SUBJECT: Request for Occupancy on Lot 15, Block 3, Valley Creek Crossing
DATE: August 3, 2005
INTRODUCTION:
Attached is a letter from Dale Dahlke, Vice President of Associated Capital Corporation
with the Valley Creek Crossing development asking for a certificate of occupancy on Lot
15, Block 3, Valley Creek Crossing. This request is being asked of Council since
previously Council issued a building permit prior to pavement being placed on January 4,
2005, with the requirement that no certificate of occupancy be given unless the street has
concrete curb and gutter and the first layer of bituminous pavement.
BACKGROUND:
Council did grant five building permits on January 4, 2005 for the Valley Creek Crossing
development prior to bituminous pavement being placed on these roadways adjacent to
these lots. Lot 15, Block 3, Valley Creek Crossing did receive a permit and the builder
has sold this house with the closing on August 4th. It is expected that the street in front of
this house will be paved on August 8th or 9th weather depending.
The developer is requesting a occupancy for this lot only due to difficulties of weather
delays and other job related problems which could not meet the closing date for the
homeowner and builder. The street does have everything done except for the final
grading of the Class 5 aggregate base, and bituminous paving. I did talk with the
Building Official Jim Grampre, and if Council is supportive of issuing a certificate of
occupancy due to the delays experienced by the developer, the Building Official would
grant the certificate of occupancy for this one lot only.
ALTERNATIVE:
1. Approve a motion to allow the issuance of a certificate of occupancy for
Lot 15, Block 3, Valley Creek Crossing.
2. Do not allow a certificate of occupancy for Lot 15, Block 3, Valley Creek
Crossing until the first layer of bituminous paving is in place.

RECOMMENDATION:
Staffhas no recommendation, as this is a policy matter for City Council, however, if
Council were to allow a certificate of occupancy for this lot, staff believes the bituminous
pavement would be placed shortly and would not impact the homeowner to a great
extent.
ACTION REQUESTED:
Approve a motion to allow a certificate of occupancy on Lot IS, Block 3, Valley Creek
Crossing before bituminous pavement is placed.

This is a request to allow occupancy of a home on lot 15, block 3, Valley Creek Crossing
on August 4,2005. We had expected to have the blacktop in place by this date, but
because of earlier weather delays and other job related problems, the blacktop will not be
done until next Monday. The lot is graded, curb is in, and small utilities available.
