CSAH 21, Pike Lake Road and Future Fire Station

INTRODUCTION:
Attached is a proposal from WSB & Associates, Inc. for mitigating wetland impacts
associated with CSAH 21, Pike Lake Road and the future Fire Station in the area of ~
Southbridge Parkway and CSAH 21. Staff is bringing this proposal to Council as the
City is responsible for mitigating wetlands associated the new Pike Lake Road
connection and future Fire Station, and is working with Scott County staff for mitigating
wetlands for future CSAH 21.
BACKGROUND:
The City previously entered into an agreement with Tollefson Development, Inc. for the
selling of property known as the Shutrop parcel for future development, and also for the
construction of Pike Lake Road, from CSAH 16 to Southbridge Parkway. In this
agreement, the City is responsible for wetland mitigation of wetland impacts with the
Pike Lake Road construction. The City also has considered constructing a satellite Fire
Station at the intersection of Pike Lake Road and CSAH 21. These wetland impacts
would also be included in the wetland mitigation proposal.
Staffhas met with Scott County staff on mitigating wetlands in this area for the proposed
CSAH 21 and has also met with the Technical Evaluation Panel (TEP) for wetland
mitigation in the City of Shakopee. The concept that staff has proposed with the TEP is
for the City and County to combine their wetland impact and mitigate those impacts in an
area in Scott County and preferably in the Prior Lake - Spring Lake Watershed District.
The basic idea is to have a large wetland mitigation complex in an area that can be
restored to a wetland in the area south of Prior Lake and Shakopee. The cost savings to
the City and County for purchase of land in these areas to restore is significantly lower
than land in the Cities of Prior Lake or Shakopee.
Attached is a map showing the proposed CSAH 21 alignment, as well as Pike Lake Road
and the future Fire Station and the wetland area that would be impacted. Staff has
contacted the Scott County Engineer, Mitch Rasmussen, and attached is an e-mail from
the County concurring with the proposed work and fee. The County will agree to
participate in the cost proportionate to the acreage mitigated for each agency. In
reviewing the wetland impacts of these three projects, the County would have
approximately eight acres of impact, while the City would have 2.5 acres. This pro-
ration would be that the County would pay 76% of the proposed wetland impact proposal
from WSB & Associates and the City would pay 24%. The total cost of this proposal is
estimated to be $15,923.00, with the City paying $3,822.00 and Scott County paying the
remaining balance of $12,101.00. The cost of this work is proposed to come out of the
Capital hnprovement Fund, as it is associated with construction of future roadways in
Shakopee.
Staff is requesting to proceed with this wetland impact approach, even though the
preliminary plat for Shutrop North has not come to Council but to proceed in order to
review potential mitigation areas, during the growing season of 2005. If a site can be
selected and acquisition can be obtained for constructing a wetland replacement area,
construction plans would then be prepared for wetland mitigation. Staff believes this is a
good cooperative effort between the City and the County in order to mitigate wetland
impacts in a cost effective method.
ALTERNATIVES:
1. Authorize the appropriate City officials to execute an extension agreement with
WSB & Associates, Inc. at a cost not-to-exceed $15,923.00 for the wetland
impact for CSAH 21, Pike Lake Road and the future Fire Station, with the City's
payment of this proposal to be paid out of the Capital hnprovement Fund with
reimbursement from Scott County for their share.
2. Do not approve the extension agreement at this time, but wait until the Shutrop
North plat has been approved.
3. Table for additional information.
RECOMMENDATION:
Staff would recommend Alternative No.1, to proceed with the wetland mitigation for the
wetland impacts associated with CSAH 21, Pike Lake Road and the future Fire Station
site in order to have the wetlands mitigated in 2006.
ACTION REQUESTED:
Authorize the appropriate City officials to execute an extension agreement with WSB &
Associates, Inc. at a cost not-to-exceed $15,923.00 for the wetland impact for CSAH 21,
Pike Lake Road and the future Fire Station, with the City's payment ofthis proposal to be
paid out of the Capital Improvement Fund with reimbursement from Scott County for

As requested, we have reviewed the proposed wetland impacts associated with the CSAH 21,
Pike Lake Road, and Fire Station projects. The CSAH 21 project is located between CSAH 18
and CSAH 16. The Pike Lake Road project is located between CSAH 16 and Southbridge
Parkway. The Fire Station project is located at the intersection of new CSAH 21 and new Pike
Lake Road. The following wetland impacts are anticipated by these projects:
. CSAH 21: 7.5-8.0 acres
. Pike Lake Road: 2.3 acres
. Fire Station: 0.1-0.2 acres
Based on this review, we have developed the following approach to address the regulatory issues
associated with wetlands and environmental concerns associated with these projects.
Task 1: Collect Background Information
Cost Estimate: $510
This task includes obtaining background information about the area. This would include
reviewing the concept plans for the projects, reviewing the National Wetland Inventory,
DNR Public Waters Map, Natural Heritage Database, soils survey, SHPO data,
information from the MPCA, and the EIS that is being completed for the project. It is our
understanding that the wetlands have previously been delineated. This information will
also be reviewed. This information will be used to guide the regulatory review process.
This task does not include any additional wetland delineation.

Task 2: Hold Agency Stakeholder Meetings
Cost Estimate: $1,773
This task will include three meetings with the agency stakeholders. These agencies
include the DNR, US Corps of Engineers, the County, the Board of Water and Soil
Resources, Soil and Water Conservation District, Prior Lake-Spring Lake Watershed
District, and Lower Minnesota River Watershed Management Organization. A kick off
meeting will beheld to review the delineation and discuss the concept plans. Additional
meetings will be held to update the agencies, receive feedback, and obtain buy-in. This is
anticipated to make the permitting process go more smoothly.
Task 3: Identify Possible Wetland Mitiga~ion Areas
Cost Estimate: $1,200
Potential wetland mitigation areas will be identified. This will include identifying areas
within the corridor, within City or County land, and potential wetland banks by working
with the Soil and Water Conservation District. These options will be evaluated for their
feasibility and a recommendation developed on the most effective and feasible mitigation
site. This information will be reviewed with the agency stakeholders.
Task 4: Complete Preliminary Design of Mitigation Area
Cost Estimate: $10,200
This task will involve developing preliminary design of the mitigation areas. It is
anticipated that survey will be obtained by WSB for the chosen mitigation area. Forty
hours of survey time has been included in this estimate. Preliminary plans will be drafted
for review with City Staff and agencies. The mitigation will be designed in conformance
with the Wetland Conservation Act and US Corps of Engineers requirements. The level
of detail ofthe preliminary design will be to the level necessary to obtain permits for the
work.
Task 5: Develop and Submit Wetland Impact Permit Applications
Cost Estimate: $2,240
This task included developing a wetland replacement plan and application for the Pike
Lake Trail, Fire Station, and Dean's Lake Outlet (if needed). The application will also
include enough mitigation for the CSAH 21 project; however, it is our understanding that
the County will be obtaining a permit for the CSAH 21 project separately. This permit
application will be reviewed at an agency meeting.
The cost estimate for this work is $15,923. This scope does not include the development of
construction plans. A scope and cost estimate to complete the construction plans and wetland
monitoring can be provided once the mitigation site and size is determined.
It is recommended that if the City wishes to complete this work, authorization be provided by the
end of the July. This will allow WSB to complete Task 4 by the. end of October, thereby
reviewing the wetland mitigation plans with the agencies during the growing season. It is
anticipated that a permit application could be submitted by early November 2005. If you have
