Introduction
Opus Development Company, LLC has submitted an application for Preliminary and Final Plat
approval of property located north of 1 lth Avenue East, east of Valley Park Drive, and south of
CSAH101. The applicant is proposing to plat two (2) industrial lots, 42.0 and 45.6 acres in size,
two (2) outlots, and new public rights -of -way (Innovation Blvd. & Innovation Drive), with the
east lot of the proposed development to be final platted at this time. The final plat would consist
of the lot on which the former ADC Telecommunications building is located, which is proposed
to be occupied by Rosemount Inc. (Emerson).
Several city departments and outside agencies provided memorandums which included
comments /conditions as a result of their review of the project. These memorandums have been
attached to this report, and their conditions have been incorporated into the draft resolution.
Planning staff have commented that the plat should be renamed Valley Park Business Center First
Addition to avoid confusion with future plat additions, such as when Outlot A is proposed to be
platted. It is also noted that the outlot shall be platted prior to issuance of any building permits
for that lot (presently, the City and Opus are processing an EAW for that property). Regarding
the connection of Innovation Blvd. along the north side of the property to Valley Park Drive, via
an easement currently owned by Conklin Company, the applicant has provided a document that
supports an agreement for the roadway which provides for the dedication of both the strip of
property located within the Conklin Company property and the portion east of that lying within
the property being purchased by the applicant. Both parties agree to submit the easement property
for dedication to the City for its use as a public street.
Planning Commission Recommendation
The Planning Commission reviewed the preliminary plat at its June 27, 2013 meeting, and by a 6
- 0 vote, they recommended approval of the preliminary plat as presented.
Alternatives
1. Approve Resolution No. 7323, a resolution approving the Preliminary and Final Plat of Valley
Park Business Center First Addition, subject to the conditions as presented.
2. Approve Resolution No. 7323, a resolution approving the Preliminary and Final Plat of Valley

3. Do not approve the preliminary and final plat and direct staff to prepare a resolution consistent

INTRODUCTION
Opus Development Company, LLC has submitted an application for Preliminary and Final
Plat approval of property located north of 11 Avenue East, east of Valley Park Drive, and
south of CSAH101. The applicant is proposing to plat two (2) industrial lots, 42.0 and 45.6
acres in size, two (2) outlots, and new public rights -of -way (Innovation Blvd. & Innovation
Drive), with the east lot of the proposed development to be final platted at this time. The final
plat will be considered by the City Council after the Commission forwards a recommendation
on the preliminary plat. The final plat would consist of the lot on which the former ADC

Telecommunications building is located, which is proposed to be occupied by Rosemount Inc.
(Emerson).
Several city departments and outside agencies have provided memorandums which note
comments /conditions as a result of their review of the project. These memorandums have
been attached to this report.
The Engineering Department has reviewed the application and provided a memorandum that
includes a significant number of conditions (including the need for easements and right -of-
way and/or roadway easements for a future crossing of the Prior Lake Outlet Channel) that
shall be incorporated into the resolution should this request be approved. Engineering also
commented that regarding the Storm Water Management Plan Review, the applicant
submitted a petition to initiate a public improvement project to construct the public streets,
utilities and various other improvements associated with Innovation Boulevard and
Innovation Drive. Engineering staff, the City's consultant and the developer will work
together to ensure the storm drainage system complies with City requirements.
Shakopee Public Utilities provided a memorandum, noting that this property is not located
within their electric service territory; however, the platted utilities and drainage easements
should not carry unique restrictions as are noted on the plat. SPUC electric must be able to
use the city's easements, much like any other subdivision.
The City Director of Parks, Recreation and Natural Resources provided a memorandum
noting a number of conditions of approval, specifically noting compliance with the City Code
pertaining to park dedication fees, and the construction of a trail along the exterior of the ring
road along the south property line.
The City Natural Resources Technician provided a memorandum noting a number of
conditions regarding compliance with the Woodland Management Ordinance, specifically
concerning tree replacement requirements.
CenterPoint Energy provided a letter stating that there is a gas main located in proposed
Innovation Blvd. right -of -way and a service line connection to the existing building. They
have voiced an objection to the proposed plat unless suitable easement rights are reserved for
them, or if the applicant reimburses CenterPoint Energy the cost of relocating the existing gas
main and service line.
Planning staff have commented that the plat should be renamed Valley Park Business Center
First Addition to avoid confusion with future plat additions, such as when the outlot is
proposed to be platted. It is also noted that the outlot shall be platted prior to issuance of any
building permits for that lot. Regarding the connection of Innovation Blvd. along the north
side of the property to Valley Park Drive, via an easement currently owned by Conklin
Company, the applicant has provided a document that supports an agreement for the roadway

Planning staff also comment that specific design and performance standards shall be reviewed
at time of building permit, should this request be approved. That would include a review of
the building materials, landscaping, parking lot (and curbing) design, trash and rooftop
screening requirements, and other criteria (including lighting, noise, and odor regulations) as
specified in the City Code.
STAFF RECOMMENDATION
Staff recommends that the Planning Commission recommend approval of the Preliminary Plat
of Valley Park Business Center First Addition, subject to the following conditions:
The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval of title by the City Attorney.
B. Rename the plat to Valley Park Business Center First Addition.
C. Execution of a Developer's Agreement, which needs to include provisions for
security for public improvements within the Final Plat and the engineering
review fees.
D. Payments of Trunk Storm Water Charges need to be made, as required by the
most current City of Shakopee Fee Schedule.
E. Payment of all bituminous sealcoat charges need to be made, as required by the
most current City of Shakopee Fee Schedule.
F. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final
Plat to be recorded with datum on the Scott County coordinate system.
G. The applicant shall meet park dedication requirements by providing cash in
lieu of land dedication.
H. Park dedication fees in the amount required by the City Code and adopted City
fee schedule shall be paid.
I. Right -of -way, in the form of sight triangles fifteen (15) feet in dimension, will
be provided at the southernmost intersection of Valley Park Drive and
Innovation Boulevard.
J. Right -of -way or roadway easement(s) need to be provided for a future crossing
or crossings of the Prior Lake Outlet Channel located in Outlot C.
K. Easements will be shown on the Final Plat as approved by the City Engineer.
They include, but are not be limited to, the following:
a. Minimum drainage and utility easements for public storm sewer need
to be dedicated per the City of Shakopee Design Criteria, Section 10.1
(A -D). The easements need to be centered on the public utility
alignments.
b. Provide adequate drainage and utility easements to encompass the final
storm sewer structures, pipe, ponds and associated appurtenances.
c. Provide drainage and utility easements adjacent to the interior lot lines
of Outlot A, Outlot B and Outlot C.
L. The applicant shall submit a landscaping plan that addresses the entire
subdivision, including Outlot B and Outlot C, to City staff for review and

approval. This plan will be in compliance with the most recent version of the
City of Shakopee's Easement Fencing and Landscaping Policy as well as the
most recent version of the City of Shakopee Easement, Fencing and
Landscaping Policy. Replacement trees are required to be planted as follows:
a. A minimum of six feet from impervious surfaces.
b. A minimum of ten feet from property lines.
c. Not in easements containing utilities.
d. Not in City owned right -of -way.
e. Not below overhead utilities.
f. Not below high water levels (HWL) in existing or created ponds or
wetlands.
g. Consistent with the Shakopee Tree Planting Guidelines.
h. Ash (Fraxinus sp.) are not allowed to be planted due to current insect
and disease issues.
M. No more than 1/3 of the trees shading the parking lot may be of one species.
N. The tree replacement requirement total is 49 replacement trees for this site.
This varies from the sheet number C2.01 B revised 06/14/13. This is
determined by the proposed 82 trees being removed of which 8 trees being
classified as Heritage Trees. No maple [Acer], apple [Malus], and spruce
[Picea] will be accepted as replacement trees. Contact the Natural Resources
Technician for a list of recommended alternatives.
O. Suitable easement rights shall be reserved for CenterPoint Energy, or the
applicant shall reimburse CenterPoint Energy the cost of relocating the existing
gas main and service line.
P. The platted utilities and drainage easements should not carry unique
restrictions as are noted on the submitted plat. SPUC electric must be able to
use the city's easements, much like any other subdivision.
II. Following approval and recording of the final plat, the following
conditions shall apply:
A. Final grading requires that the applicant shall provide six inches of topsoil for
the establishment of turf and plantings. The soil composition should be similar
to the MnDOT topsoil borrow requirements.
B. Irrigation systems shall require rain sensors.
C. Storm ponds should be seeded with a native wetland seed mixture and erosion
control blanket should be placed four feet either side of the normal water level
and around outlets to prevent erosion and sediment deposits downstream
surface waters.
D. The applicant is responsible for preserving all trees indicated as saved on the
plans. If, as a result of mass grading, any of these trees are determined to be
wounded sufficiently to be considered dead or dying by the Natural Resources
Technician, the developer shall be required to replace the tree(s) according to
the Woodland and Tree Management Ordinance.
E. Tree protection fence for mass grading shall be installed prior to any site work
and/or tree removal, and is to remain in place the duration of the land
disturbing activities. This fencing is to be removed following establishment of

vegetation as determined by an inspection by City staff. Removal of the silt
fence and tree protection fence for mass grading shall be the responsibility of
the developer. Tree Protection Fence means orange snow fencing or
polyethylene laminate safety netting placed at a radius of one and a half (1.5)
feet for every inch of DBH (diameter at breast height) from the tree stem for
trees to be preserved. {(DBH (in inches) x 1.5 (feet) = radius of Tree Protection
Fence.)}
F. The applicant shall utilize the MPCA Protecting Water Quality in Urban Areas
as a technical reference for erosion control.
G. Building construction, sewer, water service, fire protection and access shall be
reviewed for code compliance at the time of building permit application(s).
H. The developer and/or their assigns shall be responsible for any required or
desired noise or dust mitigation measures.
The applicant shall meet the screening and landscaping ordinance requirements
of the City Code.
J. For grading (cutting) being done between the dates of April 1st and July 31st
Tree Protection Fencing around an oak Heritage Tree will be at a minimum
radius of one hundred and sixty (160) feet.
K. Newly planted trees /shrubs shall meet the following requirements (add to
Sheet No. C2.01):
a. The tree /shrub shall be planted with the first main lateral root at ground
line, if planting depth of nursery stock is too deep remove excess soil.
b. Nursery stock shall meet standards set in ANSI Z60.1 -2004 and
planted to meet standards set in ANSI A300 -2012 unless noted in these
conditions or Landscaping Plans.
c. If the tree /shrub is balled & burlapped:
1. Remove the top 1/2 or the top two horizontal rings of the wire
basket.
2. Remove the burlap and nails to expose the top 1/2 of the soil ball.
3. Remove all rope /twine and dispose of off-site.
4. Cut vertical slits at 6 inch intervals into treated burlap.
d. A ring of mulch 3 " -4" in depth will be placed around all installed
plants. The ring of mulch will be cleared away from the stem, not
touching the stem.
e. Plants that do not meet listed requirements and conditions, are
determined unhealthy by City of Shakopee staff or are damaged before
time of inspection it will be replaced at the expense of the builder.
L. Bare root is an acceptable planting stock for meeting the Landscaping
Requirements. Trees still must meet size requirements. All bare trees shall be
planted during the spring or fall planting season. Spring planting season is
considered April to early June and Fall planting season is considered late
September through November. Trees shall meet the requirements outlined in
condition 5 as well as requirements outlined in the City of Shakopee Forestry
Specifications Manual (place on Landscaping Plans).
M. Tree planting detail (contact the Natural Resources Technician for the detail)
shall be included on Landscaping Plan.

III. The following conditions need to be addressed /completed prior to approval of a
grading permit and/or a street and utility plan:
A. The applicant submitted a petition to initiate a public improvement project to
construct public streets, utilities and various other improvements associated
with Innovation Boulevard and Innovation Drive. Please refer to the petition
for specifics. Engineering staff, the City's consultant and the developer will
work together to ensure all streets, utilities and appurtenances comply with the
City's requirements.
B. The applicant must meet the City's Woodland and Tree Management
Ordinance requirements (Section 11.60 Subdivision 9). The applicant shall
contact City Staff prior to any land disturbing activities for an inspection of the
tree protection/silt fence installed at the drip line of trees to be preserved.
C. The developer should implement the use of Best Management Practices for
erosion control and stormwater management during construction.
IV. Following approval and recording of the final plat, the following conditions
need to be addressed /completed prior to issuance of a building permit:
A. Record plans need to be provided per the City of Shakopee Design Criteria,
Section 2.5 and Section 11.2 (A -L). The record plans need to be submitted to
the engineering department.
B. Outlots shall be platted prior to issuance of any building permits for those lots.
C. Any work proposed within the County right -of -way shall require a County
permit.
D. No berming, landscaping, ponding or signage shall be permitted in the County
right -of -way.
E. Trail construction shall be provided along the exterior of the ring road along
the south property line with easements 20' wide if the trail crosses private
property or is outside of the public right -of -way. If the trail is to follow the
exterior of the ring road along the north property line, a fence shall be installed
between the trail and the railroad.
F. The applicant shall provide and install park, open space, and trail boundary
signage as determined to be needed by the city.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
PRELIMINARY AND FINAL PLAT OF VALLEY PARK BUSINESS CENTER FIRST
ADDITION
WHEREAS, Opus Development Company, LLC, applicant, and Premier Bank, property owner,
have made application for preliminary and final plat approval of Valley Park Business Center First
Addition; and
WHEREAS, the subject property is legally described as:
See attached Exhibit #1; and
WHEREAS, the Planning Commission reviewed the preliminary plat on June 27, 2013, and
recommended approval of the proposed preliminary plat with conditions; and
WHEREAS, on July 2, 2013, the City Council reviewed the proposed preliminary and final
plat.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA THAT THE PRELIMINARY AND FINAL PLAT OF
INTERSTATE ADDITION IS HEREBY APPROVED, SUBJECT TO THE FOLLOWING
CONDITIONS:

erosion control and stormwater management during construction.
IV. Following approval and recording of the final plat, the following conditions
need to be addressed /completed prior to issuance of a building permit:
A. Record plans need to be provided per the City of Shakopee Design Criteria, Section 2.5
and Section 11.2 (A -L). The record plans need to be submitted to the engineering
department.
B. Outlots shall be platted prior to issuance of any building permits for those lots.
C. Any work proposed within the County right -of -way shall require a County permit.
D. No berming, landscaping, ponding or signage shall be permitted in the County right -of-
way.
E. Payments of Trunk Storm Water Charges need to be made, as required by the most
current City of Shakopee Fee Schedule.
