A.~ CITY OF SHAKOPEE Memorandum CASELOG NO.: 05-105 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner I SUBJECT: Final Plat of Glacier Estates MEETING DATE: October 4, 2005 REVIEW PERIOD: August 26, 2005 - December 23, 2005 DISCUSSION Pavek Family Investments (College City Homes) has submitted an application for final plat approval of Glacier Estates, proposed for property north of Eagle Creek Blvd., west of County Road 18, and east of Hilldale Drive. The plat, as currently proposed, contemplates the construction of 49 single family homes on 16.49 acres, with right-of-way proposed for 5.82 acres, approximately one acre dedicated for park and an outlot of 12.62 acres that encompasses the wetland area. Joe Swentek, Project Engineer, submitted a memorandum that includes a number of conditions, provided this application is approved. That memo is attached for Council's review and the conditions have been incorporated into the draft resolution. Mark Themig, Parks, Recreation, and Facilities Manager, provided a memorandum recommending approval with conditions. That memo is attached for Council's review and the conditions have been incorporated into the draft resolution. He noted that consistent with the preliminary plat, the Parks and Recreation Advisory Board's recommendations have been incorporated into the final plat that provides a combination ofland, cash, and park dedication credit for developing the parks. He also noted that the City has worked with the applicant to determine the final trail alignments as required in the preliminary plat. At this time, it appears that making a trail connection to the Riverside Fields trail is possible by following the proposed alignment on the east side of the site. In addition, the applicant has shown a trail alignment from Portage Lane to connecHo the park. Finally, the City is requiring a trail easement between Lots 11 and 12, Block 2. Although the trail will probably not be constructed at this time, the easement will allow the city to install the trail in the future, should that be desired. The applicant, City, and Scott County Public Works have been working on agreements pertaining to access to CR 16, both with the main access and the secondary emergency access. Conditions that relate to these issues have been incorporated into the draft resolution. 1 Shakopee Public Utilities Commission (SPUC) provided comments that have been incorporated into the draft resolution. One specific condition is that an 18" trunk water main shall be installed within this project in the County Road .16 (CR 16) right-of-way/adjacent utilities easement, with SPUC paying oversizing per policy, from the existing water main located at the northwest comer ofCRI8/CRI6 westbound to the west edge of the plat (includes across the parcel identified by property identification number (PID) 27-9130620. A second connection to the existing system shall be made beyond the north end ofthe plat along CR 18. Tom Pitschneider, Fire Inspector, commented that the street name for Garden Well Court shall be changed and approved by the City, and that temporary street signs shall be installed. Jim Grampre, Building Official, commented that if approved, temporary street signage shall be posted prior to building permits approval. AL TERNATIVES 1. Approve Resolution No. 6312, a resolution approving the final plat of Glacier Estates, as presented. 2. ACTION REQUESTED Offer a motion to approve Resolution No. 6312, a resolution approving the final plat of Glacier Estates as presented, and move its adoption. 2 RESOLUTION NO. 6312 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF GLACIER ESTATES WHEREAS, Pavek Family Investments Corporation (College City Homes), applicant and property owner, have made application for final plat approval of Glacier Estates; and WHEREAS, the subject properties are legally described as: See attached legal, Attachment #1 WHEREAS, the Shakopee Planning Commission conducted public hearings on the preliminary plat on June 23,2005, July 21,2005 and August 4,2005; and WHEREAS, all required public notices regarding the public hearing were posted and sent; and WHEREAS, the Shakopee Planning Commission has recommended approval of the requested preliminary plat; and WHEREAS, the City Council approved the preliminary plat request at its meeting of August 16,2005. WHEREAS, the City Council reviewed the final plat request at its meeting of October 4, 2005. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: I. The following procedural actions must be completed prior to the recording of the Final Plat: A. Approval of title by the City Attorney. B. Execution of a Develqpers Agreement, which shall include provisions for security for public improvements within the Final Plat, as well as payment of engineering review fees, and any other fees as required by the City's adopted fee schedule. 1. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission and Scott County. 2. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. Installatic)l1 gf s,Wlitary ~eWrr ~pd storm sewer systems, and construction of streets in accordance with the requirements ofthe 3 Design Criteria and Standard Specifications of the City of Shakopee. 5. The developer shall be responsible for payment of Trunk Storm Water Charges, Trunk Storm Water Storage and Treatment Charges, and Trunk Sanitary Sewer Charges, as required by the most current City of Shakopee Fee Schedule. 6. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utility Commission approve the Final Construction Plans and Specifications. 7. The applicant shall obtain an NPDESpermit prior to any land disturbing activity. A copy of this permit shall be provided to the City. 8. Any work with the County right-of-way shall require a permit. 9. The applicant shall obtain the necessary Scott County permits/approvals (access, right-of-way, drainage, etc.). C. The street name for Garden Well Court shall be changed and approved by the City. Addresses shall be provided to the Shakopee Fire Inspector for review and approval. D. The developer shall provide connecting watermains consistent with SPUC's requirements. E. Provide electronic (Auto CAD) files ofthe Final Plat and all record drawings to the engineering department. F. The applicant shall obtain the appropriate Wetland Conservation Act (WCA) permits and approvals for all proposed wetland impacts prior to grading within these areas. G. The applicant shall obtain the appropriate U.S. Army Corps of Engineers permits and approvals for all proposed wetland impacts prior to grading within these areas. H. The applicant shall obtain the appropriate permits for all structures to be removed from the site and/or demolished. 1.' The applicant shall obtain a NPDES permit prior to any land disturbing activity. A copy of this permit shall be provided to the City. J. The applicant shall work with the City of Shakopee to provide one (1) trunk sanitary sewer extension to the southeast and one (1) trunk sanitary sewer extension to the South. K. The applicant shall work with the City of Shakopee to provide an acceptable design of a maintenance trail/access to the proposed storm water basin. L. The applicant shall obtain the necessary right-of-way and/or easements to perform all proposed work offsite. M. In the event a septic system and/or a well is encountered on the site, the applicant shall contact the Scott County Environmental Health Department for their requirements concerning the removal and/or capping ofthe septic system and/or well. N. Additional right-of-way, in the form of equidistant chamfers twenty-five (25) feet in dimension, shall be provided at the intersections with County Road 16 (Eagle Creek Boulevard). 4 O. Easements shall be shown on the Final Plat as approved by the City Engineer. They shall include, but not be limited to, the following: 1. Minimum drainage and utility easements for sanitary sewer and storm sewer in non-paved areas shall be provided at a one to one ratio, depth versus width, plus four (4) feet. The easements shall be centered along the utility alignment. 2. Provide a minimum of ten (10) feet of drainage and utility easement along the interior of all outlots. 3. Provide a minimum of twenty-eight (28) feet of drainage and utility easement, centered on the proposed storm sewer, between Lot 11 and Lot 12 of Block 2. P. Simultaneous to the recording of the Final Plat, a deed restriction shall be recorded on all property lines as designated by the City of Shakopee. Q. The applicant shall provide the required documentation and/or drawings that address, to the City's satisfaction, all comments noted in the September 28, 2005 letter from Todd Hubmer and Ted Witkowski, WSB & Associates, Inc. R. The applicant shall meet park dedication requirements by providing a total of .99 acres as an outlot shown on the final plat. S. The remaining park dedication requirements shall be met by providing a cash contribution in the amount of $112,349. The applicant shall provide security to the city in the full amount ofthe required cash contribution prior to recording the final plat. T. The wetland complex shall be provided to the city as an outlot and incorporated into the city's park and open space system. U. Trail easements shall be provided for trail segments on Lots 10 and 11, Block 4; Lots 17, 18, and 19, Block 2; and Lots 11 and 12, Block 2. V. The developer shall provide an easement and/or an agreement with the City and/or Scott County concerning the Portage Lane access and the temporary emergency access along the east property line of Lot 6, Block 3 to County Road 16. II. Following approval and recording of the Final Plat, the following conditions shall apply; A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s). B. Noise issues along the County roadways may arise as traffic levels increase in the area. The developer and/or their assigns shall be responsible for any required or desired noise mitigation measures. C. The developer shall implement the use of Best Management Practices for erosion control and stormwater management during construction. D. The applicant must meet the City's Woodland Management Ordinance requirements. E. The developer shall utilize the MPCA Protecting Water Quality in Urban Areas as a technical reference for erosion control. F. An 18" trunk water main shall be installed within this project in the County Road 16 (CR 16) right-of-way/adjacent utilities easement, with SPUC paying oversizing per policy, from the existing water main located at the 5 northwest comer ofCRI8/CR16 westbound to the west edge of the plat (includes across the parcel identified by property identification number (PID) 27-9130620. G. A second connection to the existing water main system shall be made beyond the north end ofthe plat along CR 18. H. The applicant shall provide an emergency service vehicle access to County Road 16, consistent with theShakopee Fire Inspector's requirements. I. Temporary street signs shall be posted prior to building permits approval. J. The developer shall install tree protection fence prior to mass.grading. No grading should occur within the drip line or Critical Root Zone of protected trees. K. The developer shall adhere to the Minnesota Local/StatefFederal Application Form for projects within the development area, dated June 30, 2005 and any following revisions to the application. This includes, but is not limited to, the management, maintenance, monitoring, and performance standards included in the permit narrative extended to 10 years. L. The developer shall work with City Staff to establish a buffer width and install buffer signage provided by the City. M. The developer shall provide a 25 foot buffer from the wetland delineation line. The grading to create the storm water management pond, install utilities, and create the trail would be exempt from this requirement. N. The proposed storm pond be seeded with a native wetland seed mixture and erosion control blanket be placed four feet either side of the normal water level and around outlets to prevent erosion and sediment deposits into the wetland mitigation sites and enhancement areas. O. The applicant shall work with staffto design and construct the park as part ofthe construction ofthe development. Construction costs shall be credited toward the applicant's cash contribution requirement. P. Sidewalks and trails shall be constructed as proposed in Blocks 2 and 4. Q. The applicant shall install park, open space, and trail boundary signage as determined to be needed by the city. The city shall provide the signage, and the applicant shall provide the posts and installation of the signage. R. The developer/builder shall provide placement of at least one overstory deciduous tree in the front yard of each lot. S. The developer/builder shall provide sod placement in the front yard of each lot and seed or sod in the side and rear yards, consistent with the City requirements. T. The developer/builder shall provide placement of 6" of topsoil on each lot. The soil composition should be similar to the MnDOT topsoil borrow requirements. U. The deve10per/builder shall provide rain sensors for any irrigation system. V. No landscaping, ponding, berming, or signage shall be permitted within the County right-of-way. W. Any change in drainage entering the County right-of-way requires detailed stormwater calculations to be submitted to the County Engineer for review and approval. 6 X. The applicant shall continue to work with the City and Scott County to determine a trail connection to the Riverside Fields trail, and design! develop the trail alignment. Y. The applicant shall provide a trail connection from the park area to Portage Lane, at a location approved by the city. Z. Connecting sidewalks should be provided throughout the development. AA. In the park area, the developer shall: 1. Fine grade the site, picking rocks and dirt clumps %" and greater in SIze. 2. Provide a finished grade that is approved by the city as suitable for park use. 3. Ensure a minimum of 6" of topsoil. 4. It is located northwest of the intersection between the West leg of County Road 16 (Eagle Creek Boulevard) and County Road 18. The engineering department has completed its review and offers the following comments at this time for the applicant and for the planning department: General Comments 1. City of Sltakopee, MN WSB Project No. 1281-85 We have reviewed the Storm Water Management Plan and Construction Plans for the Glacier Estates Development within the City of Shakopee. The documents provided by Kallio Engineering, LLC, for review included the following: 1. Storm Water Management and Calculations for Glacier Estates - dated May 9,2005, revised September. 14, 2005. . 2. Glacier Estates Construct~on Plans - dated August 24,2005. The Glacier Estates addition was previously reviewed on June 13, 2005.. Most of the preyious review comrtlents have been.addresseq. by this submittal. The comments and items not addressed in this submittal will be included as part of this review. Based on review of the documents. provided, we offer the following comments and observations for your consideration: Storm Water Calculations 1. The SCS curve numbers used in the hydrologic calculations were adjusted from Type "B" to Type "A" hydrologic soils. Our review of the soil types identified on the existing conditions drainage area map indicate that they are classified as ~Type "B" hydrologic soils in the Minnesota Hydrology Guide. The re-classifi.cation of these soils in the analysis results in a significant reduction of nmoff tributary to the site. Though site observations may indicate reduced flows, these observations have not been made with monitoring equipment or under frozen ground conditions. Therefore, it is requested that Type "B" hydrologic soils continue to be used in determining tributary flows. 2. The water quality treatment volume calculations indicate that 1.46 acre-feet of penn anent pool volume should be provided by the proposed treatment pond. The treatment pond does not provide the required deadpool volume to meet the NURP Criterion identified in the City's storm water management plan. 3. The proposed condition storm water modeling for the storm sewer crossing CSAH~16 from Pond.3 does not correspond to the proposed storm sewer system from FES~3 to . CBMH-12A in the construction plan. The storm water model input should be revised to correspond with the proposed construction plans. 4. The Pond 2 outlet structure description in the storm water model does not correspond to the proposed skimmer structure detail in the construction plans. The outlet structure in the storm water model should be revised to correspond with the proposed skimme~ structure on Sheet 8 of the construction plans. 5. The 60 minute time of concentration for SubcatchInent 3, and the 90 minute time at concentration for Sub catchment 6 do not appear reasonable based on the slopes within the drainage areas. The time of concentrations for these sub catchments should be . calculated using the lag curve number method and Type "B" soil curve numbers to determine the 1 00- year flow rates tributary to the CSAH -16 culverts. 6. The hydrologic curve number and time of concentration for Subcatcbment 5 should be revised to reflect Type "B" hydrologic soils. The 90-minute time of concentration should be changed to reflect the lag curve number methodology. Storm.Sewer Desi2n Calculations . 1. The tributary areas in the storm sewer design calculations do not correspond with the drainage area mapping. The following structures and mapping areas should be verified and corrected, CBMH-12A, CBMH-12, CBMH-14A, CBMH-14, CB.-16. 2. The drainage area tributary to CBlYIH-13 should be shown on the storm drainage area map. 3. The stann sewer pipe design should include the entire 10- year event flow from the sub catchments and not assume any bypass to the next structures. It appears that the total pipe flow calculations only include the intercepted flow at the inlets to the piping system. The pipe design should include the totallO-year event runoff to each inlet for verification with the full flow pipe capacity. 4. The runoff calculations for the subcatchments should include a column that accumulates the sum of the runoff coefficients and area product to verify that the actual runoff rates for the 10-year event are being calculated. The time of concentration totals within the runoff calculations do not correspond with the intensities for the total time of concentration. It is requested that the actual intensity column being utilized to calculate the total flow in the system be illustr-ated in the runoff calculations. The pipe velocities should be calculated based on the system slopes and full-flow discharge rates. The pipe velocities appear to use a percentage of the flow capacity to obtain the pipe velocities for the total system. The pipe velocity formula should be revised or an added calcula,tion to the design sheet should be provided. 6. The downstream 100-year storm sewer structure ID's in the pipe deslgn do not correspond to the construction plans. The structure identifications downstream of CBMH-2, CBMH-IO, CB-I7A, CB-I6, CB-19, CB-17B, CBMH-6A, and CB-7a should be verified. The pipe diameter from CB-3A to CHMH-3 should correspond with the construction plans. The co.nstruction plans indicate a IS-inch diameter pipe will be used and the design indicates that an 18-inch diameter pipe is proposed. Please verify and . correct. Construction Plan Review 1. The directional offset .from the road centerline ''RT -L T"should be identified in the storm sewer system profiles. The offset distance from centerline should also be indicated in the storm sewer profile data. 2. The station and offsets to stmctures located in rear yards and outside of the proposed right-of-ways should be illustrated in the profile data for the stonn sewer. Sheet 2 1. The storm sewer pipe diameter in the profile at station 18+05 at Portage Lane should be verified. It appears that the pipe diameter should be a 30-inch RCP based .on the design calculations. Sheet 3 1. The existing 24-inch CMF is proposed. to be extended south from County Road 16. The extension of this pipe should be illustrated in the profile view for the storm sewer. The inverts and pipe lengths should be shown in the profile data. 2. The watermain crossing in Garden Well Court of CBMH-12 to CBMH-l1 should be verified for vertical clearance with the storm sewer. It appears that the watermain will be within three feet of the storm sewer. .sheet 4 1. The storm sewer system design should include additional catch basins east ofCBMH-2 and CBMH-3 on Portage Lane to improve the capacity to the stOTIn sewer system at the site low point. Page 4 east will not interfere with the proposed driveway locations at Lot 12, Block 2 and Lot 4, Block 4. The storin sewer system profiles should be revised to incorporate the added structures into the plan. Sheet 5 1. The skimmer s.tructure detail in the profile does not correspond to Sheet 8 skimmer outlet detail. The pipe diameters, lengths, and slopes should be revised to correspond with the skimmer outlet detail and storm water m~delinput. 2. The storm sewer pipe diameter from CBM3A to CBMH-3 should be verified with the design calculations. Th~ installation of an additional catch basin inlet at the rear yard property boundary of Lots 3-4, Block 4 should be installed to improve the inlet capacity in the rear yards in the' event that clogging and debris will affect the inflow of storm water to the system. 3. The 48-inch pipe from FES-1 toMH-1 should have all the joints of the pipes tied due to the anticipated velocities of the storm water from CBMHM2 to MH-l. The stabilization of this system will reduce future maintenance and potential failure. The easements on Lot 11, Block 2 over the 48-inch RC pipe should be a minimum of 10 feet either side of the storm sewer alignment~ The easements on Lot 11 appear to require revision. 4. The pipe joints in the storm sewer system connecting to the skimmer structure should. also be tied. 5. The construction ofFES-3 to CB-12Ais proposed within the County Road 16 right-ofM way. This work should be permitted by the County. The proposed construction of the storm sewer system does not indicate whether the existing 60-inch RCP will be removed, abandoned, or the new pipe will be installed inside the existing 60-inch diameter pipe. The installation method whether it is jacked, open-cut, or installed inside the existing culvert should be defined in the plan. DISCUSSION Park Dedication Consistent with the preliminary plat, the Advisory Board's recommendations have been incorporated into the final plat that provides a combination of land, cash, and park dedication credit for developing the parks. The following is the park dedication requirements: Acreage: 49 lots X 3 persons per lot I 75 people/acre = 1.96 acres Cash: 49 lots X $4,632/lot = $226,968 The applicant is proposing to provide .99 acres of park land. The remaining dedication requirements shall be provided in cash: .99 acres provided/1.96 acres required = 50.5% of dedication met 49.5% of dedication remaining X $226,968 = $112,349 cash required Trails We have worked with the applicant to determine the final trail alignments as required in the preliminary plat. At this time, it appears that making a trail connection to the Riverside Fields trail is possible by following the proposed alignment on the east side of the site. In addition, the applicant ~as shown a trail alignment from Portage Lane to connect to the park. Finally, we are requiring a trail easement between Lots 11 and 12, Block 2. Although I do not believe that the trail will be constructed at this time, the easement will allow the city to install the trail in the future, should that be desired. SUMMARY OF PROPOSED RECOMMENDATION In order to ensure that you have conditions that reflect the most current park dedication status, the following conditions are provided for your consideration: Prior to Recording of the Final Plat a. The applicant shall meet park dedication requirements by providing a total of .99 acres as an outlot shown on the final plat. b. The remaining park dedication requirements shall be met by providing a cash contribution in the amount of $112,349. The wetland complex shall be provided to the city as an outlot and incorporated into the city's park and open space system. d.
