SUBJECT: Approval of a Registered Land Survey (RLS) - 746 6th Avenue West

INTRODUCTION
Aaron Sanders has submitted a request for an RLS for property that is located south of 6th
Avenue West and east of St. Mark's Cemetery Road (Exhibit A).
BACKGROUND
The property in question is zoned R-1 C, Old Shakopee Residential Zone, which requires 100
foot deep lots, 50 foot lot widths (for single family residences, 70 feet for two family
residences) and 50% maximum impervious surface percentage. The purpose of the request is
to reconfigure the existing lot into two (2) lots in order to allow for the sale and/or
construction of a new residential lot /residence (Exhibit B). The proposed lots would exceed
the minimum lot widths and minimum lot square footage, and any proposed structure( s) on
Tract B or improvements to the Tract A property shall comply with all applicable design and
performance standards (including complying with minimum lot setbacks and the maximum
allowed lot coverage) as stipulated in the City Code.
Initially, the applicant worked with staff on a minor subdivision application, which was
approved by the City. However, the proposed minor subdivision did not comply with Scott
County's requirements, which stipulated that a Registered Land Survey is required because it
creates a split. At that time, language found in the City Code was written such that an RLS
was not a viable option in this case. To address this situation, City staff prepared a text
amendment modifying the language concerning Registered Land Surveys, and the City
Council adopted Ordinance No. 728 on April 5, 2005, which allowed for this applicant to
proceed with an RLS.
Shakopee Public Utilities (SPU) has commented that the existing single-family house has
municipal water service and an overhead electric service (Exhibit C). The overhead electric
service to proposed Tract A crossed proposed Tract B. Relocation would be necessary if any
structure were to be built on Tract B and the cost would be the property owner's
responsibility. Any new water and electric service desired to TractB would be at SPUC
standard terms and conditions.
\ City Engineering has provided <;pmments (Exhibit P), noting that: 1) A proposed access to
Tract B is not shown; 2) One sanitary sewer service and one water service is provided to the
existing lot; 3) Currently, no sanitary sewer exists within Saint Mark's Cemetery Road or the
alley to serve Tract B; and 4) The sanitary sewer service and the water service for Tract B
may be required to be through Tract A. Conditions as noted in their memorandum have been
incorporated into the draft resolution.
Time Warner Cable commented that any request for service to Tract A will have to cross
Tract B from the alley.
ALTERNATIVES
1. Approve the requested Registered Land Survey, Resolution No. 6292, as proposed.
2. Approve the requested Registered Land Survey, Resolution No. 6292, subject to revised
conditions.
3. Do not approve the Registered Land Survey.
4. Table action on this item and request additional information from the applicant and/or staff.
ACTION REQUESTED
Offer Resolution No. 6292, a Resolution approving the Registered Land Survey, and move its
approval.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING THE
REGISTERED LAND SURVEY FOR PROPERTY LOCATED AT 746 6TH AVENUE
WEST TO RECONFIGURE THE EXISTING LOT INTO TWO (2) LOTS
WHEREAS, Aaron Sanders, applicant and property owner, has submitted a request
for approval of a Registered land Survey for property that is located at 746 6th Avenue West;
and
WHEREAS, the property upon which the request is being made is legally described
as:
All that part of Block 89 and Clay Street in the City of Shako pee, described asfollows: Starting
at the Northwest comer of Block 88 and running thence Southerly along the West line ofsaid
Block 88 a distance of 142.0feet; thence Westerly and parallel to Sixth Street about 128.66feet
to the East line of the St. Mark's Cemetery Road; thence Northeasterly along the East line of
said cemetery road about 144.15 feet to the South line of Sixth Street; thence Easterly along the
South line of Sixth Street 104.0 feet to the point of beginning, Scott County, Minnesota; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, as follows:
That the Registered Land Survey submitted by Aaron Sanders is hereby approved, subject to the
following conditions:
1. Drainage and utility easements shall be dedicated on Tract A and on Tract B as per the
requirements set forth by the City Code.
2. Each parcel shall require its own sanitary sewer service.
3. The proposed sanitary sewer service and water service shall not be aligned within
dedicated drainage and utility easements.
4. Future sanitary sewer service shall be approved by the City of Shakopee prior to
installation.
5. Future water service shall be approved by Shakopee Public Utilities staff prior to
installation.
6. A private easement shall be granted for ap.y proposed sanitary sewer service and/or
water service for Tract B through Tract A.
7. Additional street access to either parcel shall be approved by the City of Shakopee
prior to installation.
8. A right-of-way permit shall be required for all work within the City of Shakopee's
drainage and utility easements and right-of-way. Please contact the engineering
department for details.
9. Any proposed structure(s) on either parcel shall comply with all applicable design and
performance standards as stipulated in the City Code.
10. Provide electronic (Auto CAD) files of the RLS to the City Engineering Department.
11. ,The City of Shakopee shall retain all existing drainage and utility easements.
12. Any request for cable service to Tract A will have to cross Tract B from the alley.
13. The overhead electric service to proposed Tract A crosses proposed Tract B.
Relocation would be necessary if any structure were to be built on Tract B and the cost
would be the property owner's responsibility.
14. Any new. water and electric service desired to Tract B shall be provided in compliance
with Shakopee Public Utilities standard terms and conditions.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized
and directed to approve and accept said Registered Land Survey.

COMMENTS:
Municipal water selVice is available subject to our standard terms and conditions. These
include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk
Water Charge, and paying the Water Connection Charge,
Underground electric service is available subject to our standard temlS and conditions.
These include, but are not limited to: entering into an Underground Distribution
Agreement, granting any necessary easements, and paying the associated fees.
Street Lighting installation is available subject to our standard tenns and conditions.
These are contained in the current City of Shakopee Street Lighting Policy. Applicant
must pay the associated fees.
Applicant should contact Shakopee Public Utilities directly for specific requirements
relating to their project.
Note: Existing single-family house has municipal water service and an overhead
electric service. The overhead electric service to proposed parcel A crosses
proposed parcel B. Relocation would be necessary if any structure were to
be built on parcel B and the cost would be the property owner's
responsibility. Any new water and electric service desired to parcel B would
be at SPUC standard terms and conditions.

The application indicates a request for approval of a Registered Land Survey (RLS) for the
property at the above referenced address.
After reviewing the application, the following items were noted:
1. A proposed access to Parcel B is not shown.
2. One sanitary sewer service and one water service is provided to the existing lot.
3. Currently, no sanitary sewer exists within Saint Mark's Road or the alley to serve Parcel
B.
4. The sanitary sewer service and the water service for Parcel B may be required to be
through Parcel A.
Recommendation
If the City wishes to approve the RLS as submitted, the engineering department offers the
following comments:
