SUBJECT: Request of E.H. Renner & Sons, Inc. for Suspension of Construction
Hours for Test Pumping ofSPUC Wells No. 20 and No. 21
DATE: September 12, 2005
INTRODUCTION:
By letter dated September 9, 2005, E.H. Renner & Sons, Inc., the contractor for Shakopee
Public Utilities Well No. 20 and No. 21 has requested that City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrietions on Certain Operations,
be suspended for certain work hours.
BACKGROUND:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
RH. Renner & Sons, Inc. is requesting a suspension on the hours as follows:
For two days per well, up to Sept. 29 with no test pumping beyond Friday at 10:00 pm
and no pumping on Saturday or Sunday nights, the request is for 24 hour test pumping as
required.
RH. Renner & Sons is requesting these hours due to a 24 hour test pump of the well as
directed by Shakopee Public Utilities and is asking for the a suspension again as test
pumping could not be done due to the heavy rains over the Labor day weekend.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at
the discretion of the City Engineer.
If Council approves the suspension, a public. notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and
direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period
of time as determined appropriate by the City Council, and direct staff to publish
notice ofthe suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations,D.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer a motion approving a suspension of City Code See: 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

I Dear Mr. Loney,
E.H. RENNER & SONS, JNC. has revised its pumping schedule dl.~e to delays in d.ischarging the
water from the two wells #20 and #21 into the area storm sewer.
We have scheduled test pumping these wells starting on Monday the12lJl of September, 2005.
We will double shift the step test on Well No 20. We will worktwo shifts (7am to lOpm) for
the step tests, We will need a variance for the EXTENDED duration test that will follow. The
around the clock pump test will only take two days to complete for each well. The dates for
well No 20 are expected to be September 15th to the 16th. The dates for well No 21 are
expected to be September 22nd and 2fd. We are requesting that this be placed on City Council
I agenda for approval.
We request a variance to pump each w~n around the clock (up to 63hrs) as necessary to
obta'jn hydrogeologic data to dctennine final design of the pump for each well.
Enclosed is our tentative schedule for your review. We will not be
pwnping any of these wells on Friday (past 10pm), Saturday, or Sunday nightS. Variance to
expjre on the 29th of September, 2005. Thank you for your prompt attention.
