INTRODUCTION:
Attached is Resolution No. 6310, a resolution ordering the preparation of a feasibility
report for trunk sanitary sewer extension, from the Prior Lake Interceptor to the Riverside
Bluffs development.
BACKGROUND:
On September 6, 2005, the preliminary plat of Riverside Bluffs was approved with
several conditions. One of the conditions is for the development to have permanent
sanitary sewer extended to their site for development. At the September 6, 2005 meeting,
it was suggested by staff to wait until the October 4, 2005 meeting to consider a public
improvement project for the extension oftrunk sewer to this development.
Attached to this memorandum is a letter from Brian Sullivan of Ryland Homes and Mark
Leisener the property owner of Riverside Bluffs petitioning City Council to extend trunk
sanitary sewer via a 429 public improvement process. In their letter, their concern is the
availability of sanitary sewer to their site by June of 2006. Riverside Bluff s
development would offer up to $150,000.00 towards public construction of trunk sanitary
sewer to defray any additional costs that the City may incur by proceeding with an
improvement project. This contribution would be in addition to paying the City's trunk
sanitary sewer charge. Also attached is a letter from Tollefson Development Inc.
requesting the City of Shakopee proceed with a 429 public improvement project for the
trunk sanitary sewer and in addition, Tollefson would like a water main connection to
Ridgeview Farms plat through the Ridge Creek proposed plat. This agenda item is only
for the sanitary sewer extension to Riverside Bluffs.
Other options that may be available to the developer is working with the adjacent
property owners/developer of the Ridge Creek development in extending trunk sanitary
sewer to their site, or the City allowing a temporary lift station until trunk sanitary sewer
is extended to the Ridge Creek development.
The Ridge Creek development has submitted a preliminary plat that is currently being
reviewed by City staff for completeness, and if complete to go through the development
reVIew process. The developer of Riverside Bluffs has indicated that they would
continue to work with the Ridge Creek development in order to construct a trunk sanitary
sewer to their site. However, they wish to proceed with a 429 public improvement
process, if they are unsuccessful in working out an agreement with the Ridge Creek
developer.
Staff has sent a request- for- proposal to WSB & Associates, Inc. to prepare a feasibility
report for this trunk sanitary sewer extension, and also to review the City's Assessment
Policy and Trunk Sanitary Sewer charge for trunk sanitary sewer extensions that the City
currently has for new developments. The current funding level for trunk sewers is in a
deficit and staffs review of future sewer extensions along C.R. 18, c.R. 83 and in the
area of Riverside Bluffs and Ridge Creek does show the deficit further increasing.
The proposal from WSB & Associates outlines a schedule in which the feasibility report
can be completed, public hearing can be done and the project design in order to meet a
June, 2006 schedule. The one area that would control the ultimate timing of this
improvement would be the right-of-way acquisition, if easements are not obtained, and
the City would need to start condemnation proceedings as soon as possible in the public
improvement process.
Staff has estimated a total project cost for this project to be $535,000.00 including right-
of-way acquisition. The feasibility report will determine,the amount to be assessed, and
the amount to be paid out of the City's Trunk Sanitary Sewer Fund, along with additional
contribution from the Riverside Bluffs developer. The City's trunk sanitary sewer
charge will be reviewed during the feasibility report preparation. The lateral sewer
assessment policy will be reviewed, as well, and changes recommended as necessary.
Staff has indicated to the developer of Riverside Bluffs, that if the City were to proceed
in this fashion, that an agreement would need to be signed in which the developer would
reimburse the City of all costs in the preparation of the feasibility report and plan design
in the event that this project is not ordered by the Councilor the developers work out a
project privately.
AL TERNATIVES:
1. Approve a resolution ordering the preparation of a feasibility report for a trunk
sanitary sewer extension, from the Prior Lake Interceptor in the plat of Ridge
Creek Farms to the east plat line Riverside Bluff's development.
2. Do not approve a resolution ordering the feasibility report for a trunk sanitary
sewer extension at this time.
3. Authorize the appropriate City officials to execute an extension agreement with
WSB & Associates, Inc. for the preparation of the feasibility report, as outlined in
their attached proposal.
4. Do not authorize the extension agreement with WSB & Associates, Inc.
5. Authorize the appropriate City officials to enter into a reimbursement agreement
with Ryland Homes, Inc. for the preparation of a feasibility report of the Trunk
Sanitary Sewer Extension, from Prior Lake Interceptor to the east plat line of
Riverside Bluffs as prepared by the city attorney.
6. Do not authorize a reimbursement agreement.

RECOMMENDATION:
If the City Council wishes to proceed with a 429-improvement project, in order to
construct the sewer byJune, 2006, the feasibility report would need to be authorized at
this time. Alternative No.'s 1, 3 and 5 would need to be approved in order to proceed
with the feasibility report. By proceeding with the feasibility report, at this time, this
would not preclude the developers of Ridge Creek and Riverside Bluffs in working
together to extend the trunk sanitary sewer privately versu::; a public improvement project.
Staff has requested that an agreement be entered into between the developer of Riverside
Bluff and the City to pay for any costs in the preparation of the feasibility report and
design of the trunk sanitary sewer, in case the project does not get approved for next year.

WHEREAS, it is proposed to extend trunk sanitary sewer, from the Prior Lake Interceptor
to the east plat line of Riverside Bluffs, by construction of sanitary sewer and all appurtenant work
and to assess the benefitted property for all or a portion of the cost of the improvement, pursuant to
Minnesota Statutes, Chapter 429.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, that the proposed improvement be referred to Bruce
Loney, Public Works Director, for study and that he is instructed to report to the Council with all
convenient speed advising the Council in a preliminary way as to whether the proposed
improvement is feasible and as to whether it should best be made as proposed or in connection with
some other improvement, and the estimated cost of the improvement as recommended.

Dear Mr. Loney:
Weare pleased to present this proposal for professional services to complete the feasibility
study, design and contract documents for the improvements relating to the trunk sanitary sewer
extension from the Prior Lake futerceptor to the Riverside Bluffs Development. The proposed
project includes the design and construction of a IS-inch trunk sanitary sewer from just east of
Pike Lake Road across undeveloped properties to provide service to the Riverside Bluffs
subdivision. This proposal presents our understanding ofthe project along with our proposed
scope of services relating to the design and construction of the project.
PROJECT UNDERSTANDING
The City is in need of a consultant to complete the design and construction documents relating to
the proposed trunk sanitary sewer extension from the MCES interceptor west of Pike Lake Road
along the alignment that has been developed by City Staff.
The proposed pipe alignment is proposed to go through a primarily undeveloped area ofthe City.
The proposed trunk will connect to the MCES interceptor west of Pike Lake Road and extend
north and easterly through an existing wetland and eventually through private property
anticipated to be developed at some point. Theproposed alignment has been set based on the
conceptual plat for this area. The proposed pipe will terminate at the west limits of the Riverside
Bluffs Development. Further extension ofthis trunk line will be extended with the construction
ofthe proposed development.
The design and construction will require coordination with the MCES to address details
associated with the proposed connection. It is assumed that equipment required for any metering
that would be required would be supplied by the MCES along with their details for installation to
be included in the plans and specifications.

The crossing of the wetland will require the delineation of the boundaries of that particular
complex. It is understood that the pipe is anticipated to be very shallow going through the
wetland. It will be critical to obtain enough soils information to determine the best means of
crossing the wetlands and providing a stable foundation for the pipe.
It is understood that the proposed pipe will be crossing a parcel of property under private
ownership. Services associated with obtaining the easement for the pipe installation and
maintenance will need to include easement description and exhibit preparation, appraisal of the
property and negotiations with the landowner on behalf of the City. If the acquisition is pursued
through eminent domain, additional expenses can be expected from WSB and Evergreen Land
Services.
In addition to design and construction services, the City is requesting the review of its Trunk
Sanitary Charge Policy as well as its' assessment policy for lateral sanitary sewer construction.
PROJECT APPROACH/SCOPE OF SERVICES
WSB & Associates, Inc.'s project scope and proposed work plan is based on our understanding
ofthe project scope and experience on similar projects. The preliminary and final elements of
design will be based on the topographical survey performed as part ofthis project and the
preliminary design provided by City staff. The work plan has been separated into the key
components and is broken down in an hourly task budget attached to this letter. The key
components are discussed for clarification in the following paragraphs.
1. Project Management
Project management is a key task included in each phase of the project. In each case, this
task consists of management and administration, project coordination and communication
with the City of Shako pee. Proper completion of this task will allow for routine updates
on project issues as well as keeping the project on schedule and within budget.
2. Wetland Delineations
This task involves the delineation of wetlands within the project limits. Work to be
completed with this task includes the following:
. Delineation of Wetlands in October 2005. Delineation will include sides of the
wetland complex affected by the construction.
. Conformance to 1987 US Corp of Engineers Wetland Delineation Manual.
. Field review with watershed TEP.
. Preparation and submittal of the delineation report.
. Survey of the delineation.

3. Topographic Survey
A WSB survey crew will perform a topographic survey of the proposed alignment. The
distance to be surveyed is approximately 3,000 feet along the proposed alignment.
Global positioning (GPS) receivers will be used in conjunction with electronic total
stations in the field to expedite the survey process. Items to be included in the survey
will include:
. Spot elevations
. Cross-sections at 50-foot elevations
. Profiles along the proposed utility alignment
. All existing conditions in the project area
. Significant trees
. Property lines/corners
. Existing utilities
. Delineated wetland boundaries
4. Prepare Legal Descriptions for Proposed Right-of-Way/Easements
Based on the final alignment and easement needs, WSB will prepare easement exhibits
and legal descriptions needed for the acquisition ofthe identified easements. Appraisals
and land acquisition negotiations will be completed by a sub-consultant under this
contract. The budget included for this task represents acquiring easements from one
parcel as identified in the request for proposals dated September, 2005.
5. Feasibility Study
The work involved with this task includes the following tasks:
. Verification of the preliminary alignment and grade supplied by the City.
. Verification of design flow calculations for pipe sizing.
. Quantity takeoff/cost estimate.
. Report preparation including description of improvements, conclusions and
recommendations regarding project feasibility and preliminary assessment
information.
. Graphi~s illustrating improvements.
. Development of a subsurface soils investigation plan. Costs are included for the
City's geotechnical engineering firm.

6. Policy Review
Work included in this task will be the formal review ofthe City's Trunk Sanitary Sewer
Charge policy in addition to the City's sanitary sewer lateral assessment policy. The
deliverable for this task will include a memorandum to the City outlining recommended
modifications to the policy that may be forwarded to the City Council for adoption and
implementation.
7. Final Design Services
This task represents the final design, plan preparation, specifications and bidding
services. Design services will include:
. Alignment and profile for the gravity sanitary sewer. The design will address
details associated with the construction including wetland crossings and impact'
minimization, trench requirements, and MCES requirements for the sewer
extension.
. Identification of easement dimension and requirements.
. Construction plans that include a title sheet, construction details and plan and
profile sheets detailing the requirements for the construction of the improvements
as proposed.
. A temporary/permanent erosion control plan for the project for the application of
for the NPDES Phase II construction permit.W e will also prepare Stormwater
Pollution Prevention Plan documentation in accordance with the construction
activity permit.
. Preparation ofproject specifications, bidding and contract documentation
necessary for the construction contracting portion of the project.
. Preparation of quantity takeoffs and cost estimates for the purposes of evaluating
bids received for the work.
The construction plans will be submitted to the City of Shako pee at various stages of the
Design development and plan preparation for review.
8. Permit Applications
The following permits will be prepared and submitted by WSB on behalf ofthe City. It
is anticipated that the City will provide fees for the submittals.

9. Construction Services
Construction services will be provided as part of the scope of services included in this
proposal. Services to be provided include:
. Construction staking for the proposed improvements.
. Engineering consultation and support during the construction as requested by the
City.
. Surveying of final improvements for the preparation of record drawings.
. Preparation of record drawings in accordance with the City of Shakopee
standards.

In an effort to keep the project on schedule, it will be necessary to start the land acquisition for

providing some additional time for land acquisition.

PROPOSED FEE
The attached task hour budget shows the proposed hours and fee proposed to complete the
design and contract documents for the proj ect. Construction services are proposed to be
contracted on hourly basis following the award of the construction contract for the project. The
proposed fee is based on our 2005 rates as shown on the attached work sheet.

The initial authorizations at October 4 will need to include the field work. The wetland
delineations need to be completed when vegetation in wetland is still growing.. The preliminary
survey will need to be completed following the wetland delineations to ensure that boundary
locations are accurate and the survey is complete prior to snow accumulation. The policy review
should also be authorized in conjunction with the Feasibility Study as the policy will have a
direct impact on the funding scenario developed during the feasibility process. The land
acquisition process will need to be authorized at the first Council Meeting in November. This
will allow the identification of easements necessary for the construction. This schedule allows

sixty days for the negotiations to proceed. If it is found that the eminent domain process is
required, initiation ofthese proceedings on December 9,2005 will still allow construction to
begin in late March or early April, 2006.

It may not be possible to survey the pipe alignment due to land acquisition related issues. This
would reduce preliminary survey costs that are requested to be authorized immediately by
$4,000.00.
Also attached to this letter is the project team we are proposing for the project. This information
has been included for your review.
This letter represents our entire understanding ofthe project scope. If you are in agreement,
please sign on the space provided and return one original signed copy to us for our records. We

PROJECT PERSONNEL
. Kevin Kawlewski, P.E.
Project Manager
Mr. Kawlewski will serve as the Project Manager for the project. He will be responsible for
coordinating the work within the WSB team and responsible for the quality control, staff
scheduling, and overall project management to ensure that the projectmeets a high quality
standard, is delivered on time, and within budget. He will serve as the primary contact for the
City.
Mr. Kawlewski currently has two deep trunk sanitary sewer projects under construction in the
cities of Monticello and Lonsdale. The Monticello project includes the installation of Hob as
manufactured pipe at depths ranging from 25 to 45 feet deep. The construction required the
installation underneath 1-94, BNSF railroad, and in easements acquired along rear lot lines of
precision machining industrial plants.
The trunk sewer in Lonsdale involved installation ofPVC pipe at depths of25 to 40 feet through
wetlands and fat clay soils. The extension of this sewer has been completed in segments through
three different development sites. As the City Engineer, Mr. Kawlewski has reviewed and
approved all design and managed the construction observation and pipeline construction on
behalf of the City.
Mr. Kawlewski is a professional engineer with over 12 years of experience in project
management of municipal engineering projects from concept development to construction and
operations. His responsibilities include feasibility studies, cost estimating, comprehensive
planning, construction plans and specifications, operation, and construction observation. His
general project types include new and reconstructed roadways, Municipal State Aid (MSA)
streets, storm water collection systems, sanitary sewers, and water distribution and analysis. He
recently completed the Trunk Sanitary Sewer Study for the Andover Rural Reserve Area.
Bret Weiss, P.E.
Principal-in-Charge/QA-QC/Policy Review
Bret will serve as the Principal-in-Charge for the project. As Principal-in-Charge, he is the WSB
contact for performance or contract related issues with the City of Shakopee. Bret will also be
responsible for the quality control/quality assurance elements ofthe project. While it is expected
that the other members of the WSB Project Team will satisfy all ofthe City's needs, he provides
the City the assurance that WSB will meet its commitments to the Citypf Shakopee. Bret will
further be responsible for reviewing Shakopee's policy for trunk sewer charges and lateral
assessments. Bret is completing a trunk fee study for another community at this time and has
extensive experience with assessment policies.

Bret is a registered Professional Engineer with over 18 years of diverse experience in many types
of municipal and general civil engineering projects and 14 ofthese years have involved a role
with the City of Shako pee. His wide range ofproject experience includes storm sewers, water
distribution systems, sanitary sewer systems, site grading, parking facilities, and municipal State-
aid systems. He is an experienced project manager responsible for the planning, coordination,
design, and construction administration of a wide variety of municipal proj ects. Mr. Weiss
excels at public involvement and in finding solutions to difficult project issues. Mr. Weiss has
also served as the City Engineer on a permanent to interim basis for four growing communities
and has interpreted policies for each ofthese communities.
Tom YoU, P.E.
Project Engineer
Mr. V oll has over ten years of experience in the surveying, design, drafting, construction
management, and inspection of residential, municipal, commercial and industrial sites including
four years with the City of Shakopee. His design experience includes roadways, sanitary sewers,
storm sewers, watermains, detention ponds, private development projects, well drilling,
wastewater treatment facility construction, and water tower construction. Mr. Voll's
responsibilities include plan design and drafting, grading plan design, construction inspection,
surveying, permit acquisition, public information meetings, project management, final contractor
payments, right-of way acquisition, construction and grading plan review and public
assessments.
Pierre Amyotte
CADD Design
Mr. Amyotte will serve as the lead project design technician. His role will include working with
the designers on the project design and drafting of the construction plans.
Mr. Amyotte is a CADD Technician in the Municipal Group. He has 21 years of experience in
Computer-Aided Drafting and Design (CADD). Mr. Amyotte is skilled in the use of AutoCad,
Land Development, Civil Survey, MicroStation, and Eagle Point. As a CADD Technician, Mr.
Amyotte provides detail design and data management services for infrastructure engineering
projects.
