Michael Leek, Community Development Director DATE: 06/18/2013 SUBJECT: Request to Prepare an Environmental Assessment Worksheet (EAW) for the Future Opus Property Located North of CR 101 and West of Valley Park Drive (B) Action Sought The Council is asked to offer and approve a motion directing city staff to initiate the EAW for this project, and to enter into the necessary agreement(s) with city consultant WSB and the applicant. Background Opus Development Company L.L.0 has made application for preliminary and final plat approval for a project identified as Valley Park Business Center. This plat will create one lot of about 45.6 acres to accommodate the proposed Emerson project. The remaining 51.6 acres will be designated outlots and would be platted for future development in the future. Under MN. Rules 4410.4300 in a city of the second class (i.e. a city with population that is more than 20,000 but less 100,000) an EAW is mandated for new warehousing and industrial development that would exceed 450,000 square feet. As the Opus development property has the development potential for more than 450,000 square feet of development, an EAW is required. To initiate the process, the applicant will have submitted a letter requesting the initiation of the process, the $1000.00 fee required under the City of Shakopee's adopted fee schedule, and an agreement to pay the actual costs of preparing and processing the EAW. Recommendation Staff recommends that the City Council approve moving forward with the EAW process. Budget Impact Because the applicant is required to offset the actual costs of preparation of the EAW, there is no impact on the City's general fund budget. Relationship to Vision This item relates to City Goal B. Positively manage the challenges and opportunities presented by growth development and change. Requested Action The Council is asked to offer and approve a motion directing city staff to initiate the EAW for this project, and to enter into the necessary agreement(s) with city consultant WSB and the applicant.
