MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Mark Themig, Parks, Recreation, and Facilities Director Meeting Date: October 4, 2005 Subject: Rotary Donations for Huber Park INTRODUCTION City Council is asked to authorize. use of the Rotary's donation for Huber Park for the Community Built Playground. BACKGROUND AND DISCUSSION Shakopee Rotary has requested that the funds they have donated to the city for Huber Park D~velopment be used toward the Community Built Playground. The Rotary made this decision in the form of a motion a special boar meeting and regular meeting on September 27. As I understand, Rotary has made a commitment of funding $50,000 toward Huber Park redevelopment. Initially, there was discussion about Rotary having naming rights for the performance area. (Apparently the estimated costs for the performance area at that time were around $50,000). However, as more detailed design work and cost estimates were developed, it was clear that the performance area would cost significantly more than $50,000, so the ability to get naming rights came into question. Rotary's request provides $30,000 in funding now to the playground, and would result in naming rights for the playground as the top sponsor, Rotary has provided $28,300 to the city for Huber Park that would be applied toward the playground project under this request, and the remaining $1,700 would be paid directly to the playground committee. This funding will provide financial resources to upgrade the wood fiber surfacing material to rubber mulch surfacing material. The rubber mulch is more durable and will result in lower long-term maintenance costs. We have five quotes for rubber mulch surfacing material and low quote is for a product called PlaySafer is $40,020 from Rubberecycle. As of writing this memo, we have not confirmed how the money that Rotary has already donated to the city would be applied toward the playground. There appear to be two options: 1. The city would refund the money to Rotary, and Rotary would provide a direct contribution to the playground committee for the full $30,000. However, this option could create issues for Rotary since the funds were lawful gaming funds. 2. The city would purchase the rubber mulch using the funds previously donated by Rotary, and the playground committee would make a contribution to the city for the difference. However, this option would result in sales tax for the city. REQUESTED ACTION By the time of your meeting, I will have an answer as to which option should be used. Authorize purchase of rubber mulch surfacing material for the Community Built Playground from Rubberecycle in the amount of $40,200 plus sales tax. Rotary Club Meeting: Tuesday September 27,2005 . Ron Smith made a motion to have the Rotary $50,000 moved from the Huber Park commitment to the Playground project at Huber park with naming rights. Chuck Berg seconded the motion. Discussion followed: Chuck Berg made an amendment to have the dollars in the escrow account which is $28,300 and Rotary to add $1,700 to have a total of$30,000 moved to the Huber Park Playground immediately. Gary Laurent seconded the amendment The amendment passed. Further discussion - The motion passed with the amendment. . Ron Smith made a motion to enter into discussion with the city on other opportunities for the remaining $20,000 that had been given for the Huber Park project back into 2001. Jack Cole seconded the motion. Motion carried. . Gary Laurent made a motion forthe board to take necessary steps to safeguard and protect the Rotary Club from future liability issues or concerns. The U.S. Consumer Product Safety Commission, the U.S. Testing Company, and the State of Illinois, among numerous state and federal agencies, independent laboratories and licensed testing companies have conducted various tests designed to measure the shock-absorption of various surface materials as they relate to falling objects. Tire rubber chips have been shown to consistently absorb more shock impact than any other standard surface material. This is particularly important because more than 550,000 playground injuries end up in the emergency room every year. That is more than 1,500 visits per day. The majority of those injuries are attributed to falls. Therefore you can't afford to have anything less than the world's safest playground surface: Playsafer. Is there any steel content in Playsafer? No. Playsafer 1/2 inch chips are smaller than most others. The smaller the chips, the less likely they are to contain embedded steel wire. To ensure that all wire is removed, Playsafer chips pass through 4 unique, state of the art magnets during the manufacturing process. This extra attention literally ensures no steel content. Does Playsafer blow or wash away? No. Playsafer chips are too heavy to be significantly affected by normal high winds or heavy rains. Does Playsafer come in any color besides black? Yes. The end result is that the colored Playsafer should not fade any faster than that of good quality house paint, and may very well last much longer. How should the play area be prepared? We recommend the area be prepared ahead of time by clearing the ground of rocks, stumps and other debris, then calculate an area that surrounds the play equipment of 6-8 feet (commonly referred to as the "use" or "fall zone"). We also recommend the use of 6" railroad ties around the entire play area, which will contain the Playsafer, and a filter fabric beneath the rubber to prevent weed growth into the play area. Where Playsafer is replacing some other surface material, it is best to remove the old surfacing material completely. Sand or pebbles, for example, will only work their way to the surface and minimize Playsafer shock-absorption values, and reintroduce abrasiveness to the play area. Wood mulch or chips will continue to attract insects, etc. under the surface and will eventually decompose there as well. How is Playsafer delivered? Playsafer is delivered in bulk form which makes the installation process easier. What type of maintenance is required? Occasional raking. Is Playsafer toxic? No. Playsafer is non-toxic (and in the case of colored surfacing chips, only non-toxic paints are used). No. Unlike wood mulch or chips which can bleed when wet, Playsafer does not stain. DoPlaysafer chips smell? No. Some odor may be present at the time of installation, but, similar to installing a new shower curtain, any odor will soon disappear. Will the DEP (Department of Environmental Protection) bother property owners where Playsafer is installed? No. The DEP "strongly promotes the use of recycled products since it is essential to the long-term success of local and national recycling programs." In fact, the DEP visited the Playsafer manufacturing plant in Lakewood, NJ, and has expressed enthusiasm for the company's efforts to rid the environment of hazardous tire disposal sites by creating a positive environmental use. Playsafer recycled tire chips are not subject to DEP regulation and there are no special removal requirements associated with the closing of a play area that has used them. Will chips that find their way into clothing end up melting in a clothes dryer? No. Tire rubber melts at approximately 500 degrees F. Clothes dryers operate at less than 100 degrees F. What happens to leaves or branches that fall or blow onto Playsafer surfaces? Those that are not removed by lightly raking the surface will simply drain through the chips and decompose over time. How does the cost of Playsafer compare to other products? Initially Playsafer may cost a little more than some other surfaces, however, Playsafer only needs to be installed once. No annual upgrading or replacement is required. Furthermore, in comparison to wood mulch, Playsafer requires a maximum of six inches in depth, versus 12 inches for wood mulch. @ 2001 by Rubber Recycle. Nothing in this agreement shall constitute a waiver or diminution by the City of any of its immunities or statutory limitations on liability.
