No. 7328 (B) Action Sought Gulbrandson Real Estate, LLLP, is requesting that the City Council set a public hearing date to consider their application request for a vacation of drainage and utility easements. Introduction Gulbrandson Real Estate, LLLP, has submitted an application for vacation of drainage and utility easements on property located at 1624 -1684 Weston Court (Apple Ford Shakopee - see Exhibit A for location). The attached Resolution No. 7328 sets a public hearing date to consider the vacation of easements. Background/Discussion The attached resolution sets a public hearing for Tuesday, August 20, 2013. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission will consider the request at its August 8, 2013 meeting. Recommendation Staff recommends that the Council adopt the attached resolution setting a public hearing date for the vacation of easements request from Gulbrandson Real Estate, LLLP. Action Required Approve Resolution No. 7328, a resolution setting the public hearing date to consider the vacation of easements. LANNIEDIS NA UNA SUINIAICNS APPLE FORD "' 1 ijIgi-griit CITY OF SHAKOPEE -----;-...,- - 0.G.-,09043 maw rat G.:4.w SHEET C2 RESOLUTION NO. 7328 A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE VACATION OF EASEMENTS WHEREAS, it has been made to appear to the Shakopee City Council that drainage and utility easements on property owned by Gulbrandson Real Estate LLLP at 1624 -1684 (Lot 1 & 2, Block 1, Shakopee Valley Marketplace West) are no longer of public use or interest; and WHEREAS, a public hearing must be held before an action to vacate can be taken and two weeks published and posted notice thereof must be given. WHEREAS, two weeks published notice will be given in the SHAKOPEE VALLEY NEWS and posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council Chambers on the 20 day of August, 2013, at 7:00 P.M. or thereafter, on the matter of vacating drainage and utility easements on property located at 1624 -1684 Weston Court (Apple Ford Shakopee).
