CITY OF SHAKOPEE CONSENT Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Joe Swentek, Project Engineer SUBJECT: Glacier Estates Addition Wetland Replacement Plan DATE: October 18, 2005 INTRODUCTION: College City Homes (Polaris Group, Inc.) has submitted a complete Wetland Replacement Plan application. Staff along with a Technical Evaluation Panel (TEP) has reviewed. the application and determined the requirements of the Wetland Conservation Act (WCA) have been met by this plan. The replacement pIan must be acted upon by the City Council in their roll as the Local Governing Unit (LGU) for the WCA of 1991. Attached for Council consideration is Resolution No. 6314, a resolution approving the Wetland Replacement Plan for Glacier Estates Addition. BACKGROUND: The Wetland Replacement Plan, as proposed by College City Homes, would fill approximately 0.059 acres of wetland. The impacted wetland is proposed to be replaced onsite by constructing approximately 0.084 acres of new wetland and 0.035 acres of upland buffer. The City requested a review by the TEP, which consists of a City staff member, a representative from the Soil and Water Conservation District (SWCD) and a representative from the Board of Soil and Water Resources (BWSR). The TEP, established by the WCA, provides professional, technical review of wetland issues to the LGU. The TEP has reviewed the site and the replacement plan and is recommending approval of the plan. City staff and the TEP consider the application complete. Please see the attached letter from the Scott Soil and Water Conservation District dated August 30,2005. The Wetland Replacement Plan is being proposed to accommodate the installation of a vital trunk: sanitary sewer main and an associated maintenance/access trail. ALTERNATIVES: 1. Adopt Resolution No. 6314. 2. Deny Resolution No. 6314. 3. Table for additional information from staff. RECOMMENDATION: Staff recommends Alternative No.1. Rules Parts 8420.0540 and 8420.0550; and WHEREAS, all interested parties on file in the office of the City Engineer or identified in Minn. Rule 8420.0230 have been mailed notice of the proposed Wetland Replacement Plan; and WHEREAS, the Technical Evaluation Panel reviewed the proposed Replacement Plan and considered the public values, 10cation, size and type of wetland being altered and recommended approval of the Wetland Replacement PIan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. Based on the replacement standards in Minn. Rules Parts 8420.0630, and on the recommendation of the Technical Evaluation Panel, the Wetland Replacement plan is hereby approved. 2. Approval of the Wetland Replacement Plan shall become effective upon its adoption. 3. A copy of this decision shall be mailed to all interested parties and to the applicant. Beckius, District ~anager Scott Soil and Water Conservation District Re: Review of the Wetland Replacement Plan Supplement for the Glacier Estates Development A review of the Wetland Replacement Plan (WRP) application for the Glacier Estates development has been completed by the Scott Soil and Water Conservation District (SWCD). The subject property is 10cated in the N ~ ofthe S ~ of Section 13, T115N, R22W, City of Shako pee, Scott County Minnesota. The June 29,2005 Wetland Replacement Plan Application was prepared by Polaris Group Inc. The following comments and/or suggestions are submitted for your consideration: 1. The Scott SWCD reviewed the June 29,2005, WRP application to determine ifthe application was complete and compliant with Wetland Conservation Act (WCA) rules. Enclosed is a "Replacement Plan - Determination of Complete Application" checklist used by the SWCD to evaluate the pIan. The checklist indicates that all items found under the Sequencing Analysis (8420-0520) and Replacement Plan Components (8420.0530) are complete. Please review the additional comments listed below for suggested minor application amendments. The LGU (City of Shako pee) will need to make a decision on the WRP and provide notification of their decision to the appropriate agencies. . The WRP identified that 2,585 square feet of Type 2 wetland will be filled to accomplish the project. The purpose of the fill was shown as a City of Shako pee required bike path. It should be noted that sequencing was not detailed in the WRP attachments; however, a Technical Evaluation Panel (TEP) meeting with representatives from the SWCD, LGU, BWSR and Army COE was convened on June 28, 2005 to discuss the proposed impacts with the project engineer. It was determined that the proposed bike trail site and associated wetland impacts shown on the drawing that accompanied the application, minimized the wetland impact to the greatest extent possible. The TEP supported this impact as practical and reasonable. . The "Description of Replacement Wetlands" on page 5, item #17 ofthe application, indicated that 3,646 square feet of New Wetland Credit and 1,524 square feet of Public Value Credit would be created for mitigation. Even though we know that the replacement has be identified as project specific and be accomplished on site, all the boxes should be filled out in this table describing the replacement wetland. The scaled drawing that accompanied the application (Wetland Enhancement, Type Conversion, Impact and Mitigation) has a legend that only shows the New Wetland Credit mitigation area of 3,646 square feet. The Public Value Credit mitigation area of1,524 square feet is not shown on the map. This should be clearly identified also. . The first box found in the item #19, Part B, "Signed Affirmations" must be checked. The narrative that accompanied the application indicated that the excavation and replacement was going to be "conducted simultaneously" but the application is required to show this also. 2. The proposed wetland excavation in the Type 2 wetland is not regulated by the Wetland Conservation Act. The applicant should insure that permits from other regulatory agencies i.e. Army CaE, City of Shakopee (grading), are obtained prior to excavation commencing. A Grading Permit should not be issued until proper approvals have been received from the LGU for the proposed wetland excavate and fill activities. The LGU is the City of Shakopee.
