SUBJECT: Conveyance of Tax Forfeiture, Parcel No. 27-912045-4 to the
City of Shakopee for Public Use

INTRODUCTION:
Attached is Resolution No. 6293, a resolution approving the application for the
conveyance of Parcel No. 27-912045-4 in the City of Shakopee and Scott County for
public use by the City.
BACKGROUND:
On July 5, 2005, the City was notified of potential sale of forfeited lands in the City of
(Shakopee and that the City had 60 days to respond to this possible sale of forfeiture land.
Upon review of Parcel No. 27-912045-4, the City does have a need for public use as this
parcel is within alley right-of-way and City street right-of-way for Scott Street and
Atwood Street.
Staff has been working with Bev Wagner of Scott County and attached is a fax letter
from her explaining the items that the City of Shakopee needs to provide in order to
obtain this tax forfeiture parcel. The City will need to adopt a resolution and have a
certified copy sent to Ms. Wagner, along with a completed application (PT Form 962)
and a check for $237.65 to cover costs of the transaction of tax forfeiture land.
As mentioned previously, the City of Shakopee does have a need for public use of this
parcel. It is staffs recommendation to adopt Resolution No. 6293 for the conveyance of
this tax forfeiture parcel to the City of Shakopee for public use.
ALTERNATIVES:
1. Adopt Resolution No. 6293, a resolution approving the application for the City of
Shakopee for the conveyance of tax forfeiture Parcel No. 27-912045-4 for
authorized public use.
2. Do not adopt Resolution No. 6293.
3. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1, as Parcel No. 27-912045-4 is a parcel which
contains street and alley right-of-way for Scott Street and Atwood Street, south of 10th
Avenue.
ACTION REQUESTED:
Offer Resolution No. 6293, A Resolution Approving the Application for the City of
Shakopee for the Conveyance of Tax Forfeiture Parcel No. 27-912045-4 for Public Use
and move its adoption. &~

WHEREAS, the City of Shakopee was notified on July 5, 2005, by Scott County
oftheirpotential sale ofa forfeiture Parcel No. 27-912045-4; and
WHEREAS, upon review of Parcel No. 27-912045-4, this parcel is located
within public alleys and public streets, being Scott Street and Atwood Street, south of
10th A venue; and
WHEREAS, these alleys and public streets do serve a public purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE: that Parcel No. 27,.912045-4 has public use by the City
of Shakopee and the City Council approves the application by the City of Shakopee for
conveyance of tax forfeiture Parcel No. 27-912045-4, and authorizes the expenditure of
$237.65 to obtain tbis parcel for public use.

Dear Mr. McNeill:
Enclosed is a classification listing of non-conserv~tion land located in your city. The
parcel(s) described in the listing forfeited to the State of Minnesota due to non-payment
of property taxes. As required under Minn. Stat. 282~01, we request that you approve
the parcel(s) for public sale or sale to adjacent owners or request a conveyance to. your
city for public use. .
We require a certified copy of the City Council resolution authorizing any action taken.
If you request a parcel be conveyed to your city, you must also complete.the form
"Application by a Governmental Subdivision for Conveyance of Tax-Forfeited Land" and
mail it to my attention in this office.
Special assessments that were levied before the forfeiture do not need to be certified to
this office. They were cancelled at forfeiture and will be paid from the sale price. ,
Special assessments that are levied after the forfeiture should be certified to this office.
They will be added to the appraised value and paid from the sale pnce.
Please be advised that if the City Council fails to respond within sixty (60) days of the
date of this letter, the sale will be deemed to be approved.

Dear Bev:
I'm writing in response to your letter of July 5th concerning the potential sale of tax
forfeited lands.
The City's engineering department is reviewing this, but it appears that the City of
Shakopeehas an interest in acquiring all or part of this. We will be sending it to the City
Council, but probably not until September 6th. Could you please defer action on
disposing of this until after we have an opportunity to take official action by the Council?
