(3, CITY OF SHAKOPEE Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Text Amendment Regarding Off Premise Signage DATE: October 4,2005 CASELOG NO.: 05-097 INTRODUCTION In response to direction provided by the City Council, staffhas prepared a text amendment regarding off premise signage. As requested by the Council, the draft information was shared with Mr. SeverPeterson of Sever's Com Maze. Please note Mr. Peterson's comments that have been attached to the Planning Cominission report for the Council's reference. ALTERNATIVES 1. Approve Ordinance No. 738, approving the text amendment as presented. 2. Approve Ordinance No. 738, approving the text amendment with revisions. 3. Do not approve the proposed amendment. 4. Table the matter for additional information. PLANNING COMMISSION RECOMMENDATION The Planning Commission reviewed this item at its September 8,2005 meeting. At this meeting, the Commission recommended approval of the proposed amendment. A copy of the staff report from the September 8th Commission meeting is attached for the Council's reference. F. Off Premise Shma2:e. Off-premise signs shall be allowed for the purpose of advertising temporary seasonal community events open to the general public. Off-premise signs shall comply with the following: 1. shall obtain a temporary sign permit: 2. shall be limited to total display time of 30 days per calendar year: 3. shall be located along Highway 169 frontage: 4. shall provide written consent from the property owner: 5. shall be limited to 150 square feet in size: 6. shall be a one sided sign: 7. shall not exceed 20 feet in height: 8. shall be located within one half mile of Highway 169 interchanges: 9. shall be limited to 1 sign per event and location: 10. shall be setback 10 feet from the property line. Section 2 - - Effective Date. This ordinance becomes effective from and after its passage and publication. Staff prepared a draft list of regulations for such off premise signs. These proposed regulations have been shared with Council members as a part of the weekly Activity Report. ill addition, the draft regulations were shared with Mr. Sever Peterson. The following is language that staffhas prepared in response to Council's direction: Off~premise signs shall be allowed for the purpose of advertising temporary seasonal community events open to the general public. Off-premise signs shall comply with the following: 1. shall obtain a temporary sign permit; 2. shall be limited to total display time of 30 days per calendar year; 3. shall be located along Highway 169 frontage; 4. shall provide written consent from the property owner; 5. shall be limited to 150 square feet in size; 6. shall be a one sided sign; 7. shall not exceed 20 feet in height; 8. shall be limited to interchange locations on Highway 169 and no two off-premise signs shall be located closer than 500 feet to each other; 9. shall be setback 10 feet from the property line. Please find attached as Exhibit B a copy of the correspondence from Sever Peterson sharing his reaction to the proposed regulations. Specifically, Mr. Peterson is asking the City to consider: 1. Allowing signage up to 200 square. feet in size; 2. Allowing signs to be located up to % to Vi mile before interchange locations; and 3. Elimination of setback requirements and in its place require that the sign not block other signage. FINDINGS City Code Sec. 11.83, Subd. 3 provides the criteria required for the granting of a Zoning Ordinance Amendment. Only one ofthe criteria needs to exist for an amendment to be warranted. These criteria are listed below with proposed findings for the Comn:rission's consideration. Criteria #1 That the original Zoning Ordinance is in error; Finding #1 The original zoning ordinance is not in error. Criteria #2 That significant changes in community goals and policies have taken place; Finding #2 Significant changes in community goals and policies have taken place in that the City Council wishes to provide additional opportunities for signage for community events and major recreation venues that draw attendees from outside the City limits.. Criteria #3 That significant changes in City-wide or neighborhood development patterns have occurred; or Finding #3 Significant changes in City-wide or neighborhood development patterns have not occurred. Criteria #4 That the comprehensive plan requires a different provision. Finding #4 The Comprehensive Plan does not require a different provision. ALTERNATIVES 1. Recommend to the City Council approval of the text amendment as presented. 2. Recommend to the City Council approval ofthe text amendment with revisions. 3. Recommend to the City Council the denial of the text amendment. 4. Table the matter for additional information. STAFF RECOMMENDATION Staff recommends alternative no. 1 or 2. Mark McNeill, City Administrator FROM: Julie Klima, Planner II RE: Off-Premise Signage DATE: November 18, 2004 Previously, the City Council has directed staff to research the issue of proposing regulations for off-premise signage. As you may recall, the issue arose from discussions with Sever Peterson regarding signage for his seasonal business. Staff has researched other cities zoning ordinances and has been unable to find regulations and/or a situation that closely mirrors those discussed in Shakopee. As a result, staffhas prepared, as a starting point, the following language relative to off- premise signage. Off-premise signs shall be allowed for the purpose of advertising temporary seasonal community events open to the general public. This information is intended to serve as a starting point for conversation of the issue. City Council had also directed that staffbe in contact with Mr. Peterson regarding any proposals. It is the intent of staff to obtain any feedback from City Council members prior to contacting Mr. Peterson.
