No. 7332 (B) Action Sought Clark Engineering is requesting that the City Council set a public hearing date to consider their application request for a vacation of drainage and utility easements. Background Clark Engineering, representing SanMar, has submitted an application for vacation of portions of drainage and utility easements in the Opus MVW and Opus MVW 2nd Addition plats. The attached Resolution No. 7332 sets a public hearing date to consider the vacation of the drainage and utility easements. The purpose of this application is to prepare for a minor subdivision to adjust a lot line to create a more marketable parcel southeast of SanMar's building that is zoned Light Industry (I -1). The proposed parcel is 9.30 acres. The proposed vacation of easements are utility easements adjacent to the current lot line. Clark Engineering has already applied for a minor subdivision that contemplates the vacation of these specific easements, which would make the proposed lot more marketable for future industrial development. Additional easements for the new lot are proposed as part of the minor subdivision. The attached resolution sets a public hearing for Tuesday, August 20, 2013. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission will consider the request at its August 8, 2013 meeting. Recommendation Staff recommends that the Council adopt the attached resolution, Resolution No. 7332, setting a public hearing date for the vacation of drainage and utility request by Clark Engineering. Budget Impact The proposed action of setting the public hearing for the vacations of easements has no budgetary impact at this time. If the City Council chooses to vacate the drainage and utility easements, it aids in the creation of a more marketable parcel for industrial development. Relationship to Vision This item relates to goal B: Positively manage the challenges and opportunities presented by growth, development and change. Requested Action Adopt Resolution No. 7332, a resolution setting the public hearing date for the proposed vacation of certain Drainage and Utility Easements in the Opus MVW and Opus MVW 2nd Addition plats. Attachments: Resolution No. 7332 RESOLUTION NO. 7332 A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE VACATION OF DRAINAGE AND UTILITY EASEMENTS WHEREAS, it has been made to appear to the Shakopee City Council that certain drainage and utility easements in the plats of Opus MVW and Opus MVW 2 Addition is no longer of public use or interest; and WHEREAS, a public hearing must be held before an action to vacate can be taken and two weeks published and posted notice thereof must be given. WHEREAS, two weeks published notice will be given in the SHAKOPEE VALLEY NEWS and posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council Chambers on the 20 day of August, 2013, at 7:00 P.M. or thereafter, on the matter of vacating a 25' of drainage and utility easement adjacent to a portion of the south lot line of Lot 2, Block 1, Opus MVW and 20' of drainage and utility easement adjacent to the north lot line of Lot 1, Block 1 Opus MVW 2 Addition, and vacating 40' of drainage utility easement adjacent to a portion of the west lot line of Lot 1, Block 1 Opus MVW 2nd Addition and the southeastern lot line of Lot 2, Block 1, Opus MVW 2 Addition.
