No. 7322 or 7323 General Business 4 SHAKOPEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark McNeill, City Administrator DATE: 06/25/2013 SUBJECT: Authorize Sale of Downtown Fire Station Building Introduction Motion approving the sale of the City's downtown fire station. Action Sought: Approving the sale of the downtown fire station building, conditioned upon a determination of its impact on the City's comprehensive plan. Background: For several months, the City has had listed for sale the now vacant downtown fire station building (334 Second Avenue West). An offer has come to the City through the City's listing agent, Kubes Realty. The prospective buyer is Peter D. Lund. His anticipated use (the storage and minor restoration of classic vehicles) will meet the City's zoning standards for the property. Mr. Lund has offered $320,000 to purchase the property. It is a "non- contingent" offer, meaning that there are no restrictions, nor a need to sell other property as a condition of this taking effect. A closing date has been set for July 12th. By State law, the City's Planning Commission must determine that the sale of any real property owned by the City is in compliance with the City's comprehensive plan. If necessary, that topic could be considered at its special meeting on June 27th. As an alternative, by a two- thirds vote, the City Council can determine for itself that the sale of the real property does not impact the City's comprehensive plan. It would therefore not need to be considered by the Planning Commission. That is the recommendation of Staff. Budget Impact: The proceeds from the sale of the building will be placed into the City's General Fund balance. If a specific use of the funds is desired, that can be determined at a later time. Recommendation: I recommend that the City Council first find that the sale of this property will have no impact on the City's comprehensive plan. The second recommendation is that the City Council authorize its sale. Action Required: If the Council concurs, it should approve a motion to adopt the unrestricted sale of the former downtown fire station building does not impact the City's comprehensive plan. If that motion is approved by two- thirds majority, the Council should adopt the the following resolution: A Resolution authorizing the sale of certain real property located at 334 Second Avenue West, Shakopee, Minnesota . It should be noted that if two- thirds of the City Council is not in agreement that the disposal of the former fire station property does not impact the comprehensive plan, but there is still a desire to sell the building, the Council should adopt the following resolution: A Resolution authorizing the sale of certain real property at 334 Second Avenue West, Shakopee, Minnesota, contingent upon a finding of the City's Planning Commission that said sale of property is consistent with the .City's comprehensive plan Attachments: Res No 7322 Res No 7323 (Recommended) RESOLUTION NO. 7322 A RESOLUTION AUTHORIZING THE CONTINGENT SALE OF THE CITY'S FORMER FIRE STATION BUILDING, LOCATED AT 334 SECOND AVENUE WEST WHEREAS, the City of Shakopee owns property at 334 Second Avenue West, which previously housed the City's fire department; and, WHEREAS, in February, 2012, the fire department moved to a new location on Vierling Drive, thus negating the need for this satellite fire station on Second Avenue; and, WHEREAS, the City has no other need for said building, and listed it for sale through a realtor; and WHEREAS, Peter D. Lund has offered $320,000 to purchase said property; and WHEREAS, the City finds that offer to be acceptable; and WHEREAS, MSA 462.356 requires that a planning agency shall study and find that the sale of real property is in compliance with City's comprehensive plan, or, in the alternate, a 2/3 determination by the City Council may dispense with the with the requirements of this subdivision, if it is found that the proposed disposal of this real property has no relationship to the comprehensive municipal plan; and WHEREAS, it is hereby determined by a minimum of a 2/3 vote of the City Council that the sale of the property at 334 Second Avenue West, Shakopee, Minnesota has no impact on the City's Comprehensive Plan NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby accepts the offer of Peter D. Lund for the purchase of certain real property at 334 Second Avenue West. BE IT FURTHER RESOLVED, that the appropriate City officials are hereby authorized to execute the sale. Adopted in adjournd regular session of the City Council of the City of Shakopee, Minnesota held this Twenty -fifth day of June, 2013. BE IT FURTHER RESOLVED, that upon said finding of the Planning Commission, the appropriate City officials are hereby authorized to execute the sale.
