INTRODUCTION:
Ryland Homes has submitted an application for final plat of Riverside Fields 2nd Addition, located
west of CSAH 18 and south of future CSAH 21. This property is presently legally described as
Outlot B, Riverside Fields 1st Addition, and has an area of 13.1699 acres, with 2.1707 acres
proposed as public right-of-way (Exhibit A).
CONSIDERATIONS:
The applicant is proposing to develop the second phase of Riverside Fields, which would consist
of 45 single-family residential lots (Exhibit B). The 2nd Addition would be located adjacent to
Outlot C, which is dedicated for use as a public park and shall incorporate an eight-foot wide
recreational trail, generally consistent with the approved preliminary plat. As part of the
preliminary plat approval, the applicant received approval to have 15- foot structure separations
for 75 lots south of Crossings Boulevard, with no side yard setback being less than five feet.
This condition applies to both the proposed 2nd Addition and the approved 1st Addition, which
consisted of 65 lots. The 2nd Addition plat drawings show that they propose to have 26 lots that
will utilize the side yard setback variance and 19 that will not utilize the variance, although this
breakdown is subject to change. Staff is working with the developer to ensure that the number of
total lots utilizing this variance will comply with the approved allotment.
The Building Official commented that temporary street signs are required prior to construction.
The Shakopee Fire Inspector commented that a second remote access in accordance with
International Fire Code Appendix D shall be provided when the total count of lots accessing
Crossings Boulevard west of County Road 18 exceeds 100 units. Additionally, he commented
that because SwitchgrassLane has two (2) access points with Crossings Boulevard, the developer
shall install property address series signs (pole mounted) with street identification signage at the
east and west intersection with Crossings Boulevard. The purpose of this request is to provide
clarification for which access emergency service and other vehicles should take to those
residences located on this street.
Shakopee Public Utilities Commission provided a lTIemorandum (Exhibit C), noting that the
developer shall provide two (2) independent sources of water to this plat. Additionally, water,
underground electric and street lighting installation is available subject to their standard terms
and conditions. The applicant must pay the associated fees, and contact them regarding
installation/construction policies.
Mark Themig, Facilities and Recreation Director, has provided a memorandum (Exhibit D),
which addresses grading and design issues related to the park area and the trail. Specifically, he
commented that the developer shall revise the grading plan to ensure that the elevation of the
proposed trail along the south property line is the same as the south edge of the park, that the
curb cut to the park not be installed at this time, that the trail segment extending from the "y" to
the west not be installed at this time, and that the developer shall provide funds for the cost to
construct this trail in the future.
Mark McQuillan, Natural Resources Director, reviewed the final plat for conformance with the
Woodland Management Plan (Exhibit E). Mr. McQuillan noted that according to the Woodland
Management Plan, the applicant shall replace the trees that were removed from the park area by
adding another five trees to its plan. The Landscape Plan currently shows four trees along
Crossings Boulevard. The five additional trees should be planted along the west property line.
City Engineering has provided a memorandum (Exhibit F) recommending approval, noting
several conditions (including several pertaining to easements and deed restrictions) that shall be
addressed prior to recording and construction. Those conditions have been incorporated into the
draft resolution. Additionally, they will be submitting directly to the applicant comments
concerning the construction plans, including a note that the lot and block numbering shall be
revised to be consistent with the plat.
ALTERNATIVES:
1. Approve Resolution No. 6027, a resolution approving the final plat of Riverside Fields 2nd
Addition, subject to the conditions as proposed,
2. Approve Resolution No. 6027, a resolution approving the final plat of Riverside Fields 2nd
Addition, subject to revised conditions.
3. Deny the final plat of Riverside Fields 2nd Addition.
4. Table a decision in order to allow time for the applicant and/or staff to provide additional
information.

RESOLUTION NO. 6027
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF RIVERSIDE FIELDS SECOND ADDITION
WHEREAS, Ryland Homes, applicant, and Shakopee Crossings Limited Partnership,
property owner, have made application for Final Plat approval ofRNERSIDE FIELDS SECOND
ADDITION; and
WHEREAS, the subject property is legally described as follows:
Outlot B, RIVERSIDE FIELDS FIRST ADDITION;
WHEREAS, the Shakopee Planning Commission reviewed and recommended approval of
the Preliminary Plat on August 7, 2003; and
WHEREAS, all required public notices regarding the public hearing were duly sent and
posted and all persons appearing at the hearing have been given an opportunity to be heard; and
WHEREAS, the City Council of the City of Shakopee reviewed and approved the
Preliminary Plat of Riverside Fields on August 19,2003; and
WHEREAS, the City Council of the City of Shako pee reviewed the Final Plat of Riverside
Fields First Addition on October 21,2003; and
WHEREAS, the City Council of the City of Shako pee reviewed the Final Plat of Riverside
Fields Second Addition on March 16, 2004; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, as follows:
That the Final Plat of RIVERSIDE FIELDS SECOND ADDITION is approved subject to the
following conditions:
I. The following procedural actions must be completed prior to the recording of
the final plat:
A. Approval of title by the City Attorney.
B. Revise the signature block to read City Clerk rather than City Administrator.
C. Execution of a Developers Agreement which shall include provisions for
security for public improvements, payment of engineering review fees, and
any other fees as required by the City's most current fee schedule.
1. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems in accordance
with the requirements of the Design Criteria and Standard
Specifications of the City of Shako pee. Payment of Trunk Sanitary
Sewer Charges and Trunk Storm Water Charges as required by the
most current City of Shakopee Fee Schedule.
5. Installation of streets in accordance with the requirements of the
Design Criteria and Standard Specifications of the City of Shakopee.
6. The developer shall be responsible for payment of engineering review
fees, and other fees as required by the City's adopted Fee Schedule.
7. That a 12" trunk watermain in proposed Crossings Boulevard will be
required within this development.
D. No site grading will be allowed until preliminary plan and profile sheets for
street and utility work and a grading permit are approved by the City Engineer.
E. "Crossing Boulevard" shall be spelled: "Crossings Boulevard".
F. Right of Way width dimension shall have the same orientation at all points in
Crossings Boulevard.
G. Provide a total of thirty (30) feet of drainage and utility easement, centered on
the proposed storm sewer, adjacent to the following lots:
a. Lots 11, 12,28 & 29 of Block 1
b. Lots 5 & 6 of Block 2
H. Provide a total of twelve (12) feet of drainage and utility easement, along
Crossings Boulevard, adjacent to Lot 35 of Block 1.
I. Provide a total of twenty (20) feet of drainage and utility easement along the
rear property line, centered on the proposed storm sever adjacent to. Lots 8 &
9, Block 1.
J. Specify the width of the drainage and utility easement adjacent to Lots 22 &
23ofBlock 1.
K. The applicant shall record a deed restriction on the following lots
simultaneous to the recording ofthe Plat:
a. Lots 1 thru 9, 11, 12, 14, 15,22,23,28 & 29 of Block 1.
b. Lots 1 thru 10 of Block 2.
The deed restrictions shall appear as the following:
This conveyance is made conditioned upon and subject to the
following restriction. The Grantee, heirs, successors and assigns are
restricted from erecting any fence or other structure within the utility
and drainage easements dedicated by plat over the above-described
property, except with the prior written consent of the City of Shakopee.
This restriction shall run in favor of and be enforceable by the City of
Shakopee.
L. The following variation is granted from zoning code provisions:
a. 15' structure separations are approved for 75 lots south of
Crossings Boulevard, with no side yard setback being less than 5' .
M. The applicant shall implement the use of Best Management Practices for
erosion control and stormwater management during construction.
N. The applicant should transplant healthy young trees on site whenever possible.
O. The developer shall install rain sensors for the irrigation system, and that all
sprinklers owned and operated by the Homeowner's Association shall have
rain sensors consistent with State Law requirements.
P. The applicant shall construct houses using construction materials and methods
for indoor noise mitigation.
Q. The applicant shall replace the trees that were removed from the park area by
adding another five trees to its plan. The Landscape Plan currently shows four
trees along Crossings Boulevard. The five additional trees should be planted
along the west property line of the public park (Outlot C of Riverside Fields
1 st Addition).
R. The homeowner's association shall develop a management plan for the
sustainability ofthe wetlands and native plantings proposed in the preliminary
plat.
S. Any change in drainage entering the County right-of-way shall require detailed
stormwater calculations to be submitted to the County engineer for review and
approval.
T. The applicant shall include 6 inches of topsoil, meeting MNDOT
specifications, on the entire site.
II. Following approval and recording of the final plat, the following conditions shall
apply:
A. This development shall comply with City Code Section 10.60, concerning noise
elimination and noise prevention. Responsibility for other noise mitigation
measures that may be required in the future shall rest with the developer or its
aSSIgns.
B. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
C. All existing easements are retained.
D. Final grading, utility connections and access to city streets will need approval by
the Engineering Department.
E. All outstanding fees will apply.
F. Temporary street signs are required prior to construction.
G. A second remote access in accordance with International Fire Code Appendix D
shall be provided when the total count of lots accessing Crossings Boulevard west
of County Road 18 exceeds 100 units.
H. The developer shall install property address series signs (pole mounted) with
street identification signage at the east and west intersections of Switchgrass Lane
and Crossings Boulevard.
1. Prior to construction of the public improvements, the City Engineer and the
Shakopee Public Utilities Commission shall approve the Final Construction Plans
and Specifications.
J. The park dedication requirements have been determined based on the fact that the
preliminary plat for the property depicts all residential portions of the property
being developed with single-family detached homes, not attached townhouse
dwellings. If future phases of the property are proposed to be developed with
townhomes or other types of attached dwellings, the city reserves the right to: (a)
deny such proposals; (b) require additional park land dedication; or (c) require
additional park dedication fees to be paid.
K. The developer shall provide two (2) independent sources of water to this plat, and
shall consult with Shakopee Public Utilities Commission prior to any installation
of service lines.
L. Property addresses will not be released until the approved final plat is recorded
with Scott County Land Records.
M. The developer shall raise the elevation of the public park (Outlot C of Riverside
Fields 1 st Addition) to ensure a slope of 1 % or less from north to south, and that
the southern end of the park be at a final elevation of757, the same as the final
elevation shown for the trail.
N. The developer shall install the trail segment from Crossings Boulevard south
along the eastern edge ofthe public park (Outlot C of Riverside Fields 1st
Addition) and continue it east to connect to the trail from the First Addition, but
not construct the trail segment extending from the "Y" to the west along the south
line of the public park. In lieu of constructing the trail segment to the west at this
time, the developer shall provide security to construct a trail in the future, exact
location to be determined at a later date.
O. The developer shall not install the curb cut to the public park as shown on the
plans.
P. Provide electronic AutoCAD files of the Final Plat to the Engineering
Department.
Q. Submit two (2) copies ofthe final plat (11" x 17"), and an electronic copy, to the
Community Development Department, as follows:
a. The final plat copies shall be labeled 'final' and include the Council hearing
approval date.
b. Submit paper copies to: Community Development Department, 129 Holmes
Street South, Shakopee, MN 55379.
c. Send electronic copy (.dwg or .shp) to RecordedPlat(cV,ci.shakopee.mn.us.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the Final Plat of
RIVERSIDE FIELDS SECOND ADDITION does not constitute a representation or guarantee by
the City of Shako pee as to the amount, sufficiency or level of water service tl:1at will be available
to lots within the plat as they are developed.
Adopted in session of the City Council of the City of Shakopee, Minnesota,

Municipal water service is available subject to our standard terms and cotiditioils. These
include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk

Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to: entering into an Underground Distribution

Subject: Riverside Fields Second Addition Final Plat Review
I am writing to provide comments related to the final plat review for Riverside Fields
Second Addition. j
Park Area
As you are aware, the park area in Riverside Fields is part of a plan that would add
additional land to the west, creating a larger park for the area. Therefore, the park will be
constructed at some point in the future, after a master plan is completed for the area.
I would recommend that the developer raise the elevation of the park so there is a slope
of 1 % or less from north to south, and that the southern end of the park be at a final
elevation of 757, the same as the final elevation shown for the trail.
Trail
Due to the uncertainty of the final design for the park, I would recommend that the
developer install the trail segment from Crossings Boulevard south along the eastern
edge of the park and continue it east to connect to the trail from the First Addition, but
not construct the trail segment extending from the "Y" to the west. In lieu of constructing
the trail at this time, the developer should provide funds for the cost to construct this trail
in the future.
Crossings Boulevard Park Access
Since we don't know the final park design, I would recommend that the developer not
install the curb cut as shown on the plan.

Subject: Final Plat Review of the Riverside Fields 2nd Addition

I reviewed the final plat for tree replacement. The Woodland Management Plan indicates
that 39 significant trees were removed out of woodland #5, a low quality woodland. Four
(4) of those trees were classified as hazard trees and therefore, not counted towards the
tree mitigation plan. The total number of trees removed is twenty-seven.
According to the Woodland Management Requirement, the replacement value for 27
trees in a Low Quality woodland is nine trees (replace with one tree for every three trees
removed). The City would like the Applicant to replace the trees that were removed from
the park area by adding another five trees to its plan. The Landscape Plan currently shows
four trees along Crossing Boulevard. The five additional trees should be planted along
the west property line.
