No. 6273 IS; 0, :L~ CITY OF SHAKOPEE Memorandum CONSENT TO: Mayor and City Council Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Final Plat of Park Meadows 3rd Addition MEETING DATE: July 19, 2005 CASELOG NO.: 05-087 REVIEW PERIOD: June 10- October 8, 2005 DISCUSSION Centex Homes has made application for Final Plat approval of Park Meadows 3rd Addition. The property is located north of Valley View Road and west of CSAH 83 (please see Exhibit A). The plat is 13.83 acres in size with 3.89 acres being dedicated for right-of-way. The plat proposes the creation of 27 single family residential lots. The final plat is in substantial conformance with the approved preliminary plat. Comments received from other departments, including the Engineering Department and Shakopee Public Utilities (SPUC) have been attached for Council's review and incorporated into the suggested conditions of approval. ALTERNATIVES 1. Approve Resolution No. 6273, a resolution approving the final plat of Park Meadows Third Addition, as presented. 2. Approve Resolution No. 6273, a resolution approving the final plat of Park Meadows Third Addition with revisions. 3. Direct staff to prepare a resolution denying the request for final plat approval. 4. Take no action, and leave the item on the table. STAFF RECOMMENDATION Staff recommends Alternative No. 1 at this time. ACTION REQUESTED Offer a motion to approve Resolution No. 6273, A Resolution Approving the Final Plat of Park Meadows Third Addition, subject to conditions, and move its adoption. ~rrna~ Planner II h: \cc\2005\07 -19\fpparkmeadows305087 ,doc 1 " RESOLUTION NO. 6273 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF PARK MEADOWS THIRD ADDITION WHEREAS, Centex Homes, applicant, and property owner, has made application for final plat approval of Park Meadows Third Addition; and WHEREAS, the subject properties are legally described as: Outlot A, Park Meadows Second Addition, Scott County, Minnesota; and WHEREAS, the Shakopee Planning Commission conducted a public hearing on the preliminary plat on November 6, 2003, December 4, 2003 and January 8, 2004; and WHEREAS, all required public notices regarding the public hearing were posted and sent; and WHEREAS, the Shakopee Planning Commission has recommend approval of the preliminary plat; and WHEREAS, the City Council approved the preliminary plat request at its meeting of February 3, 2004. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: I. The following procedural actions must be completed prior to the recording ofthe Final Plat: A. Approval oftitle by the City Attorney. B. Execution of a Developers Agreement with provisions for Plan A and Plan B improvements, as well as payment of engineering review fees, and any other fees as required by the City's adopted fee schedule. 1. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 2. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. Installation of sanitary sewer and storm sewer systems, and construction of streets in accordance with the requirements of the 2 Design Criteria and Standard Specifications ofthe City of Shakopee. 5. The developer shall be responsible for payment of Trunk Storm Water Charges, Trunk Storm Water Storage and Treatment, Trunk Sanitary Sewer Charges, security for the public improvements, engineering review fees, and other fees as required by the City's adopted Fee Schedule for the entire plat. 6. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utility Commission approve the Final Construction Plans and Specifications. 7. The applicant shall obtain a NPDES permit prior to any land disturbing activity. 8. The developer shall provide the City a letter of credit in the amount of 125% of the estimated assessments for the Valley View Road improvements. 9. Park dedication requirements shall be met through land dedication as shown on the plat (7.5 acres), plus a 20'wide, 650' long trail easement along the pond area, with the trail to be constructed at some point in the future by the City, for an additional .3 acres credited toward their park dedication amount. The park area shall be platted as a separate outlot. 10. The applicant shall provide the sidewalks as shown on the plan. 11. The applicant, with review and approval by the City's Engineering Department, shall address any remaining drainage issues in the park area. 12. All park dedication shall be recorded at time of final plat approval. 13. The applicant is required to notify in writing those individuals interested in purchasing lots with the trail easement about the trail. , 14. The applicant is required to post signage showing the trail alignment. 15. A petition shall be provided by the developer for future improvements to Valley View Road and it shall include a signed waiver of assessment appeal for these improvements. The applicant shall agree to the reapportionment of assessments by the City Engineer. 16. The applicant shall obtain all necessary right-of-way and/or easements to perform work offsite. C. Easements shall be shown on the Final Plat as approved by the City Engineer. Adequate drainage and utility easements shall be provided to encompass runoff to low point storm ewer structures in non-paved areas. D. The survey data (length and bearings) shall be shown for each lot. E. The final plat(s) shall be revised to evenly distribute the ponding area between Block 2 and Block 4, as those are shown in the approved preliminary plat of Park Meadows. F. The plat shall be revised to include a total of 30 feet of drainage and utility easement, centered on the proposed storm sewer, between Lots 10 and 11, Block 3. 3 G. The plat shall be revised to provide a total of 24 feet of drainage and utility easement, centered on the proposed storm sewer, between Lots 1 and 2 of Block 3. H. Shall provide and easement extending 10 feet beyond the edge of bituminous for the temporary cul-de-sac located on Karner Drive. I. The plat shall provide a total easement of20 feet minimum (10 feet each on Lots 4 and 5 and 20 feet on Lot 11, Block 3) for the watermain. J. Temporary cul-de-sacs shall be provided at the east plat lines on both Thrush Street and Karner Drive. K. Simultaneous with the recording ofthe final plat, a deed restriction shall be recorded on the following lots: Lots 1,2,4,5, 10, and 11, Block 3. The deed restriction shall appear as the following "This conveyance is made conditioned upon and subject to the following restriction. The Grantee, heirs, successors and assigns, are restricted from erecting any fence or other structure within the utility and drainage easements dedicated by plat over the above described property, except with the prior written consent of the City of Shakopee. This restriction shall run in favor of and be enforceable by the City of Shakopee". L. Temporary street signs shall be installed. II. Following approval and recording of the final plat, the following conditions shall apply; A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s). B. All storm sewer design calculations shall be approved by the City Engineer. C. ThrushStreet grades shall be revised to match the existing portion of Thrush constructed west ofthe site. D. The applicant shall work with the City and the City's consultant to coordinate the simultaneous construction of Park Meadows and Valley View Road. E. The applicant shall provide the City's Engineering Department with electronic (Auto CAD) files ofthe final plat.
