Cox, City Cler~ RE: SettingDate for Tobacco Violation Hearing DATE: August 31, 2005 INTRODUCTION: City Council is asked to set a date to review the actions of certain tobacco licensees. BACKGROUND: Any licensee who furnishes, sells or attempts to sell tobacco, tobacco products or tobacco related devices to a minor or whose employee furnishes, sells or attempts to sell tobacco, tobacco products or tobacco related devices to a minor shall be charged an administrative fine and shall also have his or her license suspended as outlined in the City Code. Staff is ready to proceed with the setting of a hearing date to consider the tobacco violations that occurred during the compliance check on July 10,2005. This is the first violation for Roseen & Roseen, Inc. dba MGM Liquor and for Speedway Superamerica LLC dba Superamerica #4546, and it is the second violation for Hennen's Shell, within a three-year period. Under the current ordinance, adopted by City Council on July 2, 2002, the penalties for a first or second incident shall be imposed and administered by the City Administrator upon an admission by the licensee that the licensee furnished or sold tobacco to a minor. Any licensee with a first or second violation within a three-year period who admits to the violation and does not ask for a hearing will not need to appear before City CounciL Notices of the hearing and Admission to Violation forms will be mailed after Council sets the date for the hearing. ACTION REOUESTED: Set a hearing for Tuesday, October 4,2005, at 7:00 p.m., or thereafter, to review the actions of the tobacco licensees: Roseen & Roseen, Inc. dba MGM Liquor, 471 South Marschall Road Speedway Superamerica LLC dba Superamerica #4546, 1298 East Vierling Drive Hennen's Shell, 807 East 1 st Avenue i:licenses\tobaccoviolationmemo
