CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Assessment Hearing for 2005 Reconstruction, Project No. 2005-1 DATE: November 1, 2005 INTRODUCTION: Attached is Resolution No. 6316, a resolution which adopts the assessment for the above referenced proj ect. BACKGROUND: This project has essentially been completed and all project costs identified. The final project cost IS $1,325,437.07, which consists of construction costs and engineering/administration costs. A breakdown of the project costs are as follows: Description Amount City Costs $ 822,024.61 Assessments $ 262,744.53 SPUC Costs $ 240.667.93 TOTAL PROJECT COSTS $1,325,437.07 City policy is to assess 25% of the project costs for street reconstruction to the benefiting properties. Street improvements were assessed on a front foot basis. Sanitary sewer service replacement was assessed 100% to the benefiting properties. Attached to this memo is the assessment roll for Council consideration and adoption, and a map ofthe project area. A presentation of the final costs and assessments will be made at the Council meeting. ALTERNATIVES: 1. Adopt Resolution No. 6316. 2. Deny Resolution No. 6316. 3. Table Resolution No. 6316 for specific reasons. RECOMMENDATION: Staff recommends Altemative No.1. ACTION REQUESTED: Offer Resolution No. 6316, A Resolution Adopting Assessments for the 2005 Street Reconstruction, Project No. 2005-1 and move it adoption. CJ-IfW~ Jeff Weyandt Assistant City Engineer JW/pmp ENGR/2005PROJECT/2005RECON/WORD/MEM6316 RESOLUTION NO. 6316 A Resolution Adopting Assessments For The 2005 Street Reconstruction Project No. 2005-1 WHEREAS, pursuant to proper notice duly given as required by law, the City Council of the City of Shakopee met and heard and passed upon all obj ections to the proposed assessments of: . Sommerville Street, from 4th Avenue to 5th Avenue . Sommerville Street, from 6th Avenue to Shakopee Avenue . Apgar Street, from 10th Avenue to Meadows North . Scott Street, from 10th Avenue to Meadows North . Atwood Street, from 10th Avenue to Meadows North . Fuller Street, from 8th Avenue to 10thAvenue NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2. Such assessments shall be payable in equal annual installments extending over a period of ten years, the first installment to be payable on or before the first Monday in January, 2006, and shall bear interest at the rate of 5.25 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31,2006 and to each subsequent installment when due shall be added the interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year.
