Michael Leek, Community Development Director SUBJECT: TextAmendment Regarding Off-Premises Signage, Ordinance No. 738 MEETING DATE: October 18, 2005 INTRODUCTION: On Tuesday, October 4, 2005 the City Council adopted Ordinance No. 738, an ordinance allowing off-premises signs. At that meeting I incorrectly reported that the Planning Commission had recommended approval of the proposed text amendment with revisions. I want to first sincerely apologize to both the Council the Commission, and Ms. Klima for my error in reporting the Commission's recommendation, and causing the recommendation to be erroneously reported in Ms. Klima's memo. The error was not made intentionally. The motion at the Commission to recommend approval of the text amendment in fact failed on a 2-5 vote. Because of this error, I have put this item on the Council agenda, so that ifit wishes, the Council can consider the correct recommendation in determining whether to let the ordinance stand as adopted. ALTERNATIVES: 1) Offer a motion to suspend the rules, and reconsider Ordinance No. 738, an ordinance allowing off-premises signage; 2) Let the adoption of Ordinance No. 738 stand (no action). ACTION REQUESTED: Either 1) offer a motion to suspend the rules, and reconsider Ordinance No. 738, an ordinance allowing off-premises signage, or 2) let the adoption of Ordinance No. 738 stand (no action) ORDINANCE NO. 738, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CITY CODE SEC. 11.70, SUBD. 6 THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - That City Code Chapter 1, Zoning, Sec. 11.70, Subd. 6 is hereby amended by adding the language that is underlined and deleting the language that is struck through. F. Off Premise Sie:nae:e. Off-premise signs shall be allowed for the purpose of advertising temporary seasonal community events open to the general public. Off-premise signs shall comply with the following: 1. shall obtain a temporary sign permit: 2. shall be limited to total display time of 30 davs per calendar vear: 3. shall be located along Highway 169 frontage: 4. shall provide written consent from the property owner: 5. shall be limited to 150 square feet in size: 6. shall be a one sided sign: 7. shall not be mounted on trucks or semi-trailers: 8. shall not exceed 20 feet in height: 9. shall be located within one half mile of Highway 169 interchanges: 10. shall be limited to 1 sign per event and location: 11. shall be setback 10 feet from the property line. Section 2 - - Effective Date. This ordinance. becomes effective from and after its passage and publication.
