I). 3; MEMORANDUM TO: Mayor & City Council Mark McNeill, City Administrator Bruce Loney, Public Works Director FROM: Michael Hullander, Public Works Supervisor DATE: October 18, 2005 SUBJECT: Consider Ordinance No. 740 An Ordinance Pertaining to Parking Restrictions And Amending Section 9.50 of the City Code INTRODUCTION: Attached is Ordinance No. 740, an ordinance pertaining to the parking restrictions in Section 9.50, Subdivision 7, Towing and also amending Subdivision 8 (B) Snow Emergency Routes of the City Code. BACKGROUND: City Council last amended City Code Section 9.50 on October 16, 2001. Public Works is requesting council to consider two amendments. 1. Section 9.50, Subdivision 7 Towing - Staffis requesting to change the ordinance to read as follows: Subd. 7. Towing. Persons in violation of the parking restrictions outlined in this Section and parking on designated SilO'.'..' emergency routes, shall be tagged and subj ect to being towed at their own expense. The deletion of this wording clarifies that all parking violations of this section shall be tagged and subject to tow at the owner's expense. This amendment clarifies that vehicles parked in violation of the parking restrictions in the central business district can be immediately towed so that Public Works staff can remove the snow without vehicles impeding operations. Past practice has been to automatically tow vehicles, but the Police Department indicated to Public Works that they would like further clarity in the ordinance to tow vehicles. 2. Section 9.50, Subdivision 8 (B) Snow Emergency Routes- Staff is requesting council to consider adding: 1.) 17th A venue, from '.Veston Lane to ~'2 Mile East of Sarazin Street County Road 15 to Independence Drive, 2.) Independence Drive from 1 th Ave to Valley View Road, 3.) Valley View Road from Sarazin Street to County Road 83, 4.) Valley View Road from 1 ih Avenue East to Evergreen Lane, 5.) Sarazin Street from 17th Avenue to Valley View Road ALTERNATIVES: 1. Adopt Ordinance No. 740, an ordinance pertaining to vehicle parking restrictions and amending Section 9.50 of the City Code. 2. Deny Ordinance No. 740. 3. Table for additional information. RECOMMENDATION: Staff recommends alternative No.1 to adopt Ordinance No. 740 and publish this ordinance so that the public can be informed of the new restrictions to this coming snow season. ACTION REQUESTED: Offer Ordinance No. 740, an ordinance pertaining to vehicle parking restrictions and amending Section 9.50 of the Shakopee City Code and move its adoption. Section 9.50, Subdivision 7 of the Shakopee City Code is amended to read as follows: Subd. 7. Towing.
