"J- , Memorandum CASELOG NO.: 05-068 TO: Mayor and City Council CONSEr~T Mark McNeill, City Administrator FROM: Julie Klima, Planner II SUBJECT: Final Plat of Shakopee Valley Marketplace 2nd Addition MEETING DATE: June 7, 2005 REVIEW PERIOD: April 28, 2005 to August 26, 2005 CONSIDERATIONS: Inland Commercial Property Management has submitted an application for final plat of Shakopee Valley Marketplace 2nd Addition, located north of 17th A venue and east of CSAH 17 (Marschall Road) (Exhibit A). This property is presently platted as Shakopee Valley Marketplace (Target/Koh1s shopping area). The submitted plat proposes to reflect changes that have occurred on the site since the original recording of the plat. Please find attached as Exhibit C a copy of the applicant's narrative explaining the proposed changes to the plat. The submitted final plat is generally consistent with the approved preliminary plat. Shakopee Public Utilities Commission has commented that there is an outstanding Trunk Water Charge due on the portions of Lots 1, 5, and 6 that are over 800 feet west of Sarazin Street in the amount of$11,370.83. SPUC has further commented that underground electric service is not yet installed to serve Lots 3 and 6. Charges will apply when these lots develop. AL TERNATIVES: 1. Approve Resolution No. 6253, a resolution approving the final plat of Shakopee Valley Marketplace 2nd Addition, subject to the conditions as proposed. 2. Approve Resolution No. 6253, a resolution approving the final plat of Shakopee Valley Marketplace 2nd Addition, subject to revised conditions. 3. Deny the final plat of Shakopee Valley Marketplace 2nd Addition. 4. Table a decision in order to allow time for the applicant and/or staff to provide additional information. ACTION REQUESTED: Offer a motion to approve Resolution No. 6253, a resolution approving the final plat of Shakopee Valley Marketplace Second Addition, subject to the conditions as proposed. g: \cc\2005\06-07\fpshakopeevalleymarket2nd05 06 8 .doc RESOLUTION NO. 6253 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF SHAKOPEE V ALLEY MARKETPLACE SECOND ADDITION WHEREAS, Inland Commercial Property Management, applicant and property owner, has made application for Final Plat approval of Shakopee Valley Marketplace Second Addition; and WHEREAS, the subject property is legally described as follows: Lots 1 through 6, Shako pee Valley Marketplace, according to the recorded plat thereof, Scott County, Minnesota; and WHEREAS, the City Council of the City of Shakopee reviewed and approved the Final Plat of Shakopee Valley Marketplace on June 22, 1999; and WHEREAS, all required public notices regarding the public hearing were duly sent and posted and all persons appearing at the hearing have been given an opportunity to be heard; and WHEREAS, the City Council ofthe City of Shakopee reviewed the Final Plat of Shakopee Valley Marketplace Second Addition on June 7, 2005; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: That the Final Plat of Shakopee Valley Marketplace Second Addition is approved consistent with the drawings provided with the application for final plat approval. WEB: www.oppidan.com April 26, 2005 Ms. Julie Klima, Planner II City of Shakopee 129 Holmes street South Shakopee, MN 55379 RE: Shakopee Valley Marketplace Second Addition Dear Julie: Enclosed is an application, including fees, 6 full-sized plat drawings, 10 -11" x IT' reductions of the plat and back up documentation for the Final Plat application of Shakopee Valley Marketplace Second Addition. Per our conversation,. we are modifying the original plat as follows: . Previously, there was an Administrative Subdivision moving a portion of Lot 2 (the Target Lot) containing approximately a block 20 feet wide by80 feet deep to Lot 1. This:platmoves that to Lot 1. . A portion of Lot 6 is being dedicated to Lot 1. The original layout had the property line right down the center of the drive lane that separates Lot 1 from Lots 5 & 6~ When Kohl's was approved, the driveway was shifted to the south and ari. easement was placed for the relocated drive. This plat will move the drive and the easement will be released. A copy of the easement is . provided. . A portion of Lot 3 is being added to Lot 4. Previously, there was an issue with how parking was determined in the private agreement among the owners of the lot. This necessitated some additional stalls to be added on Lot 4 and some of the stalls on Lot 3 to be dedicated to Lot 4. The City approved this addition of the stalls (a copy is attached) and an easement was created allowing Lot 4 to use stalls on Lot 3 (a copy is attached). In general, there is no modification to the parcel that has any impact on parking counts, makes a lot less than the minimum 1 acres required by the City or is in conflict with the plans that have been previously approved by the City. The intention of this replat is to "clean up" all of these items that have been reviewed and approved in some manner into one revised and corrected plat.
