SUBJECT: Request of RH. Renner & Sons, Inc.

INTRODUCTION:
By letter dated August 16, 2005, E.H. Renner & Sons, Inc., the contractor for Shakopee
Public Utilities Well No. 20 and No. 21 has requested that City Code Sec. 10.60, Noise
Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be
suspended for certain work hours.
BACKGROUND:
The above named section of the City Code restricts the hours of operation from 7 :00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
RH. Renner & Sons, Inc. is requesting a suspension on the hours as follows:
Wednesday, Sept. ih to For 24-hour test pump of
Friday, Sept. 9th each well and for test pump
of both wells
RH. Renner & Sons is requesting these hours due to a 24 hour test pump of the well as
directed by Shakopee Public Utilities.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News.
AL TERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and
direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period
of time as determined appropriate by the City Council, and direct staff to publish
notice of the suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
, Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as

SUBJECT: SHAKOPEE WELL NO 20 & NO 21
RE: VARIANCE REQUEST - For 24 hour test pumping
Dear Mr. Loney,
RH. RENNER & SONS, INC. will so be completing the development of wells #20 and #21.
We expect to begin test pumping these wells starting on Monday the 29th of August, 2005.
We do not have any homes in the near vicinity that could be impacted by the noise and the test
pump engine {Detroit V871) has two oversized mufflers that should keep the noise to a
minimum. We will work extended hours (7am. to 7pm) for the step tests and the 24 hour test
will follow. The 24-hour pump test will only take one day to complete for each well and one
day together 3-days total. The dates are expected to be September 7th to the 9th. We are
requesting that this be placed on City Council agenda for approval,
We have a tight completion schedule of the 15th of September, 2005 and we are requesting a
variance or council approval for the working hours to perform the around the clock testing.
