No. 6026 CITY OF SHAKOPEE /5:0.2" Memorandum CASE NO.: 04-023 CONSE~JT TO: Mayor and City Council Mark McNeill, City Adminsitrator FROM: Nicole Peterson, Planner I - GIS Ph: 952.496.9675 SUBJECT: Set Public Hearing for Vacation of Easement Located North of 4th A venue East, east of Shenandoah Drive and south of Highway 101 MEETING DATE: March 16,2004 INTRODUCTION Dom Properties has submitted an application for vacation of easements located North of 4th Avenue East, east of Shenandoah Drive and south of Highway 101 (Exhibit A). The attached Resolution No. 6026 sets a public hearing date to consider the vacation of this easement. DISCUSSION The attached resolution sets a public hearing for April 20, 2004. On that date, comments from staff members and utilities, as well as a recommendation from the Planning Commission, will be presented to the City Council for consideration. The Planning Commission will consider the request at its April 8, 2004 meeting. ACTION REQUESTED Approve Resolution No. 6026, a resolution setting the public hearing date to consider the vacation of easement, North of 4th A venue East, east of Shenandoah Drive and south of Highway 101. Nicole Peterson Planner I - GIS G:\RESOLUTIONS\2004\V ACdomRES.doc RESOLUTION NO. 6026 A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE V ACA TION OF EASEMENT, NORTH OF 4TH A VENUE EAST, EAST OF SHENANDOAH DRIVE AND SOUTH OF HIGHWAY 101 WHEREAS, it has been made to appear to the Shakopee City Council that easements located North of 4th A venue East, east of Shenandoah Drive and south of Highway 101, serves no public use or interest; and WHEREAS, a public hearing must be held before an action to vacate can be taken and two weeks published and posted notice thereof must be given. WHEREAS, two weeks published notice will be given in the SHAKOPEE V ALLEY NEWS and posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council Chambers on the 20th day of April, 2004, at 7:00 P.M. or thereafter, on the matter of vacating easements located North of 4th A venue East, east of Shenandoah Drive and south of Highway 101.
