the Comprehensive Plan as well. The proposal submitted by WSB & Associates, Inc. outlines the number of tasks to complete the update of the Comprehensive Stormwater Management Plan, with a maximum cost not-to-exceed cost of $36,300.00. In addition, the MPCA has selected 30 cities to prepare a Non-Degradation plan to be in conformance with the NPDES Phase II Rules. The proposal from WSB & Associates, Inc. outlines the necessary tasks to complete the Non-Degradation plan. Most ofthe rules have been clarified by the MPCA for the completion of the Non-Degradation Plan with the exception of the deadline yet to be established for the City of Shakopee. The cost to prepare this non-degradation plan is $32,000.00. Staff did include funds in the 2005 Storm Drainage Fund for the upgrade of the Comprehensive Stormwater Management Plan. Staff is also anticipating including funds in the 2006 Storm Drainage Fund budget for the final updating of the Comprehensive Stormwater Management Plan and the Non-Degradation Plan needed for the MPCA. Both of these tasks are considered overall stormwater management tasks needed for complying with State requirements for watershed management. Thus, it is proposed the cost for these Stormwater Management Plan and Non-Degradation Plan be expended from the Storm Drainage Fund. ALTERNATIVES: I. Authorize the appropriate City officials to execute an extension agreement with WSB & Associates, Inc. for the update to the City's Comprehensive Stormwater Management Plan and to prepare a Non-Degradation Plan to meet the MPCA/ NPDES Phase II Rules at a total cost not-to-exceed of $68,300.00. 2. Do not approve an extension agreement at this time. 3. Table for additional information. RECOMMENDATION: Staffrecommend's Alternative No. I, due to the fact that State requirements mandate that the City update its Comprehensive Stormwater Management Plan by spring of 2006, since the two watershed districts and the water management organization have completed their plans and have been approved by the Board of Soil and Water Resources. Also,the Non-degradation Plan has been mandated by the MPCA/NPDES Phase II Rules requiring the City to proceed with that plan as well and to be completed by March 1, 2007. City of Shakopee 129 Holmes Street South Shakopee, MN 55379 Re: Extension Agreement to Update the Comprehensive Storm Water Management Plan and Prepare the MPCA NPDES Phase II Non-Degradation Plan for the City of Shakopee, MN Dear Mr. Loney: According to our agreement for professional services with the City of Shakopee and Section I-C-2 (major projects), this Extension Agreement is written to provide professional services for the above referenced projects. Both the Comprehensive Storm Water Management Plan and the Non-Degradation Plan for the City of Shako pee incorporate many of the same elements and modeling requirements to meet review agency approvals. In an effort to streamline the process, we are proposing that we would undertake both ofthese projects simultaneously so as to not expend additional monies duplicating efforts in the near future. We have provided a breakdown ofthe scope of services for the update to the Comprehensive Storm Water Management Plan and the Phase II Non-Degradation Plan separately. Please be aware the costs currently contained within this Extension Agreement anticipate that both projects would be undertaken simultaneously to avoid duplication of efforts. We anticipate close coordination ofthese efforts between the Watershed Districts, the WMO's and the Minnesota Pollution Control Agency during the development ofthese projects. Below please find a breakdown of the anticipated scope of services for each of the projects and the anticipated cost to complete them: I. Update Comprehensive Storm Water Management Plan We propose to revise the City of Shako pee's Comprehensive Storm Water Management Plan in a manner that would be consistent with the amendment procedures outlined in the existing plan. We believe that a complete revision of the document is necessary to incorporate the proposed annexation areas into the plan and to be in conformance with the current watershed district and watershed management organization plans. Review WMO and WD Watershed ManagementPlans WSB will obtain copies of the current plans and review them for policy conflicts and any new requirements for local units of government. We will review the following watershed district and WMO plans: a. Prior Lake Spring Lake Watershed District b. Scott County Watershed Organization c. Lower Minnesota River Watershed District Following a review ofthe watershed district and watershed management organization plans, we will meet with City staff, and ifnecessary the WD's and WMO, to review any inconsistencies in the City's plan and to discuss our approach and response to any new requirements. Anticipated cost to complete this Task: $3,800 - $4,500. B. Incorporate NPDES Storm Water Pollution Prevention Plan WSB will review the City's NPDES Storm Water Pollution Prevention Plan (SWPPP) for conflicts and conformance with the Storm Water Management Plan. We will work with City Staffto identify and incorporate elements of the SWPPP into the Storm Water Management Plan. C. Revise Goals and Policies We anticipate meeting with City staffto review the goals and policies section and to determine if any of the policies have presented problems to the City of Shakopee through implementation over the last five years, or ifthere are additional policies required which can aid City staff in implementation of storm water improvements. In addition, WSB will provide recommendations to address new requirements ofthe WMO, WDs, MPCA, BWSR, and the City's SWPPP into the goals and policies section of the plan. Anticipated cost to complete this Task: $4,200 - $4,600. D. Revise Problem Areas and Corrective Actions We will incorporate any new issues that have arisen since the City's 1999 plan, and include any new problems or concerns contained within the WD plans, WMO plans, and the City's SWPPP. A meeting will be held with City staff to review any new problems and discus the status of the corrective actions identified in the 1999 plan. Incorporating the Annexation areas into the plan 2. Incorporating all new developments which have occurred since the last update 3. Requirements of the WD's and WMO 4. Agreements the City has entered into Anticipated cost to complete this Task: $12,500 - $16,200. E. Update Implementation Priorities and Programs Based on revisions to the goals and policies section, problem and corrective actions section, and any additional or new requirements from WDs,WMOs, MPCA, and BWSR, we will revise and update the implementation priority and the implementation program section within the City's Storm Water Management Plan. We will review the proposed changes with City staff. Upon revising ofthe City's Storm Water Management Plan, we anticipate holding a public meeting to receive input on the proposed changes and to keep the public informed of the City's progress on addressing and improving water quality within the City of Shakopee. Anticipated cost to complete this Task: $3,200 -$3,800. F.Plan Preparation and Review Process WSB will prepare and provide approximately ten copies of a draft plan for distribution to review agencies and City staff. Upon receiving comments from review agencies WSB will meet with City Staff to prepare responses and revisions to the plan. Following this meeting, WSB will provide responses to the WMO and WDs for approval. Upon approval ofthe Storm Water Management Plan by the review agencies, WSB will provide ten copies of the document to the City along with digital files of the plan in a format consistent with the City's computer system. Anticipated cost to complete this Task: $6,800 - $7,200. WSB proposes to complete the update to the City's Comprehensive Storm Water Management Plan for an estimated cost of $30,500 - $36,300 with a not-to-exceed cost of $36,300. This Task is anticipated to be completed by the spring of2006 to meet the requirements of the Watershed Districts and WMO's. II. Prepare MPCA Non-Degradation Plan The work plan we recommend utilizing to complete your non-degradation plan in conformance with NPDES Phase II rules as outlined below: F:\WPWIMTEHlLTR-BLolloy-E.tIAgmtCSWMP-IOJ60S.lloc Mr. Bruce Loney, PE. Collect Background Information As part of this task, WSB will collect necessary background information as it relates to the development of a non-degradation plan for the City of Shakopee. Land use information, aerial photography, available GIS mapping, and other information available will be utilized to the fullest extent necessary to address the requirements ofNPDES Phase II Rules. Much of this information is already available in our WSB Library. Anticipated cost to complete this Task: $3,000. B. Coordination With MPCA / Secure Approval of Work Plan WSB's proj ect team will work with the City of Shakopee and the MPCA to develop a process and methodology for responding to the non-degradation requirements. This task anticipates holding up to four meetings with MPCAand/or City staffto discuss methodologies proposed by WSB to complete the non-degradation storm water modeling, define the assumptions needed to evaluate conversion of undeveloped areas to developed areas, and quantify the benefits provided by various best management practices (BMPs). We anticipate two meetings with the MPCA at the onset of the project to discuss and receive approval of a finalized methodology to address the non- degradation plan. This work may take up to 3 months to complete. Anticipated cost to complete this Task: $1,800. C. Land Use Analysis This task involves the development of data, maps, and tables that can be used to estimate volume, total suspended solids, and total phosphorus loadings for three specific land use conditions within the City of Shakopee: 1. The land use conditions of the City of Shakopee that were present in 1988. 2. The land use conditions present in year 2000. This effort would require an analysis of land-use conversion that occurred in the City of Shako pee from 1988 to 2000. This will identify areas where increases in impervious surface area mayor may not have increased the loadings of pollutants to waters of the State. 3. The development of information that predicts the areas of future growth within the City through the year 2020. The impact of future development on changes in impervious surface cover will be determined with this analysis. Anticipated cost to complete this Task: $5,000 - $7,500. D. Non-Degradation Water Quality Modeling Water quality modeling as required in the NPDES Phase II rules will be completed as part ofthis task. WSB proposes to utilize an approach consistent with P8 modeling for this purpose; however, refinement of the approach will be undertaken as part of Task B. October 26, 2005 Page 5 WSB Staff will utilize information contained in the City of Shakopee's storm water management plan in conjunction with GIS mapping for the City to determine the impact of land conversion for land use conditions defined in Task C. This will include development ofP8 or similar modeling for each type of developed and undeveloped land- use identified within the City. WSB will utilize existing soils information and land-use to determine the changes in pollutant loadings of total phosphorous, total suspended solids, and runoff volume. We will utilize the requirements outlined in the City's storm water management plan to quantify the extent to which new areas of development receive treatment in the form of storm water ponding, infiltration basins, overland overflow, and other best management practices which provide benefits to reducing storm water runoff volumes and pollutant loadings. WSB will develop anticipated benefits from each BMP identified in the City's current NPDES Phase II permit and the capital improvements and policy requirements contained in the comprehensive storm water management plan to determine the net increase or decrease in total phosphorous, total suspended solids, and runoff volumes from developed areas. Anticipated cost to complete this Task: $5,000 - $7,000. E. Evaluation of Modeling Results WSB will provide a report interpreting the results of the modeling activities described in Task IV. This task will summarize the modeling methodologies and determine the net increase or decrease of total phosphorous, total suspended solids, and runoff volume from areas which have developed in the City of Shako pee from 1988 and are anticipated to develop through the year 2020. Anticipated cost to complete this Task: $3,000 - $4,000. F. Mitigation Plan Development As part ofthis task, we will prepare a mitigation plan to meet the requirements ofthe NPDES Phase II rules. The plan will identify the best management practices which may be implemented by the City of Shako pee to return runoff volumes, total phosphorous, and total suspended solids and loadings to 1988 levels. This non-degradation plan will include a discussion associated with the costs to implement the proposed best management practices, and a test of reasonableness to determine if the activities identified within the management plan are considered feasible and prudent for implementation. Anticipated cost to complete this Task: $6,000 - $8,000. WSB proposes to prepare an NPDES Non-Degradation Plan for the City of Shakopee with an estimated cost of$23,800 - $31,300 and a not-to-exceed cost of$32,OOO. October 26, 2005 Page 6 The anticipated total project cost ranges from $54,300 - $67,800 with a not-to-exceed cost of $68,300. The City of Shakopee agrees to reimburse WSB & Associates, Inc. for these services in accordance with Section V of the Agreement for Professional Services.
