SUBJECT: Request of Walmart Regarding Hourly Restrictions on
Construction Activities

INTRODUCTION:
By letter dated August 19,2005, the contractor for Walmart has requested that City Code
Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on
Certain Operations, D, be suspended for work hours on September 6th thru September
10th, 2005.
DISCUSSION:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
Weis Builders, Inc. is requesting a suspension on the hours as follows:
Tuesday thru Saturday
4:00 A.M. to 7:00 A.M. (September 6, 2005 thru September 10, 2005)

The earlier starting time is to expedite work in order to work longer hours to allow
contractors to work earlier to complete the parking lot construction while minimizing
impacts to the public shopping at Walmart and to meet the schedule for this project.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked
at the discretion of the City Engineer.
3. Blasting activities, if any, must be done from 8:00 A.M. to 5:00 P.M.
4. Work before 7:00 A.M., September 6th to September 10th must be in the east
parking lot and in front of the Walmart building.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News. Staff
believes by allowing this suspension of work hours, the projects can be done sooner than
the length of construction description and inconvenience is minimized.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by
Weis Builders, and direct staff to publish notice of the suspension terms with the
conditions as recommended by staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, from 4:00 A.M. to
7:00 A.M. on September 6th thru September 10t\ 2005 or for some other period of
time as determined appropriate by the City Council, and direct staff to publish notice
of the suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No.2.
ACTION REQUESTED:
Offer a motion approving suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by
Weis Builders, from 4:00 A.M. to 7:00 A.M. on September 6th thru September lOt\ 2005,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

This revised letter serves as OUT request to work off peak hours removing
and reinstaJling blacktop,in from of the Sha..\opee Walmart,We would start
the evening of September 5th,and be done the evening of September the
lOth.The purpose of working off hours are as follows:
a,. . Safety, with 25 dump trocks coming and going, together with 2 pavers,
and 2 grinders,the potential for a car,or person to walk into an area
being repaved is very great.As of this Jetter, we have had no accidents.
B Fire Janes, We are paving directly in front of the store,in the fire lanes,
These fire lanes are not only for fire trucks,but rescue,
We do not want to shut these lanes down any longer than necessary
C Store traffic. after 10;30 11 ;OOam its impossible to get any work done
The lot by that time is almost full..Customers,and deliveries are non
stop.
This letter serves as our request for deviation from City regulations on noise,

Dear Sir.
Thank you for speaking with me t.oday about the off peak hours concerning the
blacktopping work at Walmart.As I discussed with you.,we would propose to come in on
the 5th of September to start removal of blacktop in half of the lot,at 4;00amto be
competed by 10;30 am on the 5th.On the 6th we would install new blacktop.in the N half

In conclusion.we are proposing if loud r",,>ise is generated. it would be for 3 to 4 hours a
day,on the front of the store,and only for a 6 days,until completion.
