CITY OF SHAKOPEE rtONSENT Memorandum r'; ~, ~1J' TO: Mayor & City Council ...--- Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Request ofPulte Homes Regarding Hourly Restrictions on Construction Activities On River Valley Estates DATE: July 19, 2005 INTRODUCTION: By letter dated July 12, 2005, Pulte Homes, the developer for River Valley Estates, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, be suspended for Saturday work hours. DISCUSSION: The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Pulte Homes is requesting a suspension on the hours as follows: Saturday From 8:00 AM to 9:00 AM Start Time From July 20, 2005 to December 31, 2005 The earlier starting time is to expedite work in order to work longer hours to allow contractors to work earlier on Saturday and to meet the schedule for this project. The contractor is anticipated to work at least six days a week to complete the project grading and 1 st phase utilities and streets. Staff would recommend that if the suspension of hours is granted, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure near residential areas. 2. If residential complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. 3. Blasting activities, if any, must be done from 10:00 A.M. to 6:00 P.M on Saturdays. . If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. Staff believes by allowing this suspension of work hours, the projects can be done sooner than the length of construction description and inconvenience is minimized. ALTERNATIVES: 1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, as requested by Pulte Homes, as per their letter dated July 12, 2005. 2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for some other period of time as determined appropriate by the City Council, and direct staff to publish notice of the suspension terms. 3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D. RECOMMENDATION: Staff recommends Alternative No.1. I would like to reiterate this request and ask that it be placed on the next available City Council agenda. Due to the late start of this project, our contractor is working diligently to complete this project prior to winter. This is important to not only create available lots for Pulte Homes, but it also facilitates the completion of the storm water ponds that will serve this development as well as Valley View Road. The creation of the ponds requires the entire site to be graded even though we are only platting the west half at this time. The project is bounded by CSAH 83 on the east side, Valley View Road on the south side, the newly graded development to the west, and a farm field to the north. The nearest existing home is to the north and is over 290 feet away from our grading limits. We would propose to direct our grading activity toward the south half of our project as much as possible from 8:00 AM to 9:00 AM to minimize the impact to this home. It is my understanding that the development directly to the east was permitted to start at 8:00 AM and that the City did not receive any complaints. Our contractor is currently working 11 hours per day Monday through Friday. Despite this aggressive work schedule, it is still necessary to work on Saturdays to facilitate the timely completion of this project. By allowing grading activity to start at 8:00 AM it will provide the ability for the contractor to complete this project sooner, which is a benefit to both Pulte Homes and the City of Shakopee.
