SHAKOPEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Kyle Sobota, Planner I DATE: 06/18/2013 SUBJECT: Final Plat of Church 2nd Addition Action Sought The City Council is asked to adopt Resolution No. 7319, a resolution approving the Final Plat of Church 2nd Addition. Background Casey Wollschlager, representing Summergate Development, LLC has applied for Final Plat Approval of Church 2nd Addition. Church 1st Addition is a mixed use development consisting of townhomes and a 7 -acre Neighborhood Commercial parcel that was approved by the City Council on June 1, 2004. The Shakopee Mdewakanton Sioux Community has recently purchased the 7 -acre commercial parcel; city staff is unaware of any plans for development of the commercial site. The property is zoned PRD, Planned Residential District and received a Conditional Use Permit for Medium Density Residential Development in 2004. Church 2nd Addition involves the proposed conversion of 35 lots in the southeastern portion of the project to 28 lots to allow for wider townhome units. The original plan for Church 1st Addition in this area contemplated 7 buildings comprised of 4 -6 units (see attached plans). Church 21d Addition proposes a reduction of each of the seven buildings by 1 unit to allow for a 36' wide unit. The proposed buildings are three 5 -unit buildings, one 4 -unit building, and three 3 -unit buildings (see attached plans). The main issue under review for this project relates to proposed utility service changes as a result of the reduced number of lots. The applicant's engineer has provided plans for changes in utility connections for the unused services of each building. The additional water service intended for the additional unit in each building would be combined with one other unit's water service line. This design has been approved by Shakopee Public Utilities Staff. The sanitary sewer service lines that were intended for the additional unit per building would be left in place, which is deemed acceptable by the City Engineer. Since Church 1st Addition was approved, the State Fire Code has been amended to require residential buildings exceeding 9,250 square -feet to be protected by fire sprinklers. Currently the applicant is proposing 2,168 square foot units. Based on this requirement the three 5 -unit buildings will be required to have fire sprinklers, based on the applicant's plans the one 4 -unit building is 8,672 square feet. Recommendation Staff recommends approval of Resolution No. 7319, a resolution approving the Final Plat of Church 2nd Addition. Budget Impact Church 2nd Addition proposes 7 fewer lots / units than Church 1st Addition. Based on the increased lot width the unit size will increase compared to the previously approved units and likely have an increased taxable value. The budgetary impacts based on whether the City Council approves this request will likely be negligible based on the City's share of property tax collection. Relationship to Vision The Final Plat of Church 2nd Addition allows for the construction of larger townhome units, which promotes a diverse housing stock in the community. Requested Action Offer a motion to approve Resolution No. 7319, a resolution approving the Final Plat of Church 2nd Addition with conditions, and move its adoption.
