DRAFT REVISED August 31, 2005 Peter Bell, Chair Metropolitan Council 230 East Fifth Street St. Paul, MN 55101-1626 Dear Chairman Bell: This is written in response to the public hearing held by the MCES on August 23rd, for which written comments are being received until September 2nd. For several years, Rahr Malting in Shakopee has been in the planning stages to handle its own wastewater disposal and sludge, with the intent being for the company to operate independently ofthe MCES treatment system. The concept ofRahr coming off the MCES system is agreeable to both sides, and the only delay to the implementation ofthis is working out details of the MCES and MPCA permit requirements. With the City of Shakopee's 1995 Comprehensive Plan, the City and Metropolitan Council reached agreement that when Rahr went off the regional sewer system, the City would be entitled to about 1500 SAC credits. Recently, City staff has been working with staff from MCES to ensure that this turnback of the SAC credits from Rahr can take place. Through all these negotiations, it has been represented and assumed that the 1500 SAC credits that will be freed up when Rahr goes "off-line" would be distributed back to the City of Shakopee. However, we have recently been made aware that consideration is being given to changing the policy, which would no longer allow such credits to be distributed back to the host community. Because of the length of time the City and Metropolitan Council agreement regarding Rahr SAC credits has been in place, the City of Shakopee hereby requests that if the Metropolitan Council adopts the proposed new policy, then an exception be granted to allow the City of Shakopee to be credited with the 1500 SAC credits from Rahr. This situation was reviewed by the City Council at a special meeting on August 16th, which was attended by Metropolitan Council Representive Julius Smith, and Met Council staffers Bryce Pickart, Donald Bluhm, and James Uttley. The consensus of the City Council was that I relay to you the City's strong desire for this exception, so that it can be entered as part ofthe written record.
