This situation is similar to Sun Path Elementary where it was determined to be advantageous for fire protection to have the school in the higher-pressure zone. . A water pressure booster station is required to provide service in this area of the 1 st high elevation service district. The area is isolated from the majority ofthe 1 st high elevation service district further to the west due to the large land holdings of the Mdewakanton Community. An option to the boosterstation that would be worth exploring involves seeking permission for a transmission water main across the Mdewakanton property to connect this area to the balance of the 1 st high elevation service district. The decision by the Commission on the best alternative to serve this area may be driven by the development timeline. Depending on the timetable, the proposed school and surrounding development may accelerate the installation of the booster station. . Planned trunk water mains in the vicinity include: an I8-inch water main along CR 16 east and west of CR 21 and a 12-inch water main extended south of CR 16 in the vicinity of CR 21. Depending on the timetable, the proposed school and surrounding development may accelerate the installation of these trunk water mams. . Electric service would initially be from the Dean Lake substation, with ultimate service from the proposed Pike Lake substation. DISCUSSION: The Board has been searching for elementary school sites, and as a result of that search has had discussions with two developers(D.R. Horton/Ryan Contracting and Tollefson Development) about three potential sites. These sites are as follows; . West of CR 15 and on the north side of CR 78; . North ofCR 78 and on the ~y side ofCR 15; . South of CR 16, east of CR 83, along the proposed alignment of future CR 21. Each of these sites poses some challenges. A partial list of these is outlined below. . West of CR 15 and on the north side of CR 78; . Final resolution ofthe question of whether the site, and surrounding proposed residential development, can be served by existing sanitary sewer capacity in the Shakopee-Chaska Interceptor. . Horton, Inc. of Minnesota (collectively, the "Developer") as the developer of the Bluffs at Marystown, located at the southwest quadrant of the intersection ofTH 169 and MarystownRoad (the "Project"). The purpose of this letter is to outline the terms of the Developer contribution of 13:1: acres of the Project for an elementary school site, together with approximately 5 acres for acity/school neighborhood park between Marystown Road and Old Brickyard Road on CSAH 78-130th Street. We believe the terms are consistent with previous conversations and meetings between the Developer, its representatives and the representatives of Shakopee Public Utilities Commission ("SPUC"), the City of Shakopee (the "City"), and Shakopee Public Schools-ISD 720 (the "School District") 1. . Contribution of Land to School District. Not later than April 1, 2006 (the "Delivery Date"), and subject to the terms and conditions provided herein, the Developer will contribute to the School District marketable title to a 13:1: acre parcel depicted on the attached Exhibit A for construction of an elementary school (the "Elementary School"). 2. Sanitary Sewer Plan Amendment. The Developer shall, at its expense, and in cooperation with the City and the School District, secure a. comprehensive plan amendment to be approved by the City and the Metropolitan Council authorizing and facilitating the extension of sanitary sewer to the Eleme~tary School site. 3. Annexation. Land Use Plan Amendment. Zoning and Utility. The Developer and the School District understand the Elementary School site is to be developed asa part of the larger mixed-density, multi-phased, residential development known as the "Bluffs at Marystown" consisting of approximately 320 acres and 650 dwelling units, parks, trails, preserved open spaces and neighborhood commercial.. The Developer, at its expense and in cooperation with the School District, will apply for and secure approval of the Orderly Annexation Agreement, land use amendments to the City Comprehensive Plan and zoning approvals for concept approval of the Bluffs at Marystown by the Delivery Date. The Developer shall provide for the phasing and construction of utilities within the Project so as to provide sanitary sewer and water service to the Elementary School site not later than December 1, 2006. <~ ~ 4. Credit for Neighborhood Park. Based upon earlier discussions with the City, the Developer is anticipating dedication credit for the City/School 5-acre neighborhood park to be dedicated to the City and adjacent to the Elementary School site. 5. Stormwater Storage. Facility. The School District understands that it will be responsible. for the costs to improve the stormwater storage facility to be constructed north of the Elementary School site. The School District will be responsible for its portion of costs based. upon its share of drainage contribution to the total sizing of the stormwater facility. 6. Site Grading, Street and Utility Costs. The School District shall, in its sole discretion be responsible for its site grading, and its share of street and utility costs to serve the Elementary School site. These costs may be levied as special assessments by the City. The School District understands it may be responsible for oversizing costs of sanitary sewer and water ifoversizing is required to serve the Elementary School site.
