Fees as Required by Scott County

INTRODUCTIONIDISCUSSION:
On July 6,2005, the Community Development staff received notice that, effective July 1; Scott
County had increased the fees for recording documents. A copy of the Recorder/Registrar of Titles,
Pat Boeckman, is attached for the Council's information. As the Council can see, very little notice of
the change was given, and this fact has a negative impact on a number of land use applicants. In other
words, after receiving complete applications, planning staffhas had to contact a number of applicants
to ask them for new or additional checks for recording fees, much to their consternation. I will be
sending the County Recorder a letter asking that in the future more notice be given of such changes.
The attached ordinance amends the adopted City Fee Schedule to conform to those new fees. The
Council is asked to approve that ordinance.
ALTERNATIVES:
1. Approve Ordinance No. 733, an ordinance amending the City's Adopted 2005 Fee Schedule to
increase recording fees as presented.
2. Approve Ordinance No. 733, an ordinance amending the City's Adopted 2005 Fee Schedule to
increase recording fees with revisions.
3. Do not approve Ordinance No. 733.
4. Table the matter for additional information.

AN ORDINANCE OF THE CITY OF SHAKOPE~'."MlNNESOTA,
AMENDING FEES SET FOR RECORDING DOCUMENTS WITH THE SCOTT COUNTY
RECORDER'S OFFICE -
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, :MINNESOTA, ORDAINS:
WHEREAS, the Shakopee City Council has adopted a Fee Schedule for the fiscal year
2005; and
WHEREAS, Scott County has recently increased certain fees relating to recording, and thus
amendment of the City's 2005 Fee Schedule is required to conform to the new fees.
NOW, THEREFORE, THE CITY COUNCIL 'OF THE CITY OF SHAKOPEE,
MINNESOTA, does hereby ordain as follow;
Section 1 - That the 2005 Fee Schedule, adopted by Ordinance No. 715, is hereby amended
as follows:
. The fee for Abstract and Torrens documents (including for example CUP resolutions) will
be $46.00, or which $10.50 is transferable by Scott County to the State Treasury as a

surcharge.
. The fee for plats/RLS/CIS's will be $56.00.
Section 2 - Effective date. This ordinance becomes effective from and after its passage and
publication.
Adopted in adj. regular session of the City Council of the City of Shakopee, Minnesota held
the 19th day of July, 2005.

Re: New recording fees and requirements; Recording Checklist
Effective July 1,2005, there will be new recording fees required by State Statute. This Fee Bill was recently signed by the
Governor. Recorder's fees have not been raised since 1991, which for most, was before computers. There was also a
collaborative effort by the Minnesota CoUnty Recorder's Association, the MN Bar Association, Title and Real Estate
Associations, etc. to have statewide standardization of recording fees.
Below are some of the major changes that will be effective July 1,2005:
. The fee for Abstract and Torrens documents will be $46.00, of which $10.50 will be transferred to the State
Treasury as a surcharge fee
. - Documents containing multiple satisfactions/releases, assignments or partial releases will be $46.00. If
more than four documents are referenced on said documents, an additional fee of$10.00 per document
referenced will be required.
. No more counting pages
. PlatstRLS/CIC's will be $56.00
. (Torrens may have additional costs depending on number of Certificates involved.)
. Certified copies will be a flat fee of$10 regardless of number of pages
. Duplicate copy submitted with original, shall be available with recording date for $2.00
. There is no longer a "non-standard" fee; however, documents should conform to standards per MN Statute
507.093
. A document will be rejected ifit is not legible or cannot be archived (Per MN Statute 508.82)
. See the enclosed Fee Schedule for additional changes (You may contact our office for an electronic version
if you wish to print in color)
Documents acknowledged before July 1,2005 may be recorded at the old recording fee through September 30,2005. All
other documents filed on or after July 1, 2005 must have the new recording fees.
A "Recording Checklist" has also been enclosed. In order for us to be statutorily timely we need your staffs efforts and
responsibility to send complete and correct recording requirements on documentation. They should use this checklist to
verifY documents before sending to our office. You may make copies of this checklist, put in sheet protectors, and keep at
your desks for quick reference. You may contact our office for an electronic version of this Checklist if you wish to print in
color.

DOCUMENT STANDARDS
Minnesota Statutes 507.093
STANDARDS FOR DOCUMENTS TO BE RECORDED OR FILED (IN PART).
a) The following standards are imposed on documents to be recorded with the County Recorder or Registrar of Titles:
I. The document shall consist of one or more individual sheets measuring no larger than 8.5 inches by 14 inches.
2. The form of the document shall be printed, typewritten, or computer generated in black ink and the form of the document
shall not be smaller than 8-point type.
3. The document shall be on white paper of not less than 20-pound weight with no background color, images or writing and shall
have a clear border of approximately one-half inch on the top, bottom and each side.
4. The first page of the document shall contain a blank space at the top measuring three
inches, as measured from the top of the page. The right half is to be used by the County
Recorder or Registrar of Titles for recording information and the left half is to be used by the County Auditor or Treasurer for
certification.
5. The title of the document shall be prominently displayed at the top of the first page below
the blank space referred to in clause (4).
6. No additional sheet shall be attached or affixed to a page that covers up any infonnation
or printed part of the fonn.
7. A document presented for recording or filing must be sufficiently legible to reproduce a
readable copy using the County Recorder's or Registrar of Title's current method of
reproduction.
Minnesota Statutes 508.82 REGISTRAR'S FEES
Subdivision 2 - Variance from standards. A document should conform to the standards in section 507.093, paragraph (a), but should
not be rejected unless the document is not legible or cannot be archived. This subdivision applies only to documents dated after July
31, 1997, and does not apply to Minnesota unifonn conveyancing blanks on file in the office of the commissioner of commerce
provided for under. section 507.09, certified copies, or any other form provided for under Minnesota Statutes.'
