Cox, City Clerk SUBJECT: Temporary 3.2 Percent Malt Liquor Licenses - Shakopee Jaycees Inc. DATE: July 14, 2005 INTRODUCTION: The Shakopee Jaycees Inc. have made application for a temporary on-sale 3.2 percent malt liquor license for Derby Days on August 5 and 6, 2005. The application and certificate of insurance are in order. I have been in contact with the Police Department regarding the application. They have no reason to deny the license. The Shakopee Jaycees have asked that the Derby Days Beer Garden remain open an extra hour. See attached letter. Chief Hughes is recommending that the beer tent sales end at 11 :00 p.m. consistent with previous years, see attached memos. RECOMMENDED ACTION: Move to approve the application and grant a temporary on-sale 3.2 percent malt liquor license to the Shakopee Jaycees, Inc., for the municipal parking lot at 2nd A venue and Lewis Street, on August 5 and 6, 2005. Council should discuss when sales should cease. (liquor/JCTempBeerDerbyDays) To whom it may concern: 6/28/05 I am writing this letter to request that you reconsider the cut off time that is currently in place for the Derby Days Beer Garden / Dance. It is at this time only until 11:30 pm. I realize that last year you let us extend it an extra half hour to make it 11 :30pm in the previous years it was 11 pm. 1Jn.1t; This suggestion came while talking to Jack McGovern and Sandy ~ of the Derby Days Committee. Most City Festivals Dances go until lam. We are asking that our time be pushed to 12:30am. I also, think that our reputation of running of the Beer Garden speaks for it's self. The Jaycees started running the Beer Garden back in the early 90's when the City Festival was brought back and we have never had issues with serving minors or cutting patrons off When we have cut patrons off we have always followed strict guidelines and notified the Shakopee Police when there was a situation that we the Shakopee Jaycees could not handle. The Shakopee Jaycees have also been selling beer out at the Renaissance Festival for over 27 years with out failing even one sting done by the Scott County Police Department. As you can see that our training of our beer tenders and having several TIPS trained members have made us very good at what we do! In the past to present, we have taken the profits that we the have made and split it do'WIl the middle and given half to the Shakopee Police Department, and half to the Shakopee Fire Department. I would love to be able to increase our donation to these Departments. This will enable them to increase the safety in our community. CITY OF SHAKOPEE POLICE DEPARTMENT Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Dan Hughes, Chief of Police ~ SUBJECT: Derby Days Beer Tent DATE: July 14,2005 I agree with Sergeant Johnson's recommendation that the beer tent sales end at 11:00 P.M., as in previous years. Sergeant Johnson's memo is attached. I believe this is consistent with council goal, # 11, which is to "Ensure a Safe and Secure Community." CITY OF SHAKOPEE Memorandum TO: Honorable Mayor and City Council FROM: Clay Johnson, Shakopee Police Sergeant SUBJECT: Derby Days Beer Garden Time Extension DATE: July 13, 2005 INTRODUCTION: The Shakopee Jaycees have submitted a written request that the Derby Days Beer Garden's remain open an extra hour. BACKGROUND: As it stands now, the Beer Garden's would cease serving alcohol at 11 :OOpm and all alcohol is to be off the tables by 11 :30pm, If the request were granted, the service would continue until 12:00am and alcohol would be off the tables by 12:30am, After discussing the matter with the police department leadership group, the consensus was that the Beer Garden's closing time remain the same. The staff aggress that the Shakopee Jaycees have done a fantastic job of coordinating and running the Beer Garden's and will continue to do so this year. Our decision is in no way a reflection on the Shakopee Jaycees ability to manage the Beer Garden's an extra hour. It is simply an effort by the police department leadership group to prevent potential problems. Specifically with crowd dispersal and loitering juveniles whose parents are at the Beer Garden's, These have been problems in the past and the overall feeling is that an extra hour of alcohol consumption would add to existing problems and perhaps create new ones. RECOMMENDATION; Staff recommends that the Derby Days Beer Garden sales end at 11: 00 pm, as in previous years.
