Memorandum CASELOG NO.: 05-083 CONSENT TO: Mayor and City Council Mark McNeill, City Administrator FROM: Mark Noble, Planner I SUBJECT: Final Plat of River Valley Estates 1 st Addition MEETING DATE: July 5,2005 REVIEW PERIOD: May 26, 2005 - September 23, 2005 DISCUSSION Pulte Homes has made application for Final Plat approval of River Valley Estates 1st Addition. The property is located north of Valley View Road and west ofCSAH 83 (Exhibit A). The preliminary plat was approved on February 15, 2005; at that time it was known as Park Meadow East. The property is approximately 40 acres in size, with 6.3 acres being dedicated for right-of-way and 24 acres dedicated as an outlot and reserved for future development. The plat proposes the creation of 29 single family residential lots in this first addition, with 50 lots proposed in future phases (Exhibit B). Although the developer has proposed a development with fewer lots than shown on the preliminary plat, it is still in substantial conformance with the approved preliminary plat, which had shown 92 lots. The developer proposes to save 16 trees and plant 257 new trees, which would exceed the minimum requirements of the Woodland ordinance. A large number of the proposed trees will be planted along CSAH 83 and Valley View Road, which will help minimize the noise impacts on this development from these roads. Jeff Weyandt, Assistant City Engineer, and Ryan Hughes, Natural Resource Specialist, have provided memoranda noting their recommendations (Exhibits C & D), which have been attached for Council's review and incorporated into the draft resolution. Additionally, Shakopee Public Utilities Commission (SPUC) provided comments that have been incorporated into the draft resolution. Jim Grampre, Building Official, commented that if approved, temporary street signage will be required and the permitted lots shall be accessible. The Finance Department noted that there are pending assessments for thi~ property in the amounts of$132,670.51 and $13,930.29; these amounts are estimates and are subject to change. ALTERNATIVES 1. Approve Resolution No. 6270, a resolution approving the final plat of River Valley Estates I st Addition, as presented. , 2. Direct staff to prepare a resolution denying the request for final plat approval. 4. Take no action, and leave the item on the table. STAFF RECOMMENDATION Staff recommends Alternative No.1, approve the final plat of River Valley Estates 1st Addition as presented. ACTION REQUESTED Offer a motion to approve Resolution No. 6270, a resolution approving the final plat of River Valley Estates 1 st Addition as presented, and move its adoption. RESOLUTION NO. 6270 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF RIVER V ALLEY ESTATES FIRST ADDITION WHEREAS, Pulte Homes of Minnesota Corporation, applicant and property owner, has made application for final plat approval of River Valley Estates First Addition; and WHEREAS, the subject properties are legally described as: The Southeast Quarter ofthe Southwest Quarter, Section 16, Township 115 North, Range 22 West, Scott County, Minnesota, excepting that part of the abandoned right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, the centerline of said right-of-way as shown on survey of Railroad Tracks, by the Scott County Surveyor and Recorded as Document No. 178639, AND That part of the abandoned right-of-way of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, the centerline of said right-of-way as shown on survey of Railroad Tracks, by the Scott County Surveyor and Recorded as Document No. 178639, located in the Southeast Quarter of the Southwest Quarter, Section 16, Township 115 North, Range 22 West, Scott County, Minnesota; and WHEREAS, the Shakopee Planning Commission conducted a public hearing on the preliminary plat on January 6 and February 3,2005; and WHEREAS, all required public notices regarding the public hearing were posted and sent; and WHEREAS, the Shakopee Planning Commission has recommend approval of the preliminary plat; and WHEREAS, the City Council reviewed and approved the preliminary plat request at its meeting of February 15, 2005. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: I. The following procedural actions must be completed prior to the recording of the Final Plat: A. Approval of title by the City Attorney. B. Execution of a Developers Agreement, which shall include provisions for security for public improvements within the Final Plat, $150,000 for the developer to contribute toward the construction of sanitary sewer facilities north of the site, and any engineering review fees as required by the City's adopted fee schedule. I. Provided the City extends the trunk sanitary sewer facilities along CSAH 83 to this property, the developer shall contribute cash for that project in lieu of providing a sanitary lift station and force main for the future phase(s) of River Valley Estates. 2. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 5. Installation of sanitary sewer and storm sewer systems, and construction of streets in accordance with the requirements ofthe Design Criteria and Standard Specifications ofthe City of Shakopee. 6. The developer shall be responsible for payment of Trunk Storm Water Charges, Trunk Storm Water Storage and Treatment Charges, and Trunk Sanitary Sewer Charges, as required by the most current City of Shakopee Fee Schedule. 7. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utility Commission approve the Final Construction Plans and Specifications. 8. The entire pond, including the infiltration system, shall be completed as part of the I st Addition improvements. 9. The applicant shall pay the assessment for the reconstruction of Valley View Road adjacent to this property and shall waive and release the right to appeal the assessment. 10. A storm water infiltration system design providing pretreatment of storm water runoff prior to infiltration shall be submitted to the City for review and approval. II. The applicant shall obtain all necessary right-of-way and/or easements to perform work offsite. 12. The applicant shall obtain the necessary Scott County permits/approvals (right-of-way, drainage, etc.). 13. The applicant shall meet the park dedication requirement by providing cash in lieu of land dedication. 14. Sidewalks and trails shall be provided throughout the site as proposed. 15. Park dedication fees in the amount required by the City Code and adopted City fee schedule shall be paid prior to the recording of the final plat. If any portion ofthe property is being platted as outlots to accommodate a phased development, the park dedication fees for each future phase shall be based on the fees in effect at the time of final plat approval for those outlots and shall be paid before the final plat for those outlots is recorded. C. The applicant shall revise the scale on sheets G2 and G3. D. Temporary street signs shall be provided until such time that permanent street signs are installed. E. Permitted lots shall be accessible, consistent with the Building Official's requirements. F. Provide electronic (Auto CAD) files ofthe Final Plat to the City Engineering Department. G. A 20 foot drainage and utility easement along the reallot line of Lots 2 and 3, Block 5, Park Meadows First Additions shall be filed prior to recording the plat. H. Easements shall be shown on the Final Plat as approved by the City Engineer. They shall include, but not be limited to, the following: a. Provide a total of 30 feet of drainage and utility easement centered on the lot line between Lots 3 and 4 of Block 5. b. Provide a drainage and utility easement over Outlot A. I. The plat shall show all easements on all lots. J. Simultaneous to the recording of the Final Plat, a deed restriction shall be recorded on the following lots: a. Block 1: Lots 1-2. b. Block 2: Lots 1-4. c. Block 4: Lots 2-3 d. Block 5: Lots 1-13. The Deed Restriction shall appear as the following: This conveyance is made conditioned upon and subject to the following restriction. The Grantee, heirs, successors and assigns, are restricted from erecting any fence or other structure within the utility and drainage easements dedicated by plat over the above-described property, except with the prior written consent of the City of Shako pee. This restriction shall run in favor of and be enforceable by the City of Shako pee. K. The applicant shall have an approved storm water management plan, including infiltration, prior to recording the plat. II. Following approval and recording of the final plat, the following conditions shall apply; A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s). B. Noise issues along the County roadways may arise as traffic levels increase in the area. The developer and/or their assigns shall be responsible for any required or desired noise mitigation measures. C. The developer and/or their assigns shall be responsible for the maintenance of all areas held in common ownership. D. The existing overhead electric power line along Valley View Road will be required to be relocated. E. The developer should implement the use of Best Management Practices for erosion control and stormwater management during construction. F. Provide placement of at least one overstory/shade deciduous tree in the front yard. G. Provide sod placement in front yard and seed or sod placed in side and rear yards. H. Provide placement of6" of topsoil. The soil composition should be similar to the MnDOT topsoil borrow requirements. I. Provide rain sensors for any irrigation system. J. Replace all proposed Northern Pin Oak with Hackberry and/or a suitable replacement approved by the City. K. The existing field access to this property off of CSAH 83 shall be completely removed from the County right-of-way and graded to match the existing ditch. L. No landscaping, ponding, berming, or signage shall be permitted within the County right-of-way. M. Any change in drainage entering the County right-of-way requires detailed stormwater calculations to be submitted to the County Engineer for review and approval. N. After reviewing the above referenced application, we have the following comments for the applicant and the planning department: General 1. February 3, 2004 Preliminary Plat Approval: (Please review the February 22, 2004' memo I wrote you to correct Michael Leek's version of my testimony at the January 8,2004 Planning Commission meeting.) I had picked up a copy of the packet information that you receive from City staff. It contained a Resolution and staffs recommendation for you to deny the preliminary plat. If I had been told there was a subsequent memo for the table at this meeting, even though I was hospitalizing Mom, I could have sent a representative to watch out for my interests. As you may recall, this is the meeting where you realized you had just , approved a revised plat that you had not seen! You asked if the Council wanted to reconsider the approval vote and they chose not to do that. June 15, 2004 Final Plat Approval: I had been consulting with an independent person for their opinion about the drainage area that borders the entire west side of my property. I met with him on May 3. Among other things, he requested Grading Plans. I picked up the March 10, 2004 version from Joe Swantek. My records show May 19 as the date I gave them to my consultant. I received the enclosed memo written by Julie KUma, postmarked May 27,2004, from Joe Swantek. I called my consultant ana told him there were revisions to the grading plan that would make reviewal of the plans I had provided him a waste of his time, and I would bring him the updated version when I got it. Joe Swantek delivered the June 8, 2004 version of the grading plans to me around noon on June 14, making it too late to bring to the consultant. So when Michael Leek stated "They made an offer to her to prOvide Preliminary Plans of Grading and Drainage. She opted to receive the final plan, rather than interim versions., he was seriously misleading you. He also neglected to mention my concerns regarding the effect of continuous seepage coming out of their drainage area on crops. The minutes of that meeting do not reflect that either. I was unable to attend your June 15, 2004 meeting. There was a milestone family event planned for that date and I was the one hosting it. I could not back out of this obligation that had been planned far in advance. I try very hard to obtain up-to-date information on my own because, from experience, staff does not let me know what is happening "next door" to me. Another example of this is that a second final plat was approved for Park Meadows that I did not find out about until I recently requested the information you had received for your February 15, 2005 meeting. , . Koehnen Memorandum Dated July 2, 2005 Regarding "Park Meadows Plat" DATE: July 5, 2005 GENERAL: This memorandum is provided in response to Ms. Koehnen's July 2,2005 memo. In that memorandum she alleges that City staffhas ".. . sabotaged. .." her efforts to be heard, while apparently trying to obscure those efforts at sabotage. I will clearly state for the record that neither I nor any other member of the City staffhas knowingly sabotaged Ms. Koehnen's efforts to be heard in regards to the preliminary or final plats of Park Meadows. Indeed, I believe staffhas made a good faith effort to afford Ms. Koehnen all reasonable opportunities to be heard. I believe further that the record clearly reflects that Ms. Koehnen not only had meaningful opportunities to address her concerns to the Planning Commission and. City Council, but that both she and City staffhad kept the City Council apprised of her numerous concerns and the steps taken to address them. Ms. Koehnen alleges in connection with the final plat action taken by the City Council on June 15,2004, that I seriously mislead the Council regarding her concerns about the final plat. The information I provided at that meeting was information I had received from engineering and the project manager, Julie Klima, regarding Ms. Koehnen's request for a copy of the final grading plan, and was provided to the Council in good faith. Finally, Council should note that Ms. Koehnen's memorandum is silent on the numerous phone calls and counter visits that both planning and engineering staff members fielded throughout the process that eventually led to the approval of the preliminary and final plat of Park Meadows. I will attempt to address the specific approvals as laid out in Ms. Koehnen's memorandum: February 3, 2004 Preliminary Plat Approval (park Meadows): . December 4, 2003 - At staffs request, the public hearing before the Planning Commission was continued to January 8, 2004. January 8, 2004 - The continued public hearing was held, closed, and the Planning Commission acted to recommend to the City Council denial of the preliminary plat. Ms. Koehnen testified at the public hearing regarding the following; ". ..she did not think what was presented for a drainage area was sufficient. She stated if the drainage was not done right her property would be under water. She also was concerned about the trail that was not going to be used as a trail and she thought far too many people were being crammed into to small of a space. She was most concerned about the drainage issue. She felt the City needed to take time and analyze this problem; there was significant drainage in that area and the City needed to be sure that the drainage was done correctly. She was asking that this preliminary plat not be approved tonight. (From the minutes of the January 8, 2004 Planning Commission meeting) . February 3, 2004 - The minutes of this meeting reflect the report that I provided that evening, as well as the status of the concerns that had been raised at the Planning Commission. Council will note that the one remaining issue of concern for the Planning Commission was Thrush Street, and that by the February 3rd meeting that issue had been addressed. Mr. Leek, Community Development Director, reported on the Preliminary Plat for Park Meadows located North of Valley View Road and east of Staghorn Drive. Mr. Leek noted there was a memo on the table tonight regarding this preliminary plat. Mr. Leek noted that there had been m()vement on this plqt and there now was an agreement with the adjacent property owners as to the alignment of Thrush Street. A letter was also on the table noting the willingness of the adjacent property owner, Shako pee Gravel, Inc. and the applicant to have this preliminary plat move forward. Mr. Leek noted the particulars of the land swap between Shako pee Gravel, Centex Homes and Gonyea Land Company that would need to be agreed to in specifics but Resolution No. 6001 before the council tonight provided conditions that assured this would occur or the plat would not be recorded. Mr. Leek highlighted three items with which he spoke to Ms. Beverly Koehnen, an adjoining property owner, about. These issues regarded the proposed trail, drainage and the impact of ground water contamination. He noted the trail did not end at the beginning of Ms. [Keohnen 's] property and it was his understanding this trail was not going to be constructed initially; this trail was proposed to provide a connection to the properties to the east in the future. The trail would be graded but there would be no asphalt laid down. City Engineering staff and WSB & Associates, Inc. had very carefully looked at the drainage plans and were comfortable with the developers I plans. Mr. Leek noted there was no evidence of ground water contamination at this time; SPUC was having the water at the Shako pee gravel pit monitored regularly checking for ground water contaminants. The Community Development Secretary sent Ms. Koehnen a letter dated March 31, 2004 letting Ms. Koehnen know that a final plat application for Park Meadows had been received, and informing her that Planner II Julie Klima could be contacted to answer questions about the application. . May 18,2004 - Consideration of the fmal plat of Park Meadows was tabled by the City Council. The staff report, prepared by the author of this report, specifically noted that additional drainage calculation information was expected to be received by Engineering on May 11 th, and that it was not expected that Ms. Koehnen would have a reasonable amount oftime to review the information. . June 1, 2004 - The staff report noted that additional information had been received on May 24, 2004, and that there had not been sufficient time to review it. For that reason, staffhad requested that the item be removed from the table, and be re-tabled. . June 15, 2004 - The memorandum to Council notes, on information provided by engineering staff, that Ms. Koehnen had requested a copy of the final grading plans. //~~ R.
