INTRODUCTION
City Council is asked to accept Resolution No. 6235, A Resolution Receiving a Report
and Calling for a Hearing on the Fillmore Street Extension and Alley Improvements,
Project No. PR2005-3, and move it's adoption.
BACKGROUND
On March 15, 2005 City Council authorized a feasibility study for Fillmore Street
extension and adjacent alley improvements. Bonestroo Rosene and Anderlik undertook
the study as part of their contract for the Huber Park design.
The study was originally scheduled to be reviewed by City Council on May 3, but was
pulled from the agenda to investigate additional water main, power line undergrounding,
and trunk water charge questions that SPUC raised. The May 3 version only included
cost estimates for the parking lots, alley improvements, and Fillmore Street extension.
This version also includes alley power line undergrounding and water main looping
costs.
I attended the May 16 and June 6 Public Utilities Commission to discuss the water main
looping, undergrounding, and trunk water charges, and will be returning on June 20 for
further discussion.
DISCUSSION
The feasibility study provides cost estimates and assessment estimates for the following
work related to Huber Park development:
. Constructing Fillmore Street from First Avenue north to the beginning of the park
parking lots.
. Constructing the park parking lots
. Improving the alley behind the businesses west of Fillmore adjacent to the park
. Installing storm water and sanitary sewer systems
. Undergrounding power lines along the alley west of Fillmore
. Extending water main from Bluff Avenue to the park
. Options for looping the water main to Levee Drive and First Avenue.
Project Considerations
There are several items that City Council should be aware of:
1. Proposed Improvements for Fillmore Street Extension
Fillmore Street is proposed to be paved and extended north of First Avenue. The
city's assessment policy, adopted by resolution of the City Council, assesses 100%
of the costs for improving gravel roads to adjacent property owners. In this case, the
city would be assessed 50% of the cost of Fillmore Street due to the amount of
frontage, and the two other adjacent property owners would share the other half.
(See Appendix B)
2. Proposed Improvements to the Alley
The alley west of Fillmore Street is proposed to be reconstructed. The city's
assessment policy, adopted by resolution of the City Council, assesses 100% of the
costs for alley improvements to the adjacent property owners. However, the
feasibility study found that one property, Gesswein, would not benefit from the alley
improvements. (Although the alley has frontage on the property, there is no access
to the alley due to elevation changes.) Therefore, the assessment would be shared
between the remaining four property owners, with the city being assessed 58% of the
costs. (See Appendix B)
3. Alley Power Line Undergrounding
The power lines on the alley behind the businesses adjacent to Huber Park (west of
Fillmore Street) would be undergrounded as part of this project. In 1996, the City and
SPUC undertook an alley undergrounding project in the downtown area. The same
approach is being proposed here.
Using the 1996 formula, the cost for undergrounding the power lines and running
new service to each building would be shared 50/50 between SPUC and the City.
The businesses could be assessed for the costs associated with connecting their
service to the new undergrounded service and this work included in the project, or
they could choose to do this work on their own. (It would be more efficient to include
this work as part of the project and assess the costs.)
The 1996 project was not without controversy. I did send the business owners a
letter in May outlining the project and the potential assessment costs, but it did not
include this information. I will be sending them a follow-up letter. There may be
objections to these costs. (See Appendix B)
4. Parking Lot Construction
The costs for constructing the park parking lot would be 100% city costs and would
be paid from the Huber Park project budget, estimated at $323,000.
5. Water Main Looping
The Utilities Commission appears to support the established policy of requiring water
main looping for new developments north/south and east/west of the project, and
they seem to consider this a "new" development rather than a redevelopment. They
also feel that there may be improved fire flow for the overall area if the water mains
are looped.
There are two water main loops being considered. The first loop would connect Bluff
Avenue to Levee Drive ($90,100). The second would connect this water main to First
Avenue either at Fillmore Street ($44,000) or the Spencer or Sommerville
intersections ($54,800). If the two loops are ordered by the Commission, the project
costs could increase up to $144,900.
However, the Commission's final decision is pending due to several items:
. With the proposed comprehensive plan update showing potential mixed use
redevelopment in the First Avenue Corridor, the Utilities Commission directed
their staff to conduct a study on fire flow to determine what effect water main
looping would have in improving fire flow. That study is not yet complete.
. We are not sure whether the County will issue a permit to cut into First Avenue
(CR 101) to connect a north/south water main loop. I have made four calls to
County staff over the past few weeks, but have not received a response.
Finally, the Utilities Commission has not determined whether or not they will share in
costs for this undergrounding.
6. Park Area Powerline Undergrounding
The Utilities Commission has affirmed their previous commitment for providing the
power line undergrounding through the park as a donation to the project. The
previous estimate for this work was $150,000.
7. Trunk Water Charge
The Utilities Commission has not determined what amount of trunk water charge it
will assess for this project, if any. Their Trunk Water Charge policy calls for every
new development to pay a trunk water charge of $1 ,348/acre. The question here is
whether or not this is new development (no existing or previous water service) or
redevelopment (existing or previous water service).
I spoke with two individuals that have confirmed there was city water service to the
WPA building (warming house) that use to be located in the park, but the building
was demolished many years ago. If there was water service to the park at one time,
it would be "grandfathered" under the policy, and the trunk water charge not
applicable. SPUC has asked for historical engineering drawings that show this water
service, which we are trying to locate. Also, if you consider the area between the two
bridges as part of the park, there is existing water service to the restroom building.
8. City's Assessment Portion
According to Mr. Voxland, the city's assessments would be paid out of the general
fund as with other roadway projects that are adjacent to park land (such as Vierling
Drive/Lions Park).
9. Project Timing and Community Built Playground
Work on the power line undergrounding and water main looping has caused delays
in the feasibility study. In order to meet the Community Built Playground build dates
of October 4-9, we need to disseminate the feasibility study, hold the public hearing,
and proceed with plans and designs as proposed in the study.
At this point, the estimated assessment costs have been determined and identified in
the feasibility study. The remaining water main looping and trunk water charge costs
are not assessable costs, although we will want to amend the feasibility study to
reflect the decisions that are made related to these costs.
Finally, I want to note that under the proposed schedule, on July 19 you would need
to order the project, call for plans and designs to be developed, and authorize
bidding in order to meet the playground build date. This action would be contingent
on the outcome of the public hearing.

Summary
The attached resolution sets a date for the public hearing for this project for July 19,
2005. Approving the resolution and setting the public hearing does not order the project,
nor does it commit the Council to the project. The intent of this resolution is to accept the
feasibility study report and set the public hearing date. The public hearing will allow the
property owners adjacent to the project area and the general public the opportunity to
address any concerns with the project.
REQUESTED ACTION
If City Council concurs, it should, by motion, accept Resolution No. 6235, A Resolution
Receiving a Report and Calling A Hearing for the Fillmore Street Extension and Alley
Improvement Project, Project No. PR2005-3 and move its adoption.

A Resolution Receiving a Report and Calling A Hearing
for the Fillmore Street Extension and
Alley Improvement Project, Project No. PR2005-3.
Whereas, pursuant to Resolution No. 6206 of the City Council adopted
March 15, 2005, a report has been prepared on the Fillmore Street Extension
and Alley Improvement Project.
Now therefore be it resolved by the City Council of the City of
Shakopee, Minnesota:
1. The City Council will consider the Fillmore Street Extension and Alley
Improvement project and all appurtenant work in accordance with the
report and the assessment of abutting and benefited property for all or
a portion of the cost of the improvements pursuant to Minnesota
Satatues Chapter 429 at an estimated total cost of $698,830.
2. A public hearing shall be held on such proposed improvements on July
19, 2005 at 7:00 p.m. or thereafter, in the Council Chambers of City
Hall at 129 South Holmes Street, Shakopee, Minnesota, and the Clerk
shall give mailed and published notice of such hearing and
improvements as required by law.
Adopted in session of the City Council of the City of
Shakopee, Minnesota, held this day of ,2005.

Introduction
On March 15,2005 the City of Shakopee adopted Resolution No. 6209 which ordered the
preparation of a feasibility report to analyze the feasibility of placing concrete curb and
gutter, aggregate, bituminous paving, and utilities on Fillmore Street north of First
A venue (County Road 10 1) to Huber Park, including reconstruction of the existing alley
adjacent to Huber Park, construction of two parking lots and rough grading of the
community built playground area.
These improvements are part of the redevelopment plan for Huber Park, and the work
associated with this phase is shaded in Figure No. 1 on the next page. This report
exammes the feasibility and cost effectiveness of the proposed improvements.
Descriptions of the proposed improvements are found in the following sections of this
report. Cost estimates and preliminary assessment rolls are provided in the Appendices,
and financing considerations are provided in the cost analysis section of this feasibility
report.

Section 1 - Fillmore Street
The street improvements for Fillmore Street relate to constructing curb and gutter and
bituminous paving. Currently, existing Fillmore is a gravel street from First Avenue
(County Road 101) to the alley at Huber Park. Fillmore will be extended to the north to
serve the two proposed parking lots.
Fillmore Street is proposed to be constructed at a 28 feet width as measured from face of
curb to face of curb. A right turn lane is proposed at the intersection with First Avenue.
Because the existing alley to the east of Fillmore Street will no longer be connected, a
gravel tum-a-round is proposed. The construction of the new Fillmore Street will disturb
the existing emergency access at Bluff A venue. This access will be restored with gravel.
Sidewalk will be placed adjacent to the west side of Fillmore Street and connect to the
existing sidewalk at First Avenue (County Road 101). Figure No.2 on the next page
shows the proposed typical section for the improvements.
The costs for the recommended street improvements are presented in the Cost Analysis
section and Appendix A.

Section 2 - Alley
The alley improvements involve reconstructing the existing bituminous alley and placing
curb and gutter and bituminous paving. Currently, the existing alley drains water along
an inverted crown in the center and continues to the west to a catchbasin placed in 2004.
The improvements will bring this drainage to the curb line and then to new and adjusted
storm sewer structures. The curb and gutter is not proposed to be constructed against the
building side of the alley. The new bituminous will match into existing sidewalk and
frontage in this area.
Striping of new parking stalls and existing parking stalls will be part of the project. The
alley is proposed to be constructed to the same section as Fillmore Street as shown in
Figure No.2.
The costs for the recommended alley improvements are presented in the Cost Analysis
section and Appendix A.
Section 3 - Parking Lots
The parking lot improvements involve construction of two parking lots that will serve the
community built playground and other future improvements. The playground is
scheduled for construction in October 2005, and rough grading of the playground is part
of the project. The parking lot improvements include construction of portions of the
sidewalk and trail that will connect to existing trails in the area.
Additional fill quantity within the amounts consistent with previously obtained permits
will be needed for these parking lots, and it is proposed to construct the parking lots to
the same section as shown in Figure No.2.
The costs for the recommended parking lot improvements are presented in the Cost
Analysis section and Appendix A.
Section 4 - Other Water and Electrical Improvements
This section is discussed in the Utility Section of the report.

Utility Improvements
The major utility improvements will be the construction of storm sewer structures and
piping to convey surface water runoff from the new improvements to the existing storm
sewer system in the park. Some of the drainage in the parking lots will be routed to the
proposed rainwater filtration basins or gardens in the islands to help improve water
quality. Rainwater gardens are becoming more widely-used method in the Metro Area
for water quality. The gardens were recommended by the Environmental Advisory
Commission, and their use in this situation will be evaluated in the final design of the
parking lots.
A sanitary sewer and water service will be extended to the future restroom and storage
building at this time. These utility improvements are shown in Figure No.3 on the next
page. The sanitary service will be extended from the existing sewer stub placed as part of
the 2004 West River Interceptor Improvements. An existing 6-inch watermain currently
ends at the hydrant on Bluff Avenue. A 4-inch diameter line is proposed to be extended
from this location. The size of this water service line will need to be approved by
Shakopee Public Utilities Commission (SPUC).
Due to the poor condition of some of the soils in Huber Park, final design will review
how the utilities are affected by these soils and any trench backfill that is needed to
stabilize the piping
City Staff has been reviewing other watermain looping and burying electrical lines with
SPUC as part of this project. The specific utility improvements discussed previously as
well as the possible watermain looping and burying electrical lines are identified as
follows:

Other Water Improvements
Shakopee Public Utilities Commission's (SPUC's) Water Policy Manual (Resolution
#783 - March 7, 2005) discusses specific policies on Water Connection Charges (Section
LD. on Page I-II), Trunk Water Charges (Section LF.3. on Page 1-12), and Trunk Water
Costs (Section LF.4. on Page I-B).
In reviewing this policy with SPUC Staff, looping the watermain along with this project
has been discussed. SPUC is currently performing a fire flow study in making a decision
on the watermain looping. Huber Park has portions of the park located in the Minnesota
River floodplain and has had water service in the past (hockey rink and possible Boy
Scout log cabin). These issues and how this past service affects water connection
charges, trunk water charges, and costs for watermain looping for the seasonal restroom
are still being discussed with SPUC Staff.
At this time, three alternative water main loops are included in the report. The first loop,
Alternative 1, extends 6-inch diameter water main from Bluff Avenue to First Avenue on
Fillmore Street. The second loop, Alternative 2, extends 8-inch diameter water main
through Huber Park from Bluff A venue to the area near the MNDOT Bridge/Lewis
A venue. This second loop should be discussed as it relates to improving fire flows for
the downtown area as part of proposed redevelopment. The third loop, Alternative 3,
extends 8-inch diameter water main from Bluff Avenue to First Avenue via Spencer
Street.
The costs for the recommended utility improvements are presented in the Cost Analysis
section and Appendix A.
Electrical Improvements
In discussions with SPUC Staff, burying the overhead wiring in the area of the alley to
the west of Fillmore Street was not part of the original scope of the project for Huber

Park estimated at $150,000. Burying the overhead wiring in this location would also
require burying of electrical service lines to the individual business properties along the
project.
The costs for the recommended electrical improvements are being reviewed by SPUC
Staff based on past project histories including the 1996 alley undergrounding project.
The costs are presented in the Cost Analysis section and Appendix A.

Easements and Permits
Almost all of the work is proposed to be done within City right-of-way or property;
however some areas of the existing parking stalls in the alley fall outside of the alley
right-of-way. Permission in the form of a right of entry will be needed from the adjacent
property owners to reconstruct this area outside of the right-of-way. If this right of entry
cannot be obtained, then the work would need to be adjusted to stay within the existing
alley right-of-way. Costs associated with right of entry acquisition would be included in
the project costs and assessed.
Work in the right-of-way of First Avenue (County Road 101) will require a permit from
Scott County. Work under Alternate 2 Water Main looping to the west end of Huber
Park will require a permit from MNDOT. Due to the size of the project, a General Storm
Water Permit for Construction Activity will be needed from the MPCA. Approval of the
proposed water service extension will be needed from the Shakopee Public Utilities.

Cost Analysis
The estimated costs of the proposed improvements are summarized in Table 1 and
Appendix A. The costs in Appendix A include 10% for contingencies and 25% for
indirect costs.

A portion of the proposed Fillmore Street Extension and Alley Improvements are
proposed to be assessed to adjacent properties, including costs associated with converting
individual electrical service lines from above ground to underground. The City's policy
is to assess 100% of the proposed improvements, and preliminary assessment rolls are
presented in Appendix B based on this policy. Property owners could choose to do the
underground electrical service conversion separate from the project.
It is anticipated that storm sewer improvements that are not assessed, water service, and
sewer service will be funded by combinations of the General Storm Sewer Fund and
Huber Park project funding. The remaining alternate water main looping, burying of
electrical lines in the alley, and possible water connection charge ($2,300 per equivalent
SAC unit) and trunk water charges ($1,348 per acre) will require further discussion
between SPUC and the City of Shakopee. At this time, it is anticipated that the costs for
burying the electricallines (not including service lines) will be split 50%/50% by SPUC
and the City.

As discussed above, it is proposed to assess benefit for the street and alley improvements
including storm sewer on a front footage basis in accordance to the City's Policy. The
estimated amount of assessable front footage for Fillmore Street and the alley is
approximately 560 and 519 feet, respectively. This results in the following:

Recommendations and Conclusions
The improvements described in this report are feasible from and engineering standpoint.
This project is necessary to provide access, parking, and utility improvements to Huber
Park and adjacent properties. The project is cost effective based on conditions and
acceptable standards proposed to construct the improvements.
The estimated cost of the improvements is $698,830 based on Alternate No. 1 and 2
watermain looping. The following recommendations are presented for consideration of
Shakopee City Council and Staff:
1. That the improvements presented herein be considered for 2005 construction. If
all the improvements were completed including water main looping alternatives 1
and 2, the cost is estimated at $698,300.
2. That the City Council review assessing the benefited properties in accordance
with the City's assessment policy and as described herein, with the City reviewing
the percentage used for the assessment. Under Chapter 429, the City is limited in
assessing the benefit of the improvements to the adjacent properties and should
review this based on the City policy.
3. That a public hearing be held to discuss the proposed improvements and
assessments.
4. That the City review the improvements in the alley parking area outside of the
alley right-of-way with the adjacent property owners and get permission to
reconstruct this area.
5. The City should finalize discussions with SPUC on this Park Project and the costs
associated with water main looping and burying of overhead electric lines.

Subject: Riverfront Park Related Development Updates and Riverfront Walk
City Council originally had a riverfront walk scheduled for May, but needed to reschedule
due to a meeting conflict. The walk is now scheduled for 5:30 p.m. on June 21. We will
meet at City Hall.
I had prepared a previous summary of riverfront park projects. This is an update of that
report.
Huber Park Design and Development (Phase 1)
Earlier this year, City Council directed that the park development should occur first, and
riverbank stabilization second. As part of the park design, Bonestroo developed a plan
that would construct the roadways and parking lots and improve the alley this year, in
time for the Community Built playground construction in October.
Phase 1 a: Fillmore Street Extension. Parking Lots. and Alley Imorovements
Since some of the roadway and parking lot costs will be assessed to adjacent properties
(per city policy), Bonestroo completed a feasibility study to develop more accurate cost
estimates and determine approximate assessments. This feasibility study was to go to
the City Council at the May 3 meeting. However, it was pulled from the agenda in order
to investigate additional water service (looping) and undergrounding questions that
Shakopee Public Utilities raised.
We have had several meetings with Public Utilities staff and their Commission, and
continue to work on water main looping, trunk water charges, and power line
undergrounding. The June 21 staff report on the feasibility study provides more detail on
each of these issues.
If the feasibility study is accepted, there would be a public hearing on the proposed
assessments July 19, with the project ordered thereafter. As planned, construction of the
roadways, parking lots, and alley improvements would be completed (or nearly
complete) by the end of September in time for the Community Playground build.
Phase 2a: Remaining Park Design and Construction
Once Phase 1 a is completed September, the design and construction documents for the
rest of the park would be completed and the project bid in January/February 2006.
Construction could begin as early as March 2006, and would continue through fall 2006.
The park would not likely be ready for use until 2007.
One issue that we recently became aware of is that when the state acquired the right-of-
way for the mini-bypass, they acquired approximately % of lot 6, block 2 adjacent to
Huber Park. This area extends north ofCR 101 roadway approximately 100'-150', and
for practical purposes, is part of the Huber Park development.
The state transferred ownership of this property to Scott County when the 101 turnback
occurred. We will be submitting a request to Scott County to consider transferring
ownership of this excess right-of-way to the city to officially be incorporated into Huber
Park. We will also be submitting a permit application for improvements that are part of
the park project that would occur in the County's right-of-way.
River Bank Stabilization (Phase 2)
The city is working with Congressman Kline's office to investigate the possibility of the
riverbank stabilization becoming an Army Corps of Engineers project, similar to the 2001
riverbank stabilization. Councilor Lehman set up an initial meeting with the
Congressman and the project, with Congressman Kline's support, has picked up
momentum since then.
Congressman Kline's office met with the Army Corps earlier this spring, and on May 9,
we toured the project site with Army Crops staff. The Army Corps explained that they
first conduct a feasibility study on a project to determine costs and public benefit, and if
public benefit is found, the project is placed on a list. There are currently 14 projects on
the Army Corps' list for this area of their jurisdiction.
Given the Army Corps funding restrictions, funding for the feasibility study would have to
be earmarked by Congress. (The Army Corps calls this process "naming" the project in
the funding allocation.) If we are successful in securing funding for the feasibility study,
naming the project in future federal budgets would ensure the Army Corps' participation.
I spoke with Colin Haley from Congressman Kline's office on June 1 and was informed
that the timing of the project did not match the timeline for submitting Congressman
Kline's appropriation request for this year, but we would be in the request for 2006. Mr.
Haley also asked me to contact Senator Coleman's office.
I spoke with Bryan Gwinn from Senator Coleman's office on June 9 regarding the
project. He indicated that Senator Coleman would likely support the project, but noted
that we missed the Senate appropriation request for this year as well. I will be following-
up with Senator Coleman's office and providing them background on the project for
2006.
Huber Park Grant Applications
As part of their contract with the City, Bonestroo worked with city staff to prepare two
grant applications for Huber Park: Federal Trails Recreation Grant Program and Outdoor
Recreation Grant Program. We are awaiting word from the DNR on the status of these
grant applications.
Community Built Playground
The Community Built Playground committee and a designer (Leathers and Associates)
worked with Shakopee elementary students in the fall of 2004 to develop a design for
the Community Built playground. Since that time, the committee has been working on
fundraising, securing donations, and signing up volunteers. As I understand, they have
received significant financial commitments.
Levee Drive Parking Lot
As part of the Northridge Court senior housing project, the Scott Housing and
Redevelopment Authority (HRA) agreed to construct a replacement parking lot on Levee
Drive between the two bridges where the old community services building stood. The
HRA's consultant completed a preliminary design for the parking lot in 2004, but agreed
to wait to construct the parking lot until 2005 in order to give the city time to work with
SPUC to underground the power lines. HRA is prepared to finish the parking lot this
summer. We are working with our Engineering Department and the HRA's designer to
update the design to address the proximity of the parking lot to the sewer line and
stormwater runoff.
Power Line Undergrounding
Shakopee Public Utilities Commission has committed funding for undergrounding the
power lines through the Huber Park area. Bonestroo is working with Public Utilities staff
to plan the best route for the power lines through the park area. This work could coincide
with the Fillmore Street extension and parking lot project this year.
The city also requested that power lines in the area between the two bridges along
Levee Drive be undergrounded in order to construct the trail head parking lot that was
part of the Northridge Court project. There has been discussion about whether or not the
city can order the undergrounding of the power lines as part of the city's right-of-way
ordinance. The city's attorney has concluded that under Chapter 17, Section 7,
Subdivision 24 of the City Code, the city has the authority to order undergrounding of
power lines on public property held in common for public use for a facility of 300' or
more.
We submitted additional information on the Levee Drive undergrounding request to the
Commission, which was discussed at their May 16 and June 6 meetings. Although the
Commission supports the idea of undergrounding the power lines along Levee Drive for
aesthetic purposes, they do not feel that it is the Commission's responsibility to pay for
the undergrounding.
At this point, City Council has not considered ordering the undergounding of these power
lines under the city's right-of-way ordinance. SPUC's attorney is suppose to offer his
opinion on whether or not the city can order the undergrounding by June 16. This
decision will need to be made soon as the HRA's contract for the parking lot will expire
this summer.
Boat Landing Relocation/Archery Range Relocation
The city has been working with the DNR to relocate and reconstruct the boat landing to
the north side of the river. In 2004, the U.S. Fish and Wildlife Service granted the city an
easement to construct the boat landing. We received a draft agreement on the boat
landing from the DNR earlier this spring and have asked for clarification on some of the
terms of the agreement. We are also submitting a permit to Scott County for the portion
of the work that would be under the CR 101 Bridge. Funding the relocation of the boat
landing is contingent on action at the legislature this year.
We have also been working with the DNR and archery enthusiasts on replacing the
Lions Park archery range. The most likely site is a parcel owned by the DNR that was
once the site of the baseball field. The DNR has prepared a concept plan for the site that
provides access to archery range from the boat landing. This approach limits the number
of access points on busy CR 101 to a single entrance.
The DNR has matching grant programs available. Local archers have expressed an
interest in helping to fund the development of the archery range, as well as participate in
long-term maintenance of the facility. Ultimately, this project would require an agreement
that specifies responsibilities for all interested parties, including the city. We have
scheduled a meeting for July 12 to continue work on this project.
MNDOT Bridge No. 4175
As you know, MNDOT needs to dispose of Bridge No. 4175 (Holmes Street Bridge)
because they no longer have a public purpose in the area. This bridge is eligible for
historic registry along with several other bridges in Minnesota. MNDOT is conducting a
study on these bridges to determine their significance and costs to restore them. They
anticipate completing the study in about eight months.
MNDOT has an unmet requirement from the Federal Highway Administration and the
DNR to provide a permanent pedestrian crossing over the river. If restored, Bridge No.
4175 could provide this purpose.
MNDOT has also been given directive by the Commissioner to sell valuable excess
right-of-way in the system. One of these excess parcels is the MNDOT Parcel 75 in
South bridge. MNDOT staff is supportive of the plan to transfer ownership of this parcel
to the city in order to protect its ecological significance (one of the few remaining oak
savannas in Minnesota). In fact, the city recently completed a joint project with MNDOT
and the DNR to treat significant oak wilt on the property, and we are working together to
develop a management plan that would preserve the ecology of the site.
In order to increase the odds that the city will actually acquire this property, Cyrus
Knutson, MNDOT Jurisdiction Program Manager, has proposed developing a memo of
understanding that would outline a potential exchange of ownership of Parcel 75 for a
renovated or replaced Bridge No. 4175. In other words, if the city would consider taking
ownership of a renovated or replaced bridge, MNDOT would transfer ownership of
Parcel 75 to the city. According to Mr. Knutson, although a memo of understanding does
not obligate the city nor MNDOT to move forward, it would provide enough assurance to
MNDOT officials that this parcel should be reserved for the city. I have attached a very
brief overview from Mr. Knutson. City Council may also want to consider adding Parcels
37 and 43 to the memo of understanding.
Once MNDOT's bridge study is complete, we will have more information about the long-
term implications of assuming ownership of the bridge. It is likely that City Council will
have the opportunity to consider the memo of understanding before the study is
complete. However, any work on an agreement that outlines transfer of ownership would
not occur until after the study is complete. This will be a significant discussion that City
Council will need to have at some point in the future.
Graffiti
The area along Levee Drive has seen a significant increase in graffiti. The Police
Department is working on the problem and has initiated a reward for information leading
to an arrest and conviction of those committing the acts.

Memorandum of Understanding between

Purpose
The proposed purpose of a non-binding memorandum of understanding (MOU) is
to establish objectives of mutual interest to the state and the city. The MOU is
proposed as a preliminary step prior to a formal binding agreement while detail
issues are identified and resolved.
Obiectives
1. Transfer of parcel 75 from state ownership to the city for park purposes.
Parcel 75 is located near South bridge Parkway and Hartley Boulevard.
The state acquired the parcel as part of US 169 right of way.
2. Restoration or replacement of the old US 169 highway bridge by the state,
followed by transfer of ownership of a restored or replaced structure to the
city. State bridge number 4175 crosses the Minnesota River near 1st
Avenue and Holmes Street east of the County Road 101 Minnesota River
bridge.
Proposed Schedule
Develop MOU in June and July of 2005.
Agency authorizations and signatures in August of 2005.
Determination of bridge restoration or replacement requirements, financing and
schedule by March of 2006.
Proceed with formal agreement, provided all issues resolved April of 2006.
Transfer of property may also proceed if agreement is reached.
