for Pedestrian Bridge

INTRODUCTION:
This agenda item is intended to request City Council approval to proceed with submittal
of projects for Federal Funding in the Transportation Equity Act for the Twenty-First
Century (TEA-21). City staff has identified in the Capital Improvements Program for
pedestrian bridges over T.H. 169 east of C.R. 83 at C.R. 77 and c.R. 15 for possible
projects that could be funded by this program.
BACKGROUND:
The TEA-21 bill has been approved by the Federal Government and Metropolitan
Council and :MN/DOT are now receiving project submittals for possible funding within
this program. The TEA-21 program has three areas primarily with funds allocated to it
and they are as follows:
. Surface Transportation Program (STP)
. Congestion, Mitigation/Air Quality Program (CMAQ)
. Transportation Enhancement Program (TEP)
Approximately $55 million dollars is anticipated to be available for STP projects for the
years 2007 through 2008. The TEP will have almost $10 million for the same period and
the CMAQ projects will may have as much as $35 million available but, over a period
from 2009 through 2010.
Mn/DOT Metropolitan Division also has a program that is separate from these three
programs that are handled by the Metropolitan Council and these programs are for
bridges, safety and hazard elimination projects. This particular program is where rail
crossing improvement programs and safety improvements can be applied for. As
mentioned previously, the City has one project that could potentially quality for Federal
Funds under the TEA-21 as follows:

1. Pedestrian bridge crossings over T.H. 169 east of C.R. 83, C.R. 77 and C.R.

Under the TEP, projects will be grouped into three categories as well and they are as
follows:
1. Pedestrian and Bicycles
2. Historic
3. Scenic and Environmental
Under the STP, projects can be submitted in one ofthree categories:
1. Non- freeway principal arterial highways
2. Projects on the "A" minor arterial highway system
3. Bicycle and pedestrian bridges
The pedestrian bridge over T.H. 169 east of C.R. 83 could qualify under the TEP as
pedestrian and bicycle improvements. It is proposed by staff to apply this bridge over
T .H. 169 under the TEP category, which Mn/DOT staff recommends for the highest
ranking. In the Capital Improvements Program, staff identified three areas in which there
are no pedestrian walkways and they are at C.R. 15, C.R. 77 and and east of C.R. 83.
Staff has reviewed the priority of each pedestrianJbicycle crossing and feels the priority
order is T.H. 169 to the east of C.R. 83. The other two pedestrian crossings would not
rank high in a submittal at this time, in staffs opinion; however, an application will be
prepared and submitted if Council approves.
Under this program, the City could obtain 80% funding from the Federal Government in
order to construct separate pedestrian bridges, bridge approaches and connecting trails
across T.H. 169 to connect to each area of the Community on either side ofT.H. 169 with
the pedestrianJbicycle facility. Currently, a bridge crossing does not exist over T .H. 169
and this bridge would connect the Southbridge area with the Camas Quarry area and
ultimately the regional DNR trail.
Submittal deadline of these applicants is August 19,2005. Also staff will need assistance
from WSB & Associates, Inc. to complete the application. Estimated not-to-exceed cost
of professional service is $5,000.00 from the Engineering Professional Service account
and funds are available in the budget.
The action being requested is for Council to direct staff to proceed with submitting
projects for the TEA-21 program for the pedestrian bridges as mentioned. The submittal
deadline for TEA-21 projects is August 19,2005.
ALTERNATIVES:
1. Approve a motion directing staff to proceed on submitting the T .H. 169 pedestrian
bridges east of c.R. 83, c.R. 77 and C.R. 15 for TEA-21 funding to the
Metropolitan Council and Mn/DOT.

2. Do not submit any projects for possible Federal funding.
3. Approve a motion approving the expenditure of a not-to-exceed amount of
$5,000.00 to WSB & Associates, Inc. for preparation of the Federal funding
application.
4. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1 and No.3, in order to receive Federal funding for
these proj ects, which staff believes is needed for the City of Shakopee' s infrastructure and
for WSB & Associates, Inc. to complete the application on behalf of the City.
ACTION REQUESTED:
1. Approve a motion directing staff to proceed on submitting the T.H. 169 pedestrian
bridges east of C.R. 83 and C.R. 77 and C.R. 15 for TEA-21 funding to the
Metropolitan Council and Mn/DOT.
2. Approve a motion approving the expenditure of a not-to-exceed amount of
$5,000.00 to WSB & Associates, Inc. for preparation of the Federal funding
application.

Dear Chuck:
Attached to this letter are letters from Patrick Hughes, Metro District Engineer with
MnJDOT, dated June 3rd and June 10th, 2005 in regard to project proposals for federal
transportation funds in the year 2009 and 2010. The City of Shakopee would request
WSB & Associates to again assist the City in preparing proposals for pedestrian bridges
over T.H. 169 in the Southbridge area and over C.R. 77 and possibly CSAH 15. In the
last round of solicitation for projects, the Southbridge bridge over T.H. 169 almost made
the list. However this project needed additional regional points.
Please prepare the proposals and it may be necessary for us to meet to discuss connecting
trails in the Southbridge area and those various routes and costs that may be needed to
construct that project. If you have any questions in regard to this letter and my request,
please feel free to contact me in my office.

The Transportation Advisory Board (TAB) to the Metropolitan Council will soon solicit proposals
for 2009 and 2010 projects to use federal transportation funds. Project proposals, which directly
impact state highways or state highway rights-of-way, will again need to include a letter from
MnDOT indicating, at a minimum, the Department is aware of and understands the project. The
following outlines the process and information we will use to consider requested letters:
1. If you are considering a project proposal that directly impacts a state highway or state highway
right-of-way please get in touch as soon as possible with the appropriate MnDOT Metro Area
Manager assigned to that trunk highway corridor, as indicated on the attached map.
The Area Manager will be able to assist in the scoping of your project, an early MnDOT
review and the completion of the remainder of this process. This early coordination will help
irisurethat MnDOT will be able to write a letter for your project.
2. Requests for support letters only must be received by the Metropolitan District by July 11,
2005 at the latest. However, we would appreciate receiving requests much earlier. MnDOT
will consider the following in making its determination of support for a project:
-Project must satisfy investment priorities laid out in the 2008-2030 Transportation System
Plan (TSP):
. System Management investments that address safety and efficiency
. Previous plan commitments for expansion have first priority. The next priority
for expansion investment is on freeways followed by arterials that have, or are
forecasted to have, operational or capacity deficiencies.
-Project must not adversely affect trunk highway operations
3. Requests for letters and a financial commitment by MnDOT must be received by July 1,
2005 at the latest. MnDOT will make a determination on its potential financial commitment at
its July 11 Metro Program Committee meeting. Letters will be sent to requesters shortly after
that meeting.

_ Are included in the Metro Work Plan 2005-2014 or have potential for funding from Metro set
aside programs (ie. Pavement, Bridge, Adva"ltagcs for Transit, Access Mgmt., etc.)
_ Show partnership potential with local funding availability.

b. Project concept drawing; layout if available
c. Expected year of construction
d. A description of the project's impacts on MnDOT right-of-way
e. A description of the problem and how the proposed project will solve that problem
f. A description of any related projects or stages.
g. A description of the funding plan, including any expectation of a MnDOT financial
contribution
h. Identification of a contact person

The Metropolitan District of MnJDOT, on behalf of the Transportation Advisory Board of the Metropolitan
Council, has been requested to solicit candidate projects in two project categories for federal transportation
funding for the years 2009 and 2010. The two project categories included in this solicitation are Hazard
Elimination Safety and Bridge Improvement/Replacement. The Transportation Advisory Board is directly
soliciting candidate projects in eight other project categories. You should receive that solicitation at about the
same time you receive this one. Approximately $2.4 million per year is available for the Hazard Elimination
Safety category, and $5 million per year for the Bridge Improvement/Replacement category.
The materials available on the following MnJDOT web site, www.dot.state.mn.us/metro/programmanagement.
describe the project categories and the qualifying and priority criteria, which will be used to prioritize the
candidate projects submitted. Please read the materials from the web site carefully and supply the required
information as completely as possible so that your project can be fully understood by the groups evaluating and
ranking the projects. If you do not have web access, please request a copy of the material from Sherry

"'management. The program emphasizes the air quality benefit ofthe'project or program. The TAB will detenriine if
any CMAQ projects will be funded with STP funds at the conclusion of the solicitation process.
Under the TEP, there are twelve qualifying eligible activities. For this solicitation those twelve activities have been
grouped into three subcategories: I) scenic and environmental, 2) bicycle and pedestrian, and 3) historic and
archaeological. Projects must be submitted under one ofthose three subcategories.
The TAB and Metropolitan Councillll'e al~o seeking project proposals for the Transportation Investment Planned
Economic Development District (TIPEDD) program, whieh is a demonstration program intended to encourage
multi-Jurisdictional transportation projects that facilitate future mixed-use development and redevelopment efforts.
Projects that qualify will be able to receive up to $1.0 million in federal transportation funds for additional
transportation improvements that meet the TIPEDD objectives.
Metropolitan Council and TAB staffwill host an information forum open to the public and to potential applicants at
9:00 a.m. on Wednesday, June 29,2005 in Council Chambers. Staff will give an overview of the program policies
and qualifying and prioritizing criteria, and will respond to any questions from potential applicants. More details on
this workshop will be available on the Council's solicitation webpage.
Also for your information, the Minnesota Department of Transportation (MN/DOT), Metropolitan Division, is in the
process of requesting submittals for Bridge Improvement and Replacement, Hazard Elimination Safety and Rail
Crossing Safety projects. MN/DOT is mailing information on this process to all potential applicants. These projects
will also be included in the 2007-2010 TIP.

Dear Mr. Loney:
According to our Agreement for Professional Services within the City of Shakopee and Section
I-C-2 (Major Projects), this extension agreement is written to provide you with an estimate of
cost for engineering services for the above-referenced project.
The proposed project includes the preparation on Federal Transportation Funds Applications for
pedestrian bridges across TH 169. The bridges are located at CR 77, CSAH 15, and the Dean
Lake Area. Two funding sources will be applied for the Transportation Enhancement Program
and the Surface Transportation Program (STP).
We propose to conduct the work on an hourly basis with an estimated fee ranging from $3,500 to
$5,000 and a not to exceed cost of$5,000. We will not exceed this amount without your prior
approval.
It is proposed that all work under the contract would be considered complete after the
applications have been submitted to Met Council. The design and construction phase would be
initiated if funding is approved.
The City of Shakopee agrees to reimburse WSB & Associates for these services in accordance
with Section IV of the Agreement for Professional Services. If this agreement meets with your
approval, please sign below and return one copy to our office.
