Memorandum CONSENT

SUBJECT: Project Closeout - Final Payment-Downtown Fire Station Reroofing
DATE: September 29,2005
INTRODUCTION:
The City Council is asked to accept as final the Downtown Fire Station reroofing project,
and authorize payment of $4,129.45 as retainage.
BACKGROUND:
In the Fall of2003, the City awarded a contract to G & S Roofing, Inc., for reroofing the
Downtown Fire Station project. The amount of the contract was for $82,589.
Work was completed on this, but the project was never c1osedout. Earlier this year, the
contractor (G & S Roofing, Inc.) was declared in default of payment, apparently to
suppliers. We had been advised by attorneys for the performance bond company that G
& S has "assigned, transferred, and conveyed" to the bond company all deferred
payments and retained percentages.
Based on that, the City is requested to release the $4,129.45 that has been held as
retainage, and send that to the bond company.
At the same time, we recommend that the contract be final ed, as there are no outstanding
performance issues yet to address.
RECOMMENDATION:
I recommend that the Council accept the project as completed, and that the retainage be
released.
ACTION REQUIRED:
If the Council concurs, it should, by motion, authorize the release of payment of
$4,129.45 to Navigators Insurance Company, and declare the Downtown Fire Station
reroofing project as finaled. l~JL~~
