Subject: Acceptance of Play Structure Donation from Cedar Fair L.P., dba
Valleyfair Family Amusement Park
INTRODUCTION
City Council is asked to consider accepting a donation of two play structures from
Valleyfair Family Amusement Park.
BACKGROUND AND DISCUSSION
Dave Vosjepka, Operations Manager from Vallefair and former Parks and Recreation
Advisory Board member, contacted me on March 3 to see if the City would be interested
in accepting a donation of two play structures that Valleyfair needs to remove in order to
install a new ride.
Condition of Equipment
Bill Egan, Park Maintenance Lead, and I inspected the structures on March 4. One
structure manufactured by Miracle Equipment was installed in 2000 and is in excellent
condition. The other structure manufactured by Iron Mountain Forge was installed in
1993/1994 and is in fairly good condition. This structure has faded plastic components,
but the remaining surfaces appear to be in good condition. (See Attachment A.)
Safety and accessibility standards for play structures have changed significantly since
the ADA was implemented in the early 1990's. Therefore, I contacted each manufacturer
to determine what modifications would need to be made to ensure they meet current
standards. The Miracle structure meets all current standards and needs no
modifications. The Iron Mountain Forge structure would require some safety
modifications to bring it up-to-date. These modifications would cost approximately
$2,000. Additionally, the plastic components could be replaced for an additional
-$10,000, which would bring the equipment close to its original condition. Additional
costs would include site preparation, curbing, and wood fiber fill for the reinstallation site.
However these costs would likely vary depending on the where the equipment is
reinstalled.
City Commitment
If the City were to take these structures as a donation, City staff would need to
disassemble the units, transport them from Valleyfair, and install them at their new site.
Valleyfair plans to begin construction of new rides by the end of the month, sowe would
need to act quickly.
I spoke with both Mr. Egan and Mike Hullander, Public Works Supervisor. It appears that
this is a good time for them to do the disassembly, as we are hopefully between snowfall
and spring field preparations. Depending on where they are relocated, the equipment
may need to be stored until site preparations can be made. Both manufacturers
indicated that they would assist the City with installation of the structures.
Possible Relocation Sites
I have also discussed possible locations for installation of the play equipment with Mr.
Egan and Mr. Hullander. We looked at our entire park system and narrowed down
potential sites using the following criteria:
. The Valleyfair equipment has bright colors and would contrast with many of our
existing play structures. Therefore, we focused on undeveloped or under-developed
existing park areas that don't have play equipment.
. There are three parks south of Hwy 169 that will likely be designed later this year,
and additional park area in South bridge. Since these will be new parks to our
system, it may not be the best approach to install "used" equipment in these parks.
. The play structures are sized so they would be a better fit for a smaller park or open
space area.
Usin these criteria, we have identified five otential sites:
Location Considerations
P. & V Addition Park Currently a .46 acre site that would provide play equipment
CR 79 and Mound for residents west of CR 79.
10t Ave and Main Street Currently a .26 acre site, but close to Pearson Elementary,
which has a la structure.
Tahpah Park Existing play equipment is in need of upgrading, but
planned to be done as part of future Tahpah project.
Possible site for the older Valleyfair equipment for the
interim, but may not want to invest the labor unless it would
be in lace for at least two ears.
Undeveloped park area. This park would likely be
develo ed when develo ment occurs to the south.
Ideal location for newer Valleyfair play structure using
existing play area site. ECFE staff has contacted the City
each year about the City participating in funding a play
structure that would serve both school participants and city
residents. Equipment could be moved directly from
Valleyfair and installed at this site. School District would
need to agree to accept equipment as a donation from the
Cit .
Additional analysis will be needed to determine the best locations.
Play Equipment Value
The Miracle equipment has a value of approximately $20,000. I was not able to confirm
the value of the Iron Mountain Forge equipment, but would estimate that it was slightly
more when purchased new.
Other Considerations
Valleyfair has expressed a concern about their potential exposure if they donate the
equipment to the City and an injury occurs in the future. I spoke with the City Attorney,
Mr. Thompson, and we have incorporated a hold harmless condition into the resolution
that will transfer all liability to the City and require the City to defend, indemnify, and hold
Valleyfair harmless. However, if Valleyfair desires a written agreement or document, the
resolution also authorizes staff to work with Mr. Thompson to develop and execute such
agreement.
RECOMMENDATION
I believe that there is value in both structures, and the City should accept them as a
donation. If accepted, staff would work to finalize the relocation site. However, if you
have a desired location (either from the list above or another site), it would be helpful to
know that in advance.
Due to the short timeframe to accept and remove these structures, the Parks and
Recreation Advisory Board will not have an opportunity to review this item prior to
Council action. Also, since this is a donation of property, a 2/3 vote is required for
approval.
REQUESTED ACTION
If Council concurs, move to accept Resolution No. 6029, A Resolution Accepting a
Donation of Two Play Structures from Cedar Fair L.P., dba Valleyfair Family Amusement
Park.

RESOLUTION No. 6029
A RESOLUTION ACCEPTING A DONATION OF Two PLAY STRUCTURES FROM
CEDAR FAIR L.P., DBA VALLEYFAIR FAMILY AMUSEMENT PARK
WHEREAS, Cedar Fair L.P., dba Valleyfair Family Amusement Park
desires to donate a Miracle Play Structure and an Iron Mountain Forge play
structure to the City of Shakopee; and,
WHEREAS, the City of Shakopee acknowledges and appreciates the
cooperation of Valleyfair Family Amusement Park in donating these structures to
the City to serve City residents; and,
WHEREAS, the City acknowledges and appreciates the role of Public
Works staff to disassemble, transport, and reinstall these play structures.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA THAT:
1. The City of Shakopee gratefully accepts the donation of a Miracle Play
Structure and an Iron Mountain Forge play structure from Cedar Fair L.P.,
dba Valleyfair Family Amusement Park; and,
2. In accepting the play equipment, the City releases Cedar Fair L.P., dba
Valleyfair Family Amusement Park from any and all claims that might arise
out of the City's use of the equipment. The City further agrees to defend,
indemnify, and hold Cedar Fair L.P., dba Valley Fair Family Amusement Park
harmless from any such claims; and,
3. City Council authorizes appropriate City officials to execute an agreement
with Cedar Fair L.P., dba Valley Fair Family Amusement Park, if so desired
by Valley Fair Family Amusement Park.
Adopted in session of the City Council of the City of Shakopee,
Minnesota, held this day of ,2004.
