The subject parcel is a sliver ofland that w inadvertently omitted in previous annexation approvals. A copy of the petition, as well as report the July 7,2005, report to the Planning Commission is attached for the Council's informati ALTERNATIVES: 1. Close the public hearing, and adopt an ordinance approving the annexation. 2. Close the public hearing and direct staff to prepare a resolution denying the petition for annexation based on specific findings of fact for consideration at the August 3, 2005 m ting. 3. Close the public hearing, but table the petition for additional information. 4. Continue the public hearing for additional information. PLANNING COMMISSION REVIEW: The Planning Commission reviewed the proposed annexation at its meeting of July 7,2 unanimously recommended approval ofthe annexation. ACTION REQUESTED: Offer a motion to approve Ordinance No. 734, approving the annexation ofthe subject p and move its adoption. Julie Klima Planner II h:\cc\2005\07 -19\annexationtollefson050n.doc ORDINANCE NO. 734, FOURTH SERIES AN ORDINANCE RELATING TO THE ANNEXATION OF CERTAIN PROPERTY THE CITY OF SHAKOPEE, MINNESOTA, HEREBY ORDAINS AS FOLLOWS: Section 1 - The City Code is amended by adding a new section to read: Section 2 - The City Council hereby finds that Tollefson Development, filed a pro prepared Petition requesting the annexation to the City of Shakopee of real property loc Jackson Township, Scott County, State of Minnesota, legally described as found on atta Exhibit A: Section 3 - The City Council hereby finds that the property is not included in bo adjustment proceeding pending before the Minnesota State Planning Agency. Section 4 - The City Council hereby determines and finds as follows; 1. That the subject properties abut the City of Shakopee; 2. That the properties proposed to be annexed are not presently served by publi facilities, and that public sewer facilities are not otherwise available to the s properties; 3. That the City of Shakopee has received a properly prepared Petition for ann from all of the owners of the subject properties; and 4. That the area is appropriate for annexation by ordinance under Minn. Stat. S 414.033, Subd. 2, and that the Petition complies with all of the provisions of 414.033, as well as the provisions of the Orderly Annexation Agreement bet City of Shako pee and Jackson Township. Section 5 - The subject properties are urban or suburban in nature or about to b Section 6 - Pursuant to law, a public hearing was scheduled, with proper notific and held on July 19, 2005, prior to Council consideration of this ordinance for annexati Section 7 - The corporate limits of the City of Shako pee are hereby extended to i clude the subject properties, and the same is hereby annexed to and included within the City ofS opee as if the property originally been part thereof. Section 8 - The City Clerk is directed to file certified copies of this ordinance with he Minnesota State Planning Agency, Jackson Township, the Scott County Auditor-Treasure, and the Minnesota S~cretary of State. Section 9 - This ordinance takes effect upon its passage and publication and filing f certified copies as directed in Section 8 and approval of the ordinance by the Minnesota State PI g Agency. II 07 ,0 ,IAU CITY OF SHAKOPEE 1 Memorandum CASELOG NO.: 05-072 TO: Shakopee Planning Commission FROM: Julie Klima, Planner II SUBJECT: Petition of Tollefson Development for the Annexation of Land loc ted in Jackson Township MEETING DATE: July 5, 2005 INTRODUCTION: The City received a petition dated April 22, 2005 from Tollefson Development for the ann .18 acres ofland from Jackson Township into the City of Shako pee. On July 19, 2005 the will hold a public hearing on the requested annexation. A copy of the petition is attached Commission's information. The Commission is asked to provide a recommendation to th Council on whether the City should proceed with annexation of the subject property. DISCUSSION: The City's adopted Land Use Plan identifies this area for single-family density developme . This designation was based on direction received from Council in the course of previous discus ons between the Township and the City. The City recently submitted and received approval of a Comprehensive Plan Amendment the Metropolitan Council for this area. The Comprehensive Plan Amendment guides the prop for single family residential development. The subject property is proposed to be part of the Countryside development that has receiv f approval from the City. The Scott County Recorders Office found that the original annex on petition for the Countryside project area inadvertently omitted this sliver of property. The ity has not received any adverse comments to the proposed annexation. ALTERNATIVES: 1. Recommend to the City Council that the proposed annexation proceed. 2. Recommend to the City Council that the proposed annexation not proceed at this time. 3. Continue the item for additional information.
