INTRODUCTION
This agenda item is to conduct a public hearing on the Fillmore Street Extension and
Alley Public Improvement Project, Project No. PR2005-3. If City Council desires to m e
ahead with the project, they are asked to adopt Resolution No. 6274, A Resolution
Ordering An Improvement And Preparation Of Plans And Specifications For The Fillmo
Street Extension and Alley Improvements, Project No. PR2005-3. Finally, City Council is
being asked to authorize a temporary parking lot, roadway, and additional fill needed for
bring the Community-Built playground site up to grade.
BACKGROUND
On March 15, 2005 City Council authorized a feasibility study for Fillmore Street
extension and adjacent alley improvements. Bonestroo Rosene and Anderlik underto
the study as part of their contract for the Huber Park design.
The study was originally scheduled to be reviewed by City Council on May 3, but was
pulled from the agenda to investigate additional water main, power line undergroundi ,
and trunk water charge questions that SPUC raised. On June 17, City Council review
the feasibility study, with watermain looping questions not yet answered by the Public
Utilities Commission. Since the watermain looping costs are not assessed costs, Cou iI
chose to move ahead with the public hearing on the feasibility study.
DISCUSSION
Comments from Property Owners
On July 12, I met with four of the five property owners that have proposed assessmen
associated with this project. (I understand the fifth property owner was out of town.)
reviewed the proposed work, timeline, and estimated costs. The following are their
comments:
Fillmore Street Extension
. Assessments for Mr. Gesswein and Mr. Capesius are proposed to be 50% of the
total costs based on the amount of road frontage. (The city would be paying the ot er
50%.)
. Mr. Gesswein and Mr. Capesius both feel that the city will be benefiting more than
they will since their driveways to their businesses are within the first % of the bloc .
Mr. Gesswein commented that he is willing to pay "his fair share".
. Mr. Capesius is also comfortable with the roadway being gravel and doesn't
necessarily see a need to pave it.
Alley Improvements
. Both Mr. Jim Perry and Mr. Wallace Perry seemed comfortable with the proposed
reconstruction of the alley, but Mr. Wallace Perry did not want to pay for the
proposed curb, gutter, and storm sewer work.
. Mr. Jim Perry asked whether the proposed reconstruction of all the existing
pavement. I confirmed with Bonestroo that it does include replacing all the existinl
pavement.
. Mr. Jim Perry questioned the design and final elevation for the west end of the all r
and whether or not the design would result in water pooling by the existing
stormwater catch basin at the end of the alley during a heavy rain or back up duri ~
flooding. I spoke with Bonestroo about the proposed design, and the project will b
designed to provide emergency over flow for the area.
Alley Power Line Undergrounding
. Mr. Jim Perry, Mr. Wallace Perry, and Mr. Gesswein seemed comfortable with th
proposed undergounding of the power line. However, they may choose to make t
electrical connections on their own instead including it in the public improvement
project. This is acceptable to Shakopee Public Utilities.
Other Questions/Discussion
. There was considerable discussion about the decision to close Bluff Avenue and t
have it function as an entrance/exit to the park. All property owners agreed that
without a second access, there were going to be significant traffic issues at the
Fillmore StreetlCSAH 101 intersection.
. There was discussion about the island on CSAH 101 east of Fillmore Street, and e
fact that it is frequently hit by motorists. Since we will be working with the County
improve the CSAH 1 01/Sommerville pedestrian crossing, I will bring up the Fillmo
StreetlCSAH 101 intersection to see if this can be addressed.
. There was a question about what interest rate is charged for assessments. Mr.
Voxland was not available to answer this question. I will have the information at y r
meeting.
. There was a question about whether or not the alley improvements included Iighti
I confirmed with Bonsetroo that lighting would be part of the final design and be
consistent with the parking lot lighting, but not an assessed cost to the adjacent
property owners.
. Mr. Jim Perry asked about trimming the park tree west of his building. I have aske
Ryan Hughes, Natural Resource Specialist, to meet with Mr. Perry.
Proposed Assessments
The proposed assessments are based on the city's adopted assessment policy. As I
understand, Council may choose to deviate from the adopted policy if it chooses. Tha
decision can be made now or at the time of the assessment hearing in the future.
Also, if there are questions regarding the amount of benefit that adjacent property
owners received from the improvements, a benefit appraisal can be done prior to the
assessment hearing.
Water Main Looping Update
In a discussion with Joe Adams from Shakopee Public Utilities on July 12, prelimina
results from their fire flow study indicate that lateral water main connection to Fillmore
Street appears to provide benefit to the area, but a connection across the park to Lev
Drive does not provide any system benefit. The Utilities Commission is scheduled to
review this information at their July 18 meeting and make a water main looping
requirement decision.
The County has indicated that they will require CSAH 101 to stay open during any util y
work. However, one option for making the water main connection is to bring the wate
main up Fillmore, but delay making the connection in CSAH 101 until CSAH is
reconstructed at some point in the future, possibly within 5-7 years.
Also, City Council had asked about the feasibility of drilling a well to serve the park.
Bonestroo researched the costs and estimate that a potable water well with pumps a
controls would cost somewhere between $30,000-$50,000, plus design fees, based 0
similar wells designed and drilled in Carver. This cost is in the same range as making
the water main loop to Fillmore Street.
Depending on the Public Utilities Commission decision, the watermain loop and CSA
101 connection plans would be finalized during the project design phase.
Project TimelinelTemporary Parking Lot and Roadway
Initially, we had hoped to have Council order the project and authorizing bidding at th
same time. However, given the additional time required to work on the water main
looping questions, it does not appear feasible to complete the design, bid the project,
and finish construction prior to the Community-Built Playground build date, October 4 .1
met with playground representative Bill Mars, Bruce Loney, Mike Hullander, and Dav
Rutt to discuss a temporary gravel roadway, parking lot, and playground staging area
There was consensus that temporary facilities would be adequate to serve the
playground build.
Construction of a temporary parking lot and roadway seems to be the best approach.
The work would be done by the Public Works staff. At this point we don't have final c ts
for the temporary facilities, but they would primarily consist of grading and aggregate.
Also, we will need to bring the playground site up to the proposed final elevation befo
the build. Bonestroo is completing the calculations for additional fill needed to meet t
elevations. Once we have this amount identified, Engineering will be reviewing their
current projects to determine what fill might be available from city projects, as well as
other sources.
Action being requested tonight authorizes staff to proceed with temporary facilities an
final fill for the playground site.
REQUESTED ACTION
1. City Council is asked to conduct a public hearing on the Fillmore Street Extension
and Alley Public Improvement Project, Project No. PR2005-3.
2. If City Council desires to move ahead with the project, they are asked to adopt
Resolution No. 6274, A Resolution Ordering An Improvement And Preparation Of

3. City Council is also asked to authorize proceeding with temporary parking and road y

WHEREAS, Resolution No. 6235 adopted on June 17,2005, fixed a date for ouncil
hearing on the proposed improvement of Fillmore Street, alley improvements nd all
appurtenant work; and
WHEREAS, ten days published notice of the hearing through two
publications of the required notice was given and the hearing was held on the 19t
July, 2005, at which all persons desiring to be heard were given an opportunity to b
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF T
OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is rdered
as hereinafter described:
Fillmore Street Extension, Alley Improvements, and all appurtenant work.
2. Bonestroo, Rosene, Anderlik and Associates is hereby designate as the
engineer for this improvement, and shall prepare plans and specifications for the king of
such improvements.
3. The work of this project is hereby designated as part of the PR2005 Public
Improvement Program.
4. The City Council shall let the contract for all or part of the improvements

Extension, Alley Improvements and Huber Park work
As I noted in the May 13 Huber Park update, the city has completed a feasibility stud
for Fillmore Street extension, alley improvements, and Huber Park work. This study
details the proposed work, cost estimates, and proposed assessment amounts, as w II
as costs that the city and Shako pee Public Utilities will be covering as part of the Hu r
Park project. An overview of the proposed work follows.
City Council has set a public hearing for 7:00 p.m. July 19 at City Hall, 129 South
Holmes Street, to hear public testimony on the proposed work and assessments. In
addition, if you would be interested in meeting as a group to review the proposed wo [m.
and assessments, I have scheduled the City Council Chambers at City Hall for 4:00
on Tuesday, July 12. If that time does not work for you, please call me at 952-233-9 14
and we can schedule another time. (I am out of the office July 4-July 11.)
Proposed Work
Section 1 - Fillmore Street Extension
Fillmore Street is proposed to be extended north from First Avenue to the start of th
new park parking lots. This work includes installation of curb and gutter, storm sewe ,
and pavement. Based on the city's adopted assessment policy, benefiting property
owners are assessed 100% of the cost for this work.
Section 2 - Alley Improvements
The alley west of Fillmore Street is proposed to be reconstructed with curb and gutt ,
storm sewer, and new pavement. The existing parking area on the north side of the IIey
would be retained. Based on the city's adopted assessment policy, benefiting prope y
owners are assessed 1 00% of the cost for this work.
Section 3 - Park Parking Lots
Parking lots are proposed to be constructed for the improvements planned for Hube
Park. Approximately 90 parking spaces would be provided. Parking lots would inclu

curb and gutter, storm sewer, and pavement. The Huber Park project would assume
1 00% of these costs.
Section 4 - Other Water and Electrical Improvements
Water Improvements
Shakopee Public Utilities Commission is considering requiring lateral water main loopi
to First Avenue and Levee Drive in order to improve fire flows for the area. Utilities is
conducting a study to determine what improvements, if any, the additional water main
would have for fire flow. Costs for this work would either be the responsibility of the cit ,
Shakopee Public Utilities, or shared between the two.
Electrical Improvements
There are two electrical improvements proposed as part of this work. First, Shakopee
Public Utilities Commission would underground the power lines running from the end
the alley through Huber Park. The Utilities Commission would fund this work,
The second electrical improvement involves undergrounding the power lines along the
alley. This work would include running new underground service to each of the buildin s
west of Fillmore Street. In 1996, several sets of power lines were undergounded in all Is
in the downtown area, and the cost for burying the power lines was shared between th
Utilities Commission and the city. However, the cost for connecting the service to eac
property was the cost of the property owner. The same cost sharing is proposed for thl
project.
Assessment Costs
The proposed assessment costs for Fillmore Street extension, alley improvements, an
electrical service connection can be found on Appendix B of the feasibility study.
Assessments would be made over a 10-year period.
Work is tentatively scheduled to begin this summer in order to meet the Community B It
Playground build date in October. However, there are questions regarding the water
main looping that may delay the city's ability to prepare construction plans and bid the
project in time for the playground build. If that turns out to be the case, we may end u
constructing a temporary access road and parking area (city cost) for the playground
build.

BACKGROUND
On March 15, 2005 City Council authorized a feasibility study for Fillmore Street
extension and adjacent alley improvements. Bonestroo Rosene and Anderlik underto k
the study as part of their contract for the Huber Park design.
The study was originally scheduled to be reviewed by City Council on May 3, but wa
pulled from the agenda to investigate additional water main, power line undergroundi Ig,
and trunk water charge questions that SPUC raised. The May 3 version only include
cost estimates for the parking lots, alley improvements, and Fillmore Street extensio
This version also includes alley power line undergrounding and water main looping
costs.
I attended the May 16 and June 6 Public Utilities Commission to discuss the water m in
looping, undergrounding, and trunk water charges, and will be returning on June 20 ~ r
further discussion.
DISCUSSION
The feasibility study provides cost estimates and assessment estimates for the folio ng
work related to Huber Park development:
. Constructing Fillmore Street from First Avenue north to the beginning of the park
parking lots.
. Constructing the park parking lots
. Improving the alley behind the businesses west of Fillmore adjacent to the park
. Installing storm water and sanitary sewer systems
. Undergrounding power lines along the alley west of Fillmore
. Extending water main from Bluff Avenue to the park
. Options for looping the water main to Levee Drive and First Avenue.
Project Considerations
There are several items that City Council should be aware of:
1. Proposed Improvements for Fillmore Street Extension
Fillmore Street is proposed to be paved and extended nQrth of First Avenue. The
city's assessment policy, adopted by resolution of the City Council, assesses 100
of the costs for improving gravel roads to adjacent property owners. In this case, t
city would be assessed 50% of the cost of Fillmore Street due to the amount of
frontage, and the two other adjacent property owners would share the other half.
(See Appendix B)
2. Proposed Improvements to the Alley
The alley west of Fillmore Street is proposed to be reconstructed. The city's
assessment policy, adopted by resolution of the City Council, assesses 100% of t l
costs for alley improvements to the adjacent property owners. However, the
feasibility study found that one property, Gesswein, would not benefit from the all y
improvements. (Although the alley has frontage on the property, there is no acce ~
to the alley due to elevation changes.) Therefore, the assessment would be shar
between the remaining four property owners, with the city being assessed 58% 0 he
costs. (See Appendix B)
3. Alley Power Line Under grounding
The power lines on the alley behind the businesses adjacent to Huber Park (west f
Fillmore Street) would be undergrounded as part of this project. In 1996, the City nd
SPUC undertook an alley undergrounding project in the downtown area. The sa
approach is being proposed here.
Using the 1996 formula, the cost for undergrounding the power lines and running
new service to each building would be shared SO/50 between SPUC and the City
The businesses could be assessed for the costs associated with connecting their
service to the new undergrounded service and this work included in the project, 0
they could choose 10 do this work on their own. (It would be more efficient to incl r
this work as part of the project and assess the costs.)
The 1996 project was not without controversy. I did send the business owners a
letter in May outlining the project and the potential assessment costs, but it did n t
include this information. I will be sending them a follow-up letter. There may be I
objections to these costs. (See Appendix B)
4. Parking Lot Construction
The costs for constructing the park parking lot would be 100% city costs and wo
be paid from the Huber Park project budget, estimated at $323,000.
5. Water Main Looping
The Utilities Commission appears to support the established policy of requiring
main looping for new developments north/south and east/west of the project, an
they seem to consider this a "new" development rather than a redevelopment. T
also feel that there may be improved fire flow for the overall area if the water mai
are looped.
There are two water main loops being considered. The first loop would connect
Avenue to Levee Drive ($90,100). The second would connect this water main to
Avenue either at Fillmore Street ($44,000) or the Spencer or Sommerville
intersections ($54,800). If the two loops are ordered by the Commission, the proje
costs could increase up to $144,900.
However, the Commission's final decision is pending due to several items:
. With the proposed comprehensive plan update showing potential mixed use
redevelopment in the First Avenue Corridor, the Utilities Commission directed
their staff to conduct a study on fire flow to determine what effect water main
looping would have in improving fire flow. That study is not yet complete.
. We are not sure whether the County will issue a permit to cut into First Avenu
(CR 101) to connect a north/south water main loop. I have made four calls to
County staff over the past few weeks, but have not received a response.
Finally, the Utilities Commission has not determined whether or not they will shar
costs for this undergrounding.
6. Park Area Powerline Undergrounding
The Utilities Commission has affirmed their previous commitment for providing th
power line undergrounding through the park as a donation to the project. The
previous estimate for this work was $150,000.
7. Trunk Water Charge
The Utilities Commission has not determined what amount of trunk water charge t
will assess for this project, if any. Their Trunk Water Charge policy calls for every
new development to pay a trunk water charge of $1 ,348/acre. The question here
whether or not this is new development (no existing or previous water service) or
redevelopment (existing or previous water service).
I spoke with two individuals that have confirmed there was city water service to th
WPA building (warming house) that use to be located in the park, but the building
was demolished many years ago. If there was water service to the park at one ti
it would be "grandfathered" under the policy, and the trunk water charge not
applicable. SPUC has asked for historical engineering drawings that show this w
service, which we are trying to locate. Also, if you consider the area between the
bridges as part of the park, there is existing water service to the restroom buildin
8. City's Assessment Portion
According to Mr. Voxland, the city's assessments would be paid out of the gener
fund as with other roadway projects that are adjacent to park land (such as Vierli
Drive/Lions Park).
9. Project Timing and Community Built Playground
Work on the power line undergrounding and water main looping has caused dela s
in the feasibility study. In order to meet the Community Built Playground build da s
of October 4-9, we need to disseminate the feasibility study, hold the public heari g,
and proceed with plans and designs as proposed in the study.
At this point, the estimated assessment costs have been determined and identifi in
the feasibility study. The remaining water main looping and trunk water charge c ts
are not assessable costs, although we will want to amend the feasibility study to
reflect the decisions that are made related to these costs.
Finally, I want to note that under the proposed schedule, on July 19 you would ne
to order the project, call for plans and designs to be developed, and authorize
bidding in order to meet the playground build date. This action would be contingen
on the outcome of the public hearing.

Summary
The attached resolution sets a date for the public hearing for this project for July 19,
2005. Approving the resolution and setting the public hearing does not order the proj
nor does it commit the Council to the project. The intent of this resolution is to accept
feasibility study report and set the public hearing date. The public hearing will allow th
property owners adjacent to the project area and the general public the opportunity to
address any concerns with the project.
REQUESTED ACTION
If City Council concurs, it should, by motion, accept Resolution No. 6235, A Resolutio
Receiving a Report and Calling A Hearing for the Fillmore Street Extension and Alley
Improvement Project, Project No. PR2005-3 and move its adoption.

Whereas, pursuant to Resolution No. 6206 of the City Council adopted
March 15, 2005, a report has been prepared on the Fillmore Street Extension
and Alley Improvement Project.
Now therefore be it resolved by the City Council of the City of
Shakopee, Minnesota:
1. The City Council will consider the Fillmore Street Extension and Aile
Improvement project and all appurtenant work in accordance with th
report and the assessment of abutting and benefited property for all r
a portion of the cost of the improvements pursuant to Minnesota
Satatues. Chapter 429 at an estimated total cost of $698,830.
2. A public hearing shall be held on such proposed improvements on J Iy
19, 2005 at 7:00 p.m. or thereafter, in the Council Chambers of City
Hall at 129 South Holmes Street, Shakopee, Minnesota, and the CI k
shall give mailed and published notice of such hearing and
improvements as required by law.

Introduction
On March 15,2005 the City of Shakopee adopted Resolution No. 6209 which ordered 'e
preparation of a feasibility report to analyze the feasibility of placing concrete curb .d
j
gutter, aggregate, bituminous paving, and utilities on Fillmore Street north of lrst
Avenue (County Road 101) to Huber Park, including reconstruction of the existing a tey
adjacent to Huber Park, construction of two parking lots and rough grading of lhe
community built playground area.
These improvements are part of the redevelopment plan for Huber Park, and the rk
associated with this phase is shaded in Figure No. 1 on the next page. This re ort
examines the feasibility and cost effectiveness of the proposed improvem ts.
Descriptions of the proposed improvements are found in the following sections of his
report. Cost estimates and preliminary assessment rolls are provided in the Append es,
and financing considerations are provided in the cost analysis section of this feasi i ity
report.

Proposed Improvements
Street, Alley, Parking Lot
Section 1- Fillmore Street
The street improvements for Fillmore Street relate to constructing curb and gutter d
bituminous paving. Currently, existing Fillmore is a gravel street from First Ave ue
(County Road 101) to the alley at Huber Park. Fillmore will be extended to the nort to
serve the two proposed parking lots.
Fillmore Street is proposed to be constructed at a 28 feet width as measured from fac of
curb to face of curb. A right turn lane is proposed at the intersection with First Ave reo
Because the existing alley to the east of Fillmore Street will no longer be connecte :, a
gravel tum-a-round is proposed. The construction of the new Fillmore Street will dis
the existing emergency access at Bluff A venue. This access will be restored with gra
Sidewalk will be placed adjacent to the west side of Fillmore Street and connect to
existing sidewalk at First Avenue (County Road 101). Figure No.2 on the next
shows the proposed typical section for the improvements.

Section 2 - Alley
The alley improvements involve reconstructing the existing bituminous alley and pIa 'g
curb and gutter and bituminous paving. Currently, the existing alley drains water al ng
an inverted crown in the center and continues to the west to a catchbasin placed in 2 14.
The improvements will bring this drainage to the curb line and then to new and adju ed
storm sewer structures. The curb and gutter is not proposed to be constructed against he
building side of the alley. The new bituminous will match into existing sidewalk nd
frontage in this area.
Striping of new parking stalls and existing parking stalls will be part of the project. he
alley is proposed to be constructed to the same section as Fillmore Street as sho In
Figure No.2.
The costs for the recommended alley improvements are presented in the Cost Ana SIS
section and Appendix A.
Section 3 - Parking Lots
The parking lot improvements involve construction of two parking lots that will serv he
community built playground and other future improvements. The playgroun IS
scheduled for construction in October 2005, and rough grading of the playground is art
of the project. The parking lot improvements include construction of portions 0 he
sidewalk and trail that will connect to existing trails in the area.
Additional fill quantity within the amounts consistent with previously obtained pe its
will be needed for these parking lots, and it is proposed to construct the parking 10 to
the same section as shown in Figure No.2.
The costs for the recommended parking lot improvements are presented in the ost
Analysis section and Appendix A.
Section 4 - Other Water and Electrical Improvements
This section is discussed in the Utility Section of the report.

Utility Improvements
The major utility improvements will be the construction of storm sewer structures nd
piping to convey surface water runoff from the new improvements to the existing st
sewer system in the park. Some of the drainage in the parking lots will be routed to
proposed rainwater filtration basins or gardens in the islands to help improve
quality. Rainwater gardens are becoming more widely-used method in the Metro
for water quality. The gardens were recommended by the Environmental Advi
Commission, and their use in this situation will be evaluated in the final design 0 the
parking lots.
A sanitary sewer and water service will be extended to the future restroom and sto age
building at this time. These utility improvements are shown in Figure No.3 on the lext
page. The sanitary service will be extended from the existing sewer stub placed as p of
the 2004 West River Interceptor Improvements. An existing 6-inch watermain curr j,tly
ends at the hydrant on Bluff A venue. A 4-inch diameter line is proposed to be exte ed
from this location. The size of this water service line will need to be approve by
Shakopee Public Utilities Commission (SPUC).
Due to the poor condition of some of the soils in Huber Park, final design will re " ew
how the utilities are affected by these soils and any trench backfill that is need to
stabilize the piping
City Staff has been reviewing other watermain looping and burying electrical lines ith
SPUC as part of this projecL The specific utility improvements discussed previous f as
well as the possible watermain looping and burying electrical lines are identifi r as
follows:

Other Water Improvements
Shakopee Public Utilities Commission's (SPUC's) Water Policy Manual (Resol on
#783 - March 7, 2005) discusses specific policies on Water Connection Charges (See ~on
J.D. on Page 1-11), Trunk Water Charges (Section J.F.3. on Page 1-12), and Trunk rr
Costs (Section I.FA. on Page 1-13).
In reviewing this policy with SPUC Staff, looping the watermain along with this pr ect
has been discussed. SPUC is currently performing a fire flow study in making a deci lion
on the watermain looping. Huber Park has portions of the park located in the Minn ota
River floodplain and has had water service in the past (hockey rink and possible ,oy
Scout log cabin). These issues and how this past service affects water conne ,ion
charges, trunk water charges, and costs for watermain looping for the seasonal restr om
are still being discussed with SPUC Staff.
At this time, three alternative water main loops are included in the report. The first ' op,
Alternative 1, extends 6-inch diameter water main from Bluff Avenue to First Aven on
Fillmore Street. The second loop, Alternative 2, extends 8-inch diameter water ain
through Huber Park from Bluff A venue to the area near the MNDOT Bridge/D wis
A venue. This second loop should be discussed as it relates to improving fire flow' for
the downtown area as part of proposed redevelopment. The third loop, Alternati 3,
extends 8-inch diameter water main from Bluff Avenue to First Avenue via Sp cer
Street.
The costs for the recommended utility improvements are presented in the Cost An
section and Appendix A.
Electrical Improvements
In discussions with SPUC Staff, burying the overhead wiring in the area of the all y to
the west of Fillmore Street was not part of the original scope of the project for ber

Park estimated at $150,000. Burying the overhead wiring in this location would ~so
require burying of electrical service lines to the individual business properties along r
project.
The costs for the recommended electrical improvements are being reviewed by S C
Staff based on past project histories including the 1996 alley undergrounding proj let.
The costs are presented in the Cost Analysis section and Appendix A.

Easements and Permits
Almost all of the work is proposed to be done within City right-of-way or prope ,
however some areas of the existing parking stalls in the alley fall outside of the a ey
right-of-way. Permission in the form of a right of entry will be needed from the adja I
F
property owners to reconstruct this area outside of the right-of-way. If this right of e
cannot be obtained, then the work would need to be adjusted to stay within the exis Ing
alley right-of-way. Costs associated with right of entry acquisition would be include in
the project costs and assessed.
Work in the right-of-way of First Avenue (County Road 101) will require a permit fi ,m
Scott County. Work under Alternate 2 Water Main looping to the west end of H
Park will require a permit from MNDOT. Due to the size of the project, a General St
Water Permit for Construction Activity will be needed from the MPCA. Approval 0
proposed water service extension will be needed from the Shakopee Public Utilities.

Cost Analysis
The estimated costs of the proposed improvements are summarized in Table 1 nd
Appendix A. The costs in Appendix A include 10% for contingencies and 25% or
indirect costs.

A portion of the proposed Fillmore Street Extension and Alley Improvements are
proposed to be assessed to adjacent properties, including costs associated with conveI t::
individual electrical service lines from above ground to underground. The City's pc I
is to assess 100% of the proposed improvements, and preliminary assessment rolls rre
presented in Appendix B based on this policy. Property owners could choose to do he
underground electrical service conversion separate from the project.
It is anticipated that storm sewer improvements that are not assessed, water service, md
sewer service will be funded by combinations of the General Storm Sewer Fund nd
Huber Park project funding. The remaining alternate water main looping, buryin of
electrical lines in the alley, and possible water connection charge ($2,300 per equiv~ ent
SAC unit) and trunk water charges ($1,348 per acre) will require further discus 'on
between SPUC and the City of Shakopee. At this time, it is anticipated that the cost for
burying the electrical lines (not including service lines) will be split 50%/50% by S UC
and the City.

As discussed above, it is proposed to assess benefit for the street and alley improvem ts
including storm sewer on a front footage basis in accordance to the City's Policy. he
estimated amount of assessable front footage for Fillmore Street and the aIle IS
approximately 560 and 519 feet, respectively. This results in the following:

Recommendations and Conclusions
The improvements described in this report are feasible from and engineering standp rt.
This project is necessary to provide access, parking, and utility improvements to H her
Park and adjacent properties. The project is cost effective based on conditions nd
acceptable standards proposed to construct the improvements.
The estimated cost of the improvements is $698,830 based on Alternate No.1 a I 2
watermain looping. The following recommendations are presented for consideratio of
Shakopee City Council and Staff:
1. That the improvements presented herein be considered for 2005 constructio . If
all the improvements were completed including water main looping alternati s 1
and 2, the cost is estimated at $698,300.
2. That the City Council review assessing the benefited properties in accord
with the City's assessment policy and as described herein, with the City revie
the percentage used for the assessment. Under Chapter 429, the City is limit in
assessing the benefit of the improvements to the adjacent properties and sh uld
review this based on the City policy.
3. That a public hearing be held to discuss the proposed improvements nd
assessments.
4. That the City review the improvements in the alley parking area outside 0 the
alley right-of-way with the adjacent property owners and get permissi to
reconstruct this area.
5. The City should finalize discussions with SPUC on this Park Project and the sts
associated with water main looping and burying of overhead electric lines.

Re: Huber Park Playground Committee Update
Dear Mayor & Council Member's & City Staff
This is an update on our committee's progress in regard to the H ber
Park Playground. Enclosed is a copy of our Informational Major
Donor Packet for your review.
Our Committee Head's continue to work full steam ahead for ou
build date of Oct 4_9th, this fall. On July 28th, we are holding our
Organizational Day at the Community Center. We invite each you
to learn more about this effort and get more information. This d y, is
a set of all day meetings design to bring everybody up to date. ur
consultant's, Leathers & Associates will be in town to conduct t se
meetings. Our meetings will start with a site review and then b
followed by Committee Head briefings and a round upl overvie
5pm. This will set the final pace of activity for the last 60 days.
We continue to meet with Mark Themig in regard to the tempor ry
plans for a parking lot and material storage area to be in place head
of our community build. We have agreed that this temporary si I~ation
will work of our playground plans.
Also as of day, we very pleased to have community commitm
some $82,000 towards our goal of $140,000. While much mo
remains, we feel confident that this goal will be meet ahead of
build date.

This is a complete community project, which includes a strong
commitment on behalf of the City of Shakopee, to make Huber P
our Community Focal Point for all of its residents and visitors. Th
Huber Park Community Playground thanks you, the City Council r
its effort to restore this historic park. Along with all of our involve
citizens who are working to make this vision and dream become
reality. We are bless here in Shakopee with very strong Commu
and Business partners that have given so much of them selves
towards this one of a kind playground.

This informational packet is intended to introduce you and your
organization to Shakopee's efforts to revitalize historic Huber Par
Huber Park is located adjacent to Shakopee's Downtown district.
Located on the Minnesota River front, Huber Park is a park of mu ~
history here in Shakopee. Shakopee is known as a river town
community, with rich history of trade and commerce on the riverfr t
dating back over 100 years. Huber Park was once "The Place To e"
in Shakopee, including a skating rink, a sliding hill, a rodeo area, d
was a focal point for our community. This was a park where
residents and visitors gathered to enjoy family, the riverfront and j st
enjoy the great outdoors. After over 25 years of inactivity, Huber I
Park is being revitalized in an effort to reclaim and celebrate our
historic riverfront roots. I
The revitalization of our riverfront is not a new idea to communiti~J in
Minnesota. Red Wing, Hasting, Stillwater, Duluth, Chaska all ha $
embraced there riverfronts or lake fronts. Or, as I like to say UTa ihg
Back Our Riverfronts". While building a sense of community prid and
creating a community focal point for all to experience and enjoy.
Today, after 5 years of visioning, planning and site plan selection We
are on the cusp of something very speCial. Our community resid ts,
task forces, consultants, civic groups, civic leaders and our City
Council has embraced the Huber Park Master Communi Park
which I present to you today. (Exhibit # 1).
The Huber Park Master Plan has so very much to offer all our
residents and visitors to our community.

I represent the Community Built Playground. I am the Chairman
the Major Donor Finance Committee for the Community Built
Playground. For the past 15 years I have been an active commu
servant here in Shakopee, serving on Shakopee's Community
Development Commission, the Planning Commission, as its May
and now serve on the Shakopee Public Utilities Commission. I c Ie a
great deal about our community and believe strongly in giving ba to
our community in which we live, work and play. I have an old say
that applies to most everything in life and it goes like this, in eve
facet of your life, "Put In As Much As You Take Out".
This is where you and your organization can help and "Give Back lto
your community. These one of a kind playgrounds are not cheap
today's dollars. It is our goal to raise $140,000.00 for this project.
You may have seen or even played on one of these castle like pi '
structures in other communities across Minnesota. Lakeville,
Burnsville, Duluth, Waconia, just to name a few, all have built the
popular playgrounds. These structures have been very successf
and have created a sense of pride within each community.
This past fall we held a highly successful Design Day for this
playground. We sent our teams out to involve and engaged over
4000 of our own Shakopee elementary students. We listened,
explored, and incorporated all of their great ideas into a Master P an
of dreams. With the help of nationally known, Leathers & Associ fes.
We now have a playground design that was Imagined by Kids for;
Kids. (Exhibit #2).
As of today, we have the Huber Park Master Plan supported by a of
the stakeholders and we have a final design of a one of a kind, 2
365 days a year Playground as one of the first major draw and
component of Huber Park.

This playground is a total community effort. From the readiness r
the infrastructure within the park, to the design aspect, we stand I
ready to go.
Community volunteers will build this playground, this fall, October th
through October 9th. This project will be like an old fashion barn
raising. It will bring out the very best Shakopee has to offer.
Residents, volunteers, businesses, neighbors coming together,
working side by side as one, getting to know one another and ma ing
new friends. Working towards a common goal-to build this
Playground, to build pride and most of all Building a Sense of
COMMUNITY.
We ask for your help and need your help to make this dream bec me
a reality. We need your financial resources and we need your
volunteerism.
There are many, many ways you and your organization can help.
All donors both large and small will be recognized on our donor
board. As I mentioned before our goal is to raise $140,000.00.
